Ildar Dadin became the first in Russia convicted of detention at rallies

On December 7, the Basmanny Court of Moscow sentenced to three years the general regime of the opposition activist Ildar Dadin - for "repeated violation of the rules of public event." In 2014, Dadina was detained four times and sentenced to a fine for participating in shares inconsistent with the authorities. This is the first verdict in Russia in July last year Article 212.1 of the Criminal Code of the Russian Federation. However, the very next day, December 8, another opposition activist-75-year-old Vladimir Ionov will perform with his last word in a similar case.

The fault of the 33-year-old Dadin is that he took part in inconsistent protests (they were practically not illuminated in the media and passed almost unnoticed). So, on August 6, 2014, Dadin participated in single pickets in defense of the defendants in the “swamp business”, and on August 23 and September 13 - just in anti -government pickets. Finally, on December 5, 2014, Dadin, along with seven other activists, blocked Myasnitskaya Street with a poster “Yesterday-Kyiv, tomorrow-Moscow”; The participants chanted the slogans in support of the Euromaidan and against the Kremlin junta.

On January 15, 2015, Dadina was again detained - he stood in a single picket in support of the opposition Alexei Navalny. He was given 15 days of administrative arrest. After this period, investigators took up this period. They regarded his actions in 2014 as a criminal offense under Article 212.1 of the Criminal Code of the Russian Federation. According to her text, for “administrative offenses under Article 20.2 of the Code of Administrative Offenses (violation of the rules for conducting street shares), committed more than two times within 180 days”, faces imprisonment up to five years. On February 3, the court placed Dadin under house arrest.

Dadin and his defenders said that by all episodes he was already punished administratively - and could not be convicted of the same actions again. In addition, according to Dadin, at least three cases he participated in single pickets for which the authorities are not required. “I believed and I believe that I did not commit crimes. All my actions for three years of protest activity were extremely peaceful and non -violent, ” said Dadin.

He did not ask for condescension at the hearing. On the contrary, in his last word he performed quite sharply: “We have a state for citizens, and not citizens-for bandits. Only in accordance with this I demand - I do not ask, I demand - to stop this shameful persecution. I was born a free person, and no bandits, introducing anti-constitutional, criminal political laws, can apply them in relation to me. ”

During the process, Dadin also addressed the judge Natalia Dudar. He reminded her that under Article 305 of the Criminal Code of the Russian Federation, the adoption of a deliberately unlawful sentence is punishable by imprisonment for up to ten years.

Although the state prosecutor asked for Dadin a little less - two years in the colony, the judge decided differently - perhaps without forgiving Dadin of his threats.

Natalya Dudar herself has been doing the cases of opposition from the Basmanny Court for more than three years. In 2012-2013, she repeatedly extended the terms of detention to those who were accused of riots on Bolotnaya Square on May 6, 2012. The Dudar also participated in the case of the former vice president of Yukos Vasily Aleksanyan-and the list of people who "contributed to his death" compiled by the new newspaper. Dadin calls himself not a politician, but an indifferent citizen. I believe that any citizen of his country must participate in the life of the country, he should not pass by, should not be “indifferent population,” Dadin said .

Dadina Anastasia Zotova was indignant that, during the investigation, two policemen testified on the picket on September 13 on Manezhnaya Square: “They could not say anything in essence. Dadin says that it was a single picket, and police officers insisted that there were two people, ”said Zotova. Dadin Ildus's father refused to support his son. Moreover, in court he criticized him: “He went in that direction. I am very sorry as a father. Putin is, I think, the country was lucky. We do not communicate with our son for ideological reasons. ”

According to Mediazona, in the courtroom after the sentence announcement, a brawl began between the bailiffs and supporters of Dadin, shouting the judge "Shame!" Someone was taken out of the hall, and two were also laid on the floor in the corridor of the court.

One of the party leaders on December 5 and a member of the Council of the Memorial Center Sergey Davidis in a conversation with Medusa admitted that he did not expect such a sentence. “This is perfect savagery, the situation is absurd in itself, because Dadin on street actions carefully did not violate the law. Three years of real term is a punishment for his perseverance and intransigence, ”says Davidis. The opposition believes that Article 212.1 is absolutely unlawful, "after all, a person is punished twice for the same thing." “In addition, in fact, there are no guarantees of a fair court, since it proceeds from decisions made in administrative cases and actually does not check them again,” Davidis believes.

“Initially, the deputies introduced this amendment, since the authorities are afraid of street activity. Moreover, this intimidation of not leaders of protest, but ordinary participants. Everyone can put himself in this place, as in a “swamp business”, ”he added.

One of the convicts in the “swamp case”, the activist of Yabloko, Nikolai Caucasian, calls the case with Dadin “egregious”. “The sentence to Ildar Dadin is as cruel as possible. Even the prosecutor asked for two years, the judge gave three! I generally thought that Ildar would be given conditionally. This is another signal to society - you cannot defend your rights on the streets. Unfortunately, such an intimidation policy works effectively, ”Caucasian said Medusa.

Article 212.1, according to which Dadin goes to the colony, appeared in the Criminal Code in 2014. One of its authors, State Duma deputy from United Russia, Alexander Sidyakin, said “Medusa”: “I am not a judge, I did not participate in the case. You can just as successfully interview any deputy who voted for this law. Yes, and this comrade Dadina, I did not lead to illegal rallies by the hand. He deliberately went on to this, understood, realized, provoked. ”

The judge probably got acquainted with the characteristics of this person, took into account aggravating and mitigating circumstances, other factors. She was guided by something. But Dadin has repeatedly violated the law, which means from a formal point of view is the subject of this crime, ”Sidyakin answered.

Dadin became the first citizen of Russia convicted under Article 212.1 of the Criminal Code. Three more political activists are waiting for the court under the same article - this is Irina Kalmykova, Mark Halperin and Vladimir Ionov (Medusa reported about the affairs of the last two). The 75-year-old Vladimir Ionov should be in court with his last word on December 8. The state prosecution asks for him three years conditionally.
