Rufer Volodymyr Podrezov, found guilty in the case of the Ukrainian flag on a high-rise , appealed sentence. The Moscow City Court replaced his deprivation of liberty with a restriction of liberty, due to with which the roofer was released in the courtroom.
On December 17, 2015, the Moscow City Court considered the appeal complaint of roofer Vladimir Podrezov and commuted his sentence to 2 years and 3 months freedom restrictions. Podrezov was released in the courtroom. The acquittal four base jumpers, who, like the roofer, were charged under Part 2 of Art. 213 and on Part 2 Art. 214 of the Criminal Code (hooliganism and vandalism committed by a group based on political hatred), left unchanged.
On September 10, 2015, the court of first instance sentenced Podrezov to 2 years and 3 months in prison and acquitted the base jumpers in the case of hanging the flag of Ukraine and painting the skyscraper star on Kotelnicheskaya embankment on August 20, 2014. The defense and the prosecution appealed the verdict.
After the action, four base jumpers were arrested, but the responsibility soon Ukrainian roofer Pavel Ushivets (Grisha Mustang, Mustang Wanted), he was charged in absentia under the same articles. Then there was arrested and sent to a pre-trial detention center as an accomplice of Ushivets Vladimir Podrezov. He later pleaded not guilty to the basejumpers.
We do not agree with the qualification of this case: absolutely it is not clear who Podrezov could have been guided by hatred for, in addition, these actions are more likely to be considered a petty, rather than gross, violation of public order and be regarded as an administrative offense under Art. 20.1 Administrative Code (minor mischief).
