Since the emergence of the Federal List of Extremist Literature, cases of sanctions against library employees have become regular. Even in cases where claims against librarians are formally substantiated by anti-extremist legislation, we often do not consider them legitimate, since this legislation is in conflict with the law "On librarianship." In addition, anti-extremist sanctions against libraries for not having a list of extremist materials, in our opinion, look like an imitation of activity designed to artificially inflate the relevant statistics.
We have combined these cases into a single list, the first part of which covers the period from July 2008 to June 2011, the second part - from July 2011 to June 2012, the third part - from July 2012 to the end of 2014, and the fourth part - from January to December 2015. On December 13, 2016, the prosecutor's office of the Karachay-Cherkess Republic reported that the Adyge-Khabl interdistrict prosecutor's office, during an audit, revealed that the Federal List of Extremist Materials was not systematically updated in a number of institutions. It was about the libraries of the primary school of the village of Adyge-Khabl, the main school of the village of Dubyansk, secondary schools of the village of Adyge-Khabl, the village of Malo-Abazinsk, the village of Erken-Shakhar, the village of Ikon-Khalk, the village of Adil-Khalk and the village of Kyzyl-Togay , as well as about the libraries of Apsuansky, Vako-Zhilevsky, Grushkinsky, Staro-Kuvinsky, Ersakonvsky, Adil-Khalsky, Ikon-Khalsky, Erken-Yurtsky, Erken-Shakharsky and Erken-Khalsky rural settlements. The prosecutor's office submitted 14 submissions to the heads of administrations of municipal districts and rural settlements to eliminate violations of the law and sent 8 administrative claims to the court demanding that schools be required to systematically update the Federal List of Extremist Materials in libraries.
On December 12, 2016, it became known that a submission was made to the head of the education department of the Pribaikalsky district to eliminate the violation of the law, as a result of which 9 persons were brought to disciplinary responsibility. The reason was that the provisions on the school libraries of educational institutions of the district did not provide for a ban on the distribution of extremist literature and the procedure for reconciling the library fund and incoming literature with the Federal List of Extremist Materials.
On November 16, 2016, the North-Western Transport Prosecutor's Office reported that in the course of checking compliance with the legislation on countering extremism, the Volkhovstroy Transport Prosecutor's Office found that the Water Transport Technical School (Shlisselburg, Leningrad Region) did not provide for the procedure for reconciling the library fund and incoming literature with the Federal list of extremist materials, there is no updated list in the library, there are no reconciliation acts. The director of the technical school made a presentation.
On November 3, 2016, the Prosecutor’s Office of the Primorsky Territory reported that an audit conducted in the schools of the Mikhailovsky District showed that five school libraries did not have the Federal List of Extremist Materials, and that existing and incoming literature was not regularly checked against it. The prosecutor's office of the Mikhailovsky district made five submissions to the directors on the elimination of violations of the law, as a result of which four persons were brought to disciplinary responsibility.
On November 1, 2016, the Prosecutor's Office of the Chelyabinsk Region reported that the Magnitogorsk Prosecutor for Supervision of Compliance with Laws in Correctional Institutions warned against violating the law and. O. head of the GUFSIN prison in the Chelyabinsk region. The caveat is that the prison did not have the full version of the Federal List of Extremist Materials. The incident is included in this collection because the prosecutor's claims are identical to those made against the heads of libraries.
On October 27, 2016, the Prosecutor's Office of the Perm Territory announced the results of an audit that took place in the Okhansk City Library named after M. V. N. Serebrennikov. It was found that the institution did not have an updated Federal List of Extremist Materials and did not check against it. The prosecutor of the Okhansky district submitted a recommendation to the library director to eliminate the identified violations, and as a result of his consideration, one employee was brought to disciplinary responsibility.
On October 14, 2016, the prosecutor's office of Karachay-Cherkessia reported that an inspection was carried out in the Urupsky district of compliance with anti-extremist legislation in educational institutions. She showed that all institutions systematically check funds with the Federal List of Extremist Literature, but they have not developed a local act regulating the timing and procedure for staff actions when extremist publications are discovered. The directors of 15 educational institutions were submitted recommendations to eliminate violations of the law.
On October 4, 2016, the prosecutor's office of the Republic of Buryatia reported that the local prosecutor's office had submitted a proposal to the head of the Department of Culture of the Okinsky District Administration to eliminate violations of the law. The reason was that the Oka Central Inter-Settlement Library and the District Children's Library MBUK "Centralized Library System" did not regularly reconcile funds and new acquisitions with the current version of the Federal List of Extremist Materials.
On September 29, 2016, the prosecutor's office of the Trans-Baikal Territory reported that the prosecutor's office of the Zheleznodorozhny district of Chita conducted an audit of the implementation of legislation on countering extremism and revealed violations in five schools and two district libraries. They did not appoint persons responsible for reconciling the library stock with the Federal List of Extremist Materials, such reconciliations were not carried out, and there were no instructions for working with extremist materials. The district prosecutor made two submissions on the elimination of violations of anti-extremist legislation to the chairman of the education committee of the administration of Chita and the director of the centralized library system of Chita.
On September 21, 2016, the prosecutor's office of the Republic of Tatarstan reported that the Bugulma city prosecutor's office had made submissions to eliminate violations of the law and bring the perpetrators to disciplinary responsibility against the directors of three local educational institutions. The reason was that school libraries did not have a fresh version of the Federal List of Extremist Materials and no reconciliation of funds and new acquisitions was carried out with it.
On August 22, 2016, the prosecutor's office of the Tula region reported that the prosecutor's office of the Volovsky district sent nine statements of claim to the court obliging Baksakovskaya, Boryatinskaya, Verkhoupskaya, Dvorikovskaya, Krasnodubrovskaya, Lutovskaya, Nepryadvenskaya, Stationary secondary educational schools, as well as the Volovo Education Center to update the federal list of extremist materials in school libraries. In particular, at the time of the prosecutor's check, the Station School had a list of 3,370 items, while its current version contained 3,762 items.
On July 26, 2016, the prosecutor's office of the Tula region reported that the Efremovskaya interdistrict prosecutor's office made a submission to the director of the Lastochka children's health camp. The reason for the sanction was that the camp library did not have the Federal List of Extremist Materials and no reconciliation of the fund with it was carried out.
On July 26, 2016, the prosecutor's office of the Krasnodar Territory reported that the prosecutor's office of the Lazarevsky district of Sochi had made six submissions to the heads of the district's institutions, including organizations in the sanatorium and resort sector. The reason was that the libraries of these institutions did not have up-to-date versions of the Federal List of Extremist Materials, and reconciliation of funds and incoming literature with it was not carried out regularly or was not conducted at all.
On July 15, 2016, the North-Western Transport Prosecutor's Office reported that the Vologda Transport Prosecutor's Office revealed violations of anti-extremist legislation in the Veliko-Ustyug branch of the Moscow State Academy of Water Transport (Veliky Ustyug River School) and the Vologda College of Railway Transport - a branch of the St. Emperor Alexander I. In particular, there was no Federal List of Extremist Materials in the libraries of educational institutions. Two submissions were made to the heads of institutions.
On July 6, 2016, the Prosecutor’s Office of the Amur Region reported that the Blagoveshchensk Prosecutor’s Office, during an audit, found that the library of School No. 5 in 2015 and 2016 did not check the catalog with the Federal List of Extremist Materials, and there was no information on compliance with the law in the duties of a teacher-librarian on countering extremist activity. Similar violations were revealed in schools Nos. 10 and 22 and lyceum No. 6. School directors were submitted recommendations, as a result of which the violations were eliminated, and officials were reprimanded.
On July 5, 2016, the prosecutor's office of the Tomsk region reported that the prosecutor's office of the Teguldetsky district had made a submission to the director of the MKU "Teguldetsky district centralized library system". The reason for this was that the library did not have an up-to-date version of the Federal List of Extremist Materials and did not check the incoming and available literature with it.
On July 4, 2016, the prosecutor's office of the Republic of Buryatia reported that the prosecutor's office of the Tarbagatai district had made representations to the director of the Tarbagatai secondary school, in the library of which " preventive and security measures to ensure security against extremist activity " were not properly observed, as well as to the director of the Tarbagatai CBS with rural branches (the essence of the violations in the CBS is not specified, but it follows from the report that they are related to anti-extremist measures).
On June 30, 2016, it became known that the prosecutor's office of the Bryansk district of the Bryansk region brought a protest against the regulation on the library of the Michurinsky Agricultural College, which is part of the Bryansk State Agrarian University. The document did not contain a direct ban on the distribution of extremist literature.
On June 27, 2016, the prosecutor's office of the Bryansk region reported that the prosecutor's office of the Zhukovsky district had filed a motion with the director of the Zhukovsky inter-settlement central library to eliminate violations of the law and bring to disciplinary responsibility those responsible for the fact that the library had not reconciled funds since March 30, 2016 and incoming literature with the Federal List of Extremist Materials.
On June 23, 2016, the prosecutor's office of the Bryansk region reported that the prosecutor's office of the Klintsovsky district filed a complaint with the management of the children's health camp JSC "Bryanskagrozdravnitsa" due to the fact that the camp's library did not have the Federal List of Extremist Materials and no reconciliation of the fund and incoming literature with it was carried out. The violation of the law has been eliminated.
On June 17, 2016, the Prosecutor’s Office of Dagestan reported that most of the schools in the Dakhadaevsky district of the republic did not contain a direct ban on the distribution of extremist literature in the regulations on libraries and did not establish a procedure for reconciling the library fund and incoming literature with the Federal List of Extremist Materials. The prosecutor's office of the Dakhadaevsky district brought 20 protests against the provisions on libraries that did not meet the requirements of the law.
On June 14, 2016, it became known that the Kuzminskaya Interdistrict Prosecutor's Office of Moscow brought two protests against the regulations on the libraries of school No. Mikhailov and School No. 1386. The regulations did not contain a direct ban on the distribution of extremist literature. Based on the results of consideration of the protests, the documents were brought into line with the law.
On June 8, 2016, the Yeisk Interdistrict Prosecutor's Office of the Krasnodar Territory reported that it had identified 24 violations in the activities of educational institutions of the Yeisk District. Regulations on the libraries of a number of institutions did not contain a direct ban on the distribution of extremist literature, and they did not establish the procedure for checking the library fund and incoming literature with the Federal List of Extremist Materials. The prosecutor's office brought protests against the documents, as a result of which the violations were eliminated.
On May 26, 2016, the prosecutor's office of the Tomsk region reported that the Kolpashevo city prosecutor had submitted proposals to the heads of nine educational organizations to eliminate violations of anti-extremist legislation. The reason was that school libraries did not have an up-to-date version of the Federal List of Extremist Literature and no reconciliation of funds with it was carried out.
On May 12, 2016, the prosecutor's office of Karachay-Cherkessia reported that the prosecutor's office of the Karachaevsky district had made submissions to eliminate violations of the law against 16 directors of educational institutions in the district. The reason was that the institutions' libraries were not reconciled with the current version of the Federal List of Extremist Materials.
On May 10, 2016, the prosecutor's office of the Republic of Altai reported that the prosecutor's office of the Chemalsky district had made representations to the directors of two local schools. The reason was, in particular, the fact that school libraries were not reconciled with the Federal List of Extremist Materials. Two officials were brought to disciplinary responsibility.
On April 29, 2016, the Prosecutor’s Office of the Tomsk Region reported that the Prosecutor’s Office of the Kargasok District filed a motion to eliminate violations of the law on combating extremist activity against the head of the Kargasok inter-settlement central district library due to the fact that the library did not reconcile funds and new acquisitions with the Federal List of Extremist Materials. It is reported that the guilty official was brought to disciplinary responsibility.
On April 28, 2016, the prosecutor's office of the Kamchatka Territory reported that the prosecutor's office of the Tigilsky district had made submissions to the directors of the Kovran and Ust-Khairyuz secondary schools to eliminate violations of the law on countering extremist activity. The reason was that the schools did not have an order to reconcile library collections and new acquisitions with the Federal List of Extremist Materials, and the corresponding reconciliations were not carried out in the libraries of these schools. It is reported that the submissions were satisfied, two officials were brought to disciplinary responsibility.
On April 21, 2016, the prosecutor's office of the Chechen Republic announced that it had made a submission to the head of the local penal colony No. materials. The incident is included in this collection because the prosecutor's claims are identical to those made against the heads of libraries.
On April 21, 2016, the prosecutor's office of the Trans-Baikal Territory reported that in the Ononsky district, the prosecutor's office made a submission to the director of the Kulusutai secondary school. One of the identified violations was the lack of an up-to-date Federal List of Extremist Materials in the school library.
On April 20, 2016, the Prosecutor’s Office of the Leningrad Region reported that the Podporozhye City Prosecutor’s Office had submitted six submissions to the heads of regional educational institutions to eliminate violations of the law due to the fact that the libraries of these institutions did not check the funds with the Federal List of Extremist Materials.
On April 20, 2016, it became known that the prosecutor's office of the Ust-Kansky district of the Altai Republic, during an audit, established that the Chernoanui rural library did not regularly check existing and incoming literature with the Federal List of Extremist Materials. The department made a submission addressed to the director of the Ust-Kansk CBS with a demand to eliminate these violations, as a result of its consideration, two officials were brought to disciplinary responsibility.
On April 15, 2016, it became known that the Ivanovo transport prosecutor's office submitted a proposal to eliminate violations of the law to the head of the Northern Center for Scientific and Technical Information and Libraries of the Northern Railway. The reason for this was the results of the audit, which showed that in the Linear Technical Library of Ivanovo Station, despite the regular updating of the Federal List of Extremist Materials, the last inventory of literature was carried out in 2012.
On April 12, 2016, the Prosecutor's Office of the Chelyabinsk Region reported that during an inspection of correctional colony No. 21, the Chelyabinsk Prosecutor's Office for Supervision of Compliance with Laws in Correctional Institutions found that the library did not have an up-to-date list of extremist materials. The head of the colony was warned against violating the law.
On April 8, 2016, the Prosecutor's Office of the Murmansk Region reported that during an audit of compliance with anti-extremist legislation conducted by the prosecutor's office of Monchegorsk, it was found that officials of a number of libraries were not taking steps to update the Federal List of Extremist Materials. Based on the results of the check, a submission was made to the head of one of the libraries, and warnings were issued to two officials, but it is not clear from the statement of the prosecutor's office which of these sanctions were issued in connection with the mentioned violation.
On April 7, 2016, it became known that the Boksitogorsk City Prosecutor's Office of the Leningrad Region, based on the results of an audit of the implementation of federal legislation in institutions of secondary vocational education, submitted a proposal to eliminate violations of the law addressed to the head of one of the institutions. The reason for this was that the library had an incomplete version of the Federal List of Extremist Materials, which consisted of only 200 items. The prosecutor's office also filed protests against local acts that contradicted the law and initiated several administrative proceedings, but it is not clear from the agency's report whether this was due to a violation of anti-extremist legislation or to numerous other violations identified during the inspection of educational institutions.
On April 6, 2016, the prosecutor's office of the Chechen Republic announced that it had conducted an inspection of compliance with anti-extremist legislation in pre-trial detention center No. 1 in Grozny. The department found, in particular, that in the library of the pre-trial detention center, reconciliations of existing and incoming literature with the Federal List of Extremist Materials were carried out " formally and unsystematically ." The deputy prosecutor of the republic submitted a proposal to the head of the detention center to eliminate violations of the law, which was carried out, and officials were brought to disciplinary responsibility.
On March 30, 2016, the prosecutor's office of the Republic of Altai reported that the prosecutor's office of the Turochaksky district made a submission to the director of the Dmitrievskaya secondary school, as a result of which the perpetrators were brought to disciplinary responsibility. The reason was that in the school library the Federal List of Extremist Materials was not available in the latest version and, thus, the library did not have information about 1329 prohibited materials.
On March 28, 2016, the prosecutor's office of the Republic of North Ossetia reported that the prosecutor's office of the Zaterechny district of Vladikavkaz issued a warning about the inadmissibility of violations of the law against three officials of the FKU SIZO-1 of the Federal Penitentiary Service of Russia for North Ossetia-Alania. The reason was that the SIZO staff did not check the literature handed over to the prisoners against the Federal List of Extremist Materials.
On March 28, 2016, the prosecutor's office of the Krasnodar Territory reported that the prosecutor's office of the Kushchevsky district had protested the order of the director of one of the local schools, relating to the procedure for the work of the school library with extremist materials. As reported, according to the order, "the procedure for marking such documents and issuing them to users was established, an application form was approved, on the basis of which a document with extremist content is issued to the user" . The order also stated that "a specially allocated place of storage for the discovered documents of extremist content is not required . " At the protest of the prosecutor's office, the order was brought "in line with the requirements of the law . "
On March 24, 2016, the prosecutor's office of the Kostroma region reported that the prosecutor's office of the Krasnoselsky district had made eight submissions to the directors of local schools. The reason was that the provisions on the work of school libraries did not contain items regulating the issue of extremist materials, in particular, requiring regular reconciliation of funds and new arrivals with the Federal List of Extremist Materials. The submissions were considered, eight officials were brought to disciplinary responsibility.
On March 24, 2016, the prosecutor's office of the Tomsk region reported that the prosecutor's office of the Verkhneketsky district had made submissions to eliminate violations of the law against the directors of Klyukvinskaya and Yagodninskaya secondary schools. The reason was that the school libraries did not regularly check the collection and incoming literature with the Federal List of Extremist Materials. It is reported that one of the submissions was considered, the identified violations were eliminated, the guilty official was brought to disciplinary responsibility, and the second is under consideration.
On March 21, 2016, the prosecutor's office of the Republic of Tatarstan reported that the Bugulma city prosecutor's office had made submissions to the directors of five local educational institutions. The reason was that the schools did not have a Federal List of Extremist Materials and there was no reconciliation of funds with it.
On March 17, 2016, the prosecutor's office of the Arkhangelsk region reported that the prosecutor's office of the Lensky district had submitted a proposal to eliminate violations of the law to the director of the Lensk secondary school. During the audit, the department found that the school library did not check the library funds and new acquisitions with the Federal List of Extremist Materials.
On March 14, 2016, the prosecutor's office of the Bryansk region announced that the prosecutor's office of the Rognedinsky district had submitted a proposal to eliminate violations of the law to the address of the Rognedinsky regional library association. The reason was that the association had not reconciled library collections and new acquisitions with the Federal List of Extremist Materials since September 2015. It is reported that the violations were eliminated, 13 officials were brought to disciplinary responsibility.
On March 11, 2016, the prosecutor's office of the Republic of Tatarstan reported that the prosecutor's office of the Sabinsky district had made submissions to eliminate violations of the law against the heads of 22 local educational institutions. The reason was that the libraries of educational institutions did not have the Federal List of Extremist Materials and no book stock was checked against it.
On March 9, 2016, the prosecutor's office of Karachay-Cherkessia reported that the prosecutor's office of the Malokarachaevsky district filed lawsuits with the court to oblige the heads of the Dzhaginsky, Krasnokurgansky, Rimgorsky, Elkushsky and Kichi-Balyksky rural settlements to bring the lists of extremist materials of rural libraries in line with the Federal List of Extremist Materials.
On March 4, 2016, it became known that the prosecutor's office of the Lovozero district of the Murmansk region found that the regulations on the libraries of seven structural divisions of the Lovozero inter-settlement library did not contain a ban on the distribution of extremist materials and did not oblige employees to withdraw such materials from the funds. In addition, these libraries did not check the incoming and available literature against the Federal List of Extremist Materials. The prosecutor's office filed seven protests against the provisions on libraries and made one motion to eliminate violations of the law.
On March 2, 2016, it became known that in the city of Kasli, Chelyabinsk region, the prosecutor's office announced a warning against violating the law on countering extremism against the pastor of the Light of the Gospel church. The reason was that the church library did not reconcile the fund and new acquisitions with the Federal List of Extremist Materials.
On March 2, 2016, the prosecutor's office of the Bryansk region reported that the prosecutor's office of the Zlynkovsky district had made submissions to eliminate violations of the law and bring the perpetrators to disciplinary responsibility against the heads of 9 local schools and the head of the district education department. The reason was the fact that school libraries were irregularly reconciled with the latest version of the Federal List of Extremist Materials.
On March 1, 2016, the prosecutor's office of the Magadan region reported that the prosecutor's office of the Olsky district had filed a motion to eliminate the violation of the law against the director of the secondary school in the village of Ola, as a result of which the official was brought to disciplinary responsibility. The reason was that the school library regularly checked the fund with the Federal List of Extremist Materials.
On February 11, 2016, it became known that the prosecutor's office of the Vedensky district of the Chechen Republic established that a number of schools in the district did not have a federal list of extremist materials and that library collections and incoming literature were not checked. The directors of five educational institutions were presented with recommendations on the need to eliminate violations of the law.
On January 25, 2016, the prosecutor's office of the Magadan region reported that the prosecutor's office of the Olsky district had submitted a proposal to eliminate violations of the law to the director of the Olsk Central Library. I.A. Varren, as a result, the violations were eliminated, one person was brought to official responsibility. The reason was that the library regularly checks the fund with the Federal List of Extremist Materials.
On January 15, 2016, the prosecutor's office of the Republic of Dagestan announced the results of an audit conducted by the prosecutor's office of the Leninsky district of Makhachkala. The department found that the provisions on the libraries of the non-state gymnasiums Sahab, Razvitie and Zemfira " " do not contain a direct ban on the storage and distribution of extremist materials . Similar violations were found in two state vocational education institutions - the Dagestan Center for Culture and Arts and the Dagestan Art College. As a result of the audit, protests were brought against the provisions on libraries and submissions were made to the directors of institutions to eliminate violations of the law, as well as warnings were issued about the inadmissibility of violations of the law. It should be noted that the anti-extremist legislation contains a ban only on the mass distribution of extremist materials and their storage for the purpose of mass distribution, and not on storage as such and not on individual issuance to the reader.
On January 11, 2016, the prosecutor's office of the Ryazan region announced the results of an inspection conducted by the prosecutor's office of the Ryazan region in the Central District Inter-Settlement Library in December 2015. In accordance with internal instructions, library staff checked the library catalog with the Federal List of Extremist Materials once every six months. The prosecutor's office found that since the last reconciliation in August 2015, the list has significantly expanded. The department considered that the library staff was not fully taking measures to combat extremism, and sent a submission to the library director.
On January 11, 2016, the prosecutor's office of the Omsk region reported that the prosecutor's office of the Omsk region during the audit found that in some schools in the region the library fund was not properly studied in order to identify materials that were duly recognized as extremist and included in the Federal List of Extremist Materials. 36 directors of educational institutions of the district were warned about the inadmissibility of violating the law on countering extremist activity in the process of teaching pupils by distributing literature recognized as extremist.
