In the city of Kola, Murmansk region, a criminal case on an attack on a native of Azerbaijan was dismissed in connection with reconciliation with victim.

On February 15, 2016, the Magistrate's Court of Court District No. 1 of the Kola Judicial District of the Murmansk Region terminated the criminal case against Devyatkina, accused under paragraph "b" part 2 article 116 of the Criminal Code (beatings motivated by hatred), in connection with reconciliation with victim.

According to the case file, on December 22, 2015, Devyatkina, in a state of alcoholic intoxication, attacked a native of Azerbaijan in the trading room of the Dixy store, punched her twice in the face. The attack was accompanied by xenophobic insults.

Before the court session, the victim received a petition in which the latter asks the court to stop the criminal case against Devyatkina due to reconciliation with her and the absence of claims against the defendant.

Devyatkina had no previous convictions, during the preliminary investigation of the criminal case she fully admitted her guilt in the crime, during the trial she reconciled with the victim, apologized and made amends for the harm caused.

The victim asked to stop the criminal case, the defendant did not object to this, the public prosecutor and the defender consider it possible to stop the criminal case in connection with the reconciliation of the parties. The circumstances preventing the termination of the criminal case, the court has not established.

No civil action has been filed.

There is no real evidence.

The court terminated the criminal case against Devyatkina, accused under paragraph “b” of part 2 of article 116 of the Criminal Code (beatings motivated by hatred), in connection with reconciliation with the victim.

Devyatkina's preventive measure in the form of a written undertaking not to leave the place and proper behavior should be left unchanged until the verdict enters into force, and canceled upon entry.
