The case of the leader and members of the movement "Restrukt!"

On March 1, 2016, the Babushkinsky Court of Moscow returned to the prosecutor's office the case of members of the Restrukt organization and its leader Maxim (Tesak) Martsinkevich. They are accused of numerous attacks on merchants smoking mixtures - spices. M. Martsinkevich is also accused of inciting national hatred.

Recall that the group is accused of beating people in Moscow using stun guns, gas cartridges and metal batons, taking away their belongings, and publicly pouring paint and other substances on them. All this was done in 2012-2014 as part of the Occupy-Drugophilia movement organized by them, associated with the fight against spice dealers. All of them, depending on their deeds, are presented with charges under Art. 162 (robbery), 167 (deliberate destruction or damage to property), 213 (hooliganism), 161 (robbery), 111 (causing grievous bodily harm, including resulting in the death of a person) of the Criminal Code. M. Martsinkevich is charged with one episode of robbery and Article 282 of the Criminal Code (inciting national hatred or enmity). It's related to the book. M. Martsinkevich "Restrukt", which experts recognized as extremist.

Investigation with respect to the accused was completed in January 2016. However, Babushkinsky court returned the case to the supervisory authority to clarify the dates commission of certain crimes, as well as the jurisdiction of the case. Moscow City Court recognized as lawful the return of the case against ten members of the organization "Restruct" to the Prosecutor General's Office of the Russian Federation.

The Basmanny Court of the capital extended until November 4 the term of detention of Maxim Martsinkevich.

During the search, one of the suspects was seized the book "Restruct" written by Martsinkevich. Examination found there signs of inciting national hatred. As a result of the GSU SKRpo Moscow initiated a new criminal case against Tesak under Article 282 of the Criminal Code. Martsinkevich was transferred to Moscow from a colony where he was serving a sentence for posting three xenophobic videos on a social network. . The Investigative Committee also considered the issue of charging the members of Restrukt with creating an extremist community (Article 282.1).
