
The collegium of the Supreme Court for military personnel reduced the 19 -year -old Muscovite Kirill Banetsky, convicted for participating in the ATO in Ukraine, for two months - from 6 and a half years to 6 years 4 months of a general regime. This was reported by RAPSI.
Banetsky himself insisted that he returned to Russia voluntarily and only "in connection with the detention, he did not manage to declare a voluntary exit from the illegal armed formation." As in the court of first instance, he emphasized that he pleads guilty and repent.
The lawyer of the young man noticed that the calls to Banetskiy to extremism dates back to the time he has not yet reached the age of majority. He also recalled that the convict collaborated with the investigation and testified to other persons. In addition, the defender noted that due to age, Banetsky was affected by senior comrades.
The prosecutor of the main military prosecutor's office agreed with part of the arguments of the lawyer and did not object to the softening of the sentence.
In April 2015, without finishing the graduation class, he left for Ukraine and joined the armed formations of the Right Sector. Participated in the ATO. In May 2016, he returned to Russia.
The verdict of Banetskoy was sentenced on September 16, the college of the Moscow District Military Court, chaired by Alexei Grinev . The defendant was announced guilty under part 2 of article 280 (public calls for extremism via the Internet; up to 5 years of colony), part 2 of Article 282.2 (participation in the activities of an extremist organization; up to 4 years) and part 2 of Article 208 of the Criminal Code (participation in illegal armed formation; from 8 to 15 years).
As additional punishments, Banetsky was imposed a restriction of freedom after leaving the colony (for what time - not specified) and an annual ban on publication on the Internet.
In April 2015, the collegium, chaired by Judge Grinev , sentenced the third case of publicist Boris Stomakhin . Politsyk was added six months to a period of six and a half years of strict regime.
Banetsky wanted to take part in Euromaidan, but could not leave for Ukraine, because at that time he was a minor. At school, Banetsky wore Ukrainian symbols and expressed support to Ukraine. Then he placed three publications on the Internet, for which he was charged with the 280th article.
In April 2015, as soon as the young man turned 18 years old, he, without graduating from the 11th grade, left the house and left for Ukraine. There he joined the "Right Sector". In his video message, he explained that there are more ideological people, and he arrived "purely because of ideological views." "I was tired of lies from television, the lies of the president, lies of the State Duma, tired of the cop lawlessness," Banetsky said.
Banetsky spent several weeks in the training camp. In June 2015, he joined a separate company Aratt, formed from members of the Right Sector and Maidan activists. Since autumn, it was claimed, Banetsky began to periodically leave with the fighters of the Azov regiment and the Chechen battalion named after Sheikha Mansur to the front line in the Shirokin area to participate in the battles against the DPR and LPR. Why, consisting in the "right sector", he fought as part of other units, the Russian media did not specify. It was also not explained what was done in Shirokin, located in the Donetsk region, LPR militants.
However, in the spring of 2016, Banetsky decided to return to his homeland. At the Russian embassy, he received documents for returning, and on May 1, at the entrance to Russia, he was detained by border guards in the Bryansk region.
