Rapper Ptah was fined under Art. 282

In Moscow, a court found the rapper guilty of inciting hatred against activists of the Antidealer movement.

March 16, 2017 Presnensky District Court of Moscow found rapper David Nuriev ("Ptahu") guilty of inciting hatred to representatives of the Antidealer public organization, which provides assistance to law enforcement agencies. Nuriev was sentenced under Part 1 of Art. 282 of the Criminal Code to a fine of 200 thousand rubles.

Nuriev fully admitted his guilt, so the case was considered in a special order.

Recall that the case against Nuriev was initiated by the Meshchansky Interdistrict Investigative Department of the Investigative Committee for the Central Administrative District of Moscow of the Investigative Committee of Russia for the fact of his speech on the "Anti-dealer" movement, which he delivered on 23 September 2015 in the club "16 tons".

As the investigation stated, Nuriev " publicly delivered a speech, in the text which contains a set of linguistic features degrading dignity and inciting hatred or enmity against a group of persons, united on the basis of "assistance to law enforcement agencies in search and detention of criminals" and who are representatives public organization "Anti-dealer ". Movement "Anti-dealer", fighting drug dealers, participates in joint operations with law enforcement agencies and is related to detention of rappers Guf and Slim in Krasnoyarsk in 2015. The concert where Nuriev delivered a speech that caused complaints from law enforcement agencies, took place precisely in support of Guf and Slim - Ptakha's colleagues in the rap team Centr.

We consider the sentence handed down to Ptah unlawful. In his speech it was possible to detect insults against the Antidealer activists and a call for illegal actions - damage to their property, but no calls for there was no violence in the rapper's speech. In addition, we believe that persons providing assistance to law enforcement agencies, are not a vulnerable social group, requiring protection in the form of anti-extremist legislation. We are also convinced is that the vague concept of "social group", which is source of abuse should be excluded from the anti-extremist articles.
