
In the Tver court, the consideration of the case of the nationalist Stanislav Zimovts continues. He is accused of applying violence to a policeman who was not dangerous for life and health (part 1 of article 318 of the Criminal Code). Zimovets is the first of the defendants in the “case of March 26”,which abandoned a special order. Now the court considers evidence of the prosecution and defense, as well as other details of the events on March 26 in Moscow. Zimovtsa is defended by the lawyer of the international human rights group "Agora" Svetlana Sidorkina.
Guardsman and policeman
Today, the victim of the Rosgvardiy, Lieutenant Colonel of OMON Vladimir Kotenev and police officer Alexei Klimov, who shot the video on the video, were interrogated in court.
Kotenev-a young tall sports man, refused to comment on the comments, referring to the fact that "not in the mood." Klimov-a very gray-haired middle-aged operative-also did not speak with the ATS-info, motivating this by the fact that he was a witness in the case.
Kotenev testified that during the dispersal of the action on March 26 he felt a blow in the back, turned around and saw a lying piece of brick. In his testimony, Klimov said that he was engaged in video filming on Tverskaya, and saw how Zimovets throw a brick and went into the crowd. Klimov turned off the camera, followed him and informed his police colleagues about him.
After the meeting, Sidorkina told the OVD-Info, during the interrogation in the court of law enforcement officers it turned out that Klimov was facing Kotenev, and thus, it was not very clear how Klimov could see that Kotenev was throwing a winter-man in Kotenev.
The flight of bricks
Zimovets was born in the city of Volzhsky Volgograd region. In 2005-2007 he served in Chechnya - he was engaged in the clearance of roads. He studied at the Marine School, but threw his studies because of a lack of money. He came to Moscow to work, worked at a construction site in the suburbs. He lived in a change house, where he was detained.
Zimovets does not hide nationalist views. Judging by the photographs on his VKontakte page, Previously, the Zimovets was related to the legal organization “Resistance” (created by the famous fighter of mixed martial arts Roman Zentsov).
In the jacket “Resistance”, T -shirt of the Ukrainian musical group “Sokira Perun” and even pants with nationalist symbols of Zimovets appeared at meetings in the Tver district court.

Sidorkina Zimmovets said that on March 26 he walked in the center of Moscow and in Pushkinskaya Square, where the action was held, hit accidentally. Outraged by the excessively gesture actions of law enforcement officers regarding the demonstrators, the winter -man took a small piece of brick and threw it towards riot police.
According to investigators, the brick hit the castle commander of the 2nd operational battalion of riot police in Moscow by Lieutenant Colonel Vladimir Kotenev.
The indictment says:
Realizing the sudden criminal intent that has arisen, aimed at using violence that is not dangerous to life and health, acting intentionally, realizing the social danger of their actions, anticipating the inevitability of socially dangerous consequences in the form of a violation of the management order and wanting their advance ...
According to the investigation, after that, the winter -man "changed clothes for the purpose of conspiracy, hid his jacket into a backpack, took out a traumatic gun and returned to the place of events, continuing to provoke those present to illegal actions." The accused himself claims that he always carries with him a traumatic gun due to the fact that he was once beaten-he needs a weapon for self-defense, and he took off his jacket because of the heat. Also, when detained by the winter, a knife was found.
On March 29, the winter house was detained, and on April 1, the court sent him for two months in a pre -trial detention center. On April 26, the Moscow City Court secretly examined the arrest of the accused. Sidorkina, who at this point had already submitted an application to the Investigative Committee on joining the case as a defender, no one announced the planned meeting. The appeal was considered at 11:15, and information about this on the court website appeared only at 15:00. On May 29, the Tverskaya District Court extended the arrest of the Zimovts until November 10.
In the first testimony, the victim riot police said that the brick hit him in the middle of his back and he felt severe pain. The medical examination conducted on the initiative of the investigation found on the back of a policeman hematoma. According to the winter house, on the operational video, which captured a throw of brick, it can be seen that the brick enters Kotenev into the lower back on the left, and then falls, hitting the police buttock.
After the investigators showed the victim this shooting, he stated that he was mistaken at the first interrogation. Kottenov explained the contradiction in his testimony by the fact that the body armor softened the blow. During repeated interrogation, he also said that hematoma on his back could not appear at the rally day, but even before the rally after the morning training.
Zimovets himself said that he was not aiming at the policeman, but in the ground next to him:
This all happened by chance. The police committed crimes: they grabbed, beat, and people just walked. But even if there was a rally, they (riot police) did not have the right to behave like that. I could not stand it and threw the brick, but I was aiming not at a person, but to an empty place, so that the commander would pay attention: if it goes on, then we can answer. Unfortunately, the brick hit the police officer.
Svetlana Sidorkina told the OVD-Info that at the moment the Zimovets did not plead guilty to the charges against him: the very fact that Zimovets was throwing a brick was not necessary to lead to criminal liability (for example, administrative punishment could also lead). Zimovets himself did not see that the brick abandoned by him was in Kotenev. He is not sure that he really got into the policeman.
Methods of declension
The first two weeks after the detention of the Zimovts were taken every day to investigative actions - he left the pre -trial detention center at 6 in the morning and returned late at night, did not eat normally and did not sleep. At the same time, for the "Butirka", the winter house for an unknown reason was placed in a special block for those sentenced to life imprisonment. As the lawyer Sidorkina latertold , from food he was given only a dry ration, from which the winter honey was ill. The insulator doctors found that he had gastritis, but did not offer treatment. Members of the PMC, who twice came to the Butyrka to meet him, both times did not find the winterbeat in the cell.
The lawyer on purpose Diana Tatosov (Sidorkina went into the case later) did not explain anything to her client and appeared only with the investigator to sign the protocols of familiarization with the documents. According to the Zimovts, she incuted him to plead guilty and agreed to a special procedure for considering the case in court, which does not imply a study of evidence of guilt.

At the same time, he did not see a single volume of his own criminal case - the lawyer did not explain that the accused had the right to get acquainted with them. Zimovets even apologized to Kotenev, as he believed that the police officer had a bruise from the brick.
Tatosova, despite the requests of her client, did not contact his parents. Volgograd police who searched their houses in Volzhsky did not explain what their son was accused of and where they were - they only said that he was detained for a rally in Moscow. Parents began to call the Moscow ATS, but there they did not answer anything specific and for some reason threatened with criminal liability for giving false testimony.
It is worth noting that the desire to do everything without unnecessary noise is characteristic of investigators in the “case of March 26”. The fact that the four defendants in the case were in jail became known only on April 13, after they were charged. At the same time, they were detained in late March and early April. At first, lawyers for their intended purpose worked with them - and all four concluded an agreement with the investigation, pleading guilty.
After consultations with Sidorkina, the winter-man refused to be a special order and asked the court to provide him with the opportunity to get acquainted with the volumes of the criminal case. The conditions of detention in the insulator in which it was originally placed, Zimovets called it unbearable. According to him, he agreed to a special order of the judicial investigation, because he was tired and "wanted to be lagged behind him."
Two other defendants in the “March 26 case”, who have gone to a special procedure for considering cases, have already received deadlines. Yuri Kulia was sentenced to eight months in prison in a colony-settlement, and Alexander Shpakov -to half the years of the colony of general regime. Andrei Kosykh , who, unlike Shpakov, Kulia and Zimovts, is accused under Part 2 of Art. 318, is in the Vodnik pre -trial detention center, the trial has not yet begun. The fifth person involved in the case of Dmitry Gerekin was detained on May 14 and he is the only one of all from the very beginning completely denies guilt.
