The court decided, but did not answer

The verdict in the case of the murder of Boris Nemtsov left out of attention the main issues

On July 13, a verdict was announced in the Moscow District District Military Court in the case of the murder of Boris Nemtsov . Prior to this, the jury found five accomplices guilty, after which a professional judge determined the measure of punishment. The process lasted since October 2016. All attempts by representatives of the family Boris Nemtsov to receive answers to the main questions about the crime were suppressed. Who is the customer of the murder? Where is the intermediary Ruslan Mukhudinov (driver Ruslan Geremeyev)? Why didn’t the investigation find Ruslan Geremeyev himself (deputy commander of the North battalion)? Why is Ramzan Kadyrov’s interrogation refused? Where is the pistol from which the murder was committed? Where are the entries of the FSO video cameras? What was the motive of the crime - for what and why were Boris Nemtsov killed? The investigation did not answer any of these questions.

Both during the investigation and during the court the impression that an invisible barrier was established before investigators and judges, which was categorically impossible to overcome on the way to the truth: the closer the person is to Ramzan Kadyrov , the less likely that the investigation and the court will be able to ask him questions, not to mention the receipt of answers.

Boris Nemtsov was killed late in the evening of February 27, 2015 on the Big Moskvoretsky Bridge. A week after the murder, the investigation detained a group of young Chechens, who were accused of committing a crime (another participant in the group, Beslan Shavanov , died during the detention).

Zaur Dadaev (according to the investigation and court decision - a direct killer) and Anzor Gubashev (his driver) after the detention admitted to the perfect murder, telling the investigation in detail how it was prepared and committed. Their involvement in the attempt was confirmed by records from street video cameras, examinations and telephone conversations. However, later both defendants said that confessions from them were received under torture.

The jury found five accused guilty of the murder for hiring (part 2 of Article 105 of the Criminal Code of the Russian Federation), that is, the investigation and the court qualified the murder of Nemtsov as a murder with the aim of banal profit. The Prosecutor General’s Office requested a lifelong conclusion for Zaur Dadaev, for Anzor Gubashev - 23 years, for Shadid Gubashev - 21 years old, for Temirlan Eskerkhanov - 19 years and for Hamzat Bakhaev - 17 years of colony.

According to the verdict of Judge Yuri Zhitnikov , the direct participants in the murder of Zaur Dadaev and Anzor Gubashev received 20 and 19 years in a maximum security colony. Shadid Gubashev, Temirlan Eskerkhanov and Khamzat Bakhaev, who helped the killers prepare a crime and then hide from Moscow, were sentenced to 16, 14 and 11 years of imprisonment, respectively.

For each of the conspiracy participants, the court made a fine of 100 thousand rubles, and the killer of Dadaev, who was at the time of the murder by an employee of the Chechen Ministry of Internal Affairs, deprived the title of lieutenant and the Order of the courage received "for the fight against terrorism in the North Caucasus."

The judge, thus, saved Zaura Dadaev from a life sentence, and each of his assistants reduced a period of five to six years requested by the accusation. The presiding judge said that when pronouncing the sentence, he took into account the mitigating circumstances, in particular, the former combat merits of Dadaev, as well as the presence of other defendants in chronic diseases and young children.

None of the defendants pleaded guilty.

Some defendants met the sentence with smiles.

Ramzan Kadyrov publicly stated that he considers them to be unproven.

The same position (word for word) is occupied by lawyers. The defender Dadaeva Shamsudin Tsakaev said that he would achieve an excuse for the client: "His fault has not been proven."

Moreover, in the comments to the verdict there were balanced and rational political assessments. “Nemtsov did a lot for the Chechen Republic during the war. We respect him very much. We would not have done this, ”said Brother Zaura Dadaev Shakhmutdin .

The truth about the murder of Boris Nemtsov looks like the state military secret of Russia , which is carefully guarded by power structures and the court.

It is impossible to get away from the impression that the senior leadership of Russia is known for the truth of the murder of Boris Nemtsov . The first persons of the state know who ordered the crime and why. And the investigation was strictly outlined by the circle of names and actions that it can work on without crossing the red line. And named names that cannot be approached.

The verdict pronounced by the court leaves an opportunity to further reduce the deadlines for serving sentences-there is no doubt that the perpetrators will behave approximately in the colony and deserve the favor of the authorities up to parole.

The murder of a politician for the sake of receiving money is almost a banality. But it is about this motive that the paragraph “Z” of part 2 of Article 105 of the Criminal Code of the Russian Federation says: murder from selfish motives or hiring.

Such a qualification of the prosecution is a legal impasse. It allows you to not apply another norm of the criminal law, the paragraph “l” of the same part of the same article: murder based on political, ideological, racial, national or religious hatred or enmity.

The investigation and the court did not consider the political motives of the murder of Boris Nemtsov. These motives are not investigated, not studied at the hearing and are not reflected in the court decision.

A simple answer is given to society: Boris Nemtsov was killed simply for the sake of money. Someone promised future killers at least 15 million rubles for the murder of a politician-opposition, the former first deputy chairman of the government, the former presidential contender, the former leader of the political party, political opponent Vladimir Putin .

The "commercial" version of the crime on July 13 was approved by the court. The verdict in the case of the murder of Boris Nemtsov was announced.
