
The repeated decision of the ECHR on the verdict, which was issued by the Russian court, politician Alexei Navalny (“The Cyrovles case”) is unlikely to have any impact on his admission to the presidential election. This was announced this by the lawyer and chairman of the interregional association of voters Andrei Buzin.
According to him, the decision of the ECHR can only mean that for the third time the case will be considered by the Russian court, and the decision on it will probably remain the same (Navalny was already found guilty and condemned for 5 years conditionally). According to Buzin, the ECHR can fine Russia for violations committed during the process over Navalny, but he cannot directly put on Russian courts. Thus, Buzin emphasized, the chance that Navalny’s Navalny will be recognized as illegal, minimal. It is also not worth counting on the Constitutional Court either: the restriction prescribed by the law to run for 10 years if there is a criminal record is quite constitutional, ”the lawyer explained.
Buzin also noted that in practice, cases when the elections are recognized as failed or their results are invalid are extremely rare. If the elections are recognized as failed (due to low turnout in the second round), then all candidates have the right to participate in the elections in the future. However, if the election results are recognized as invalid (for example, due to the illegal inappropriate of one of the candidates), then the victorious candidate who was related to or could somehow influence the unit by his opponent can be prevented to the next election.
We will remind, earlier the Central Election Commission refused Navalny to register as a candidate for the presidential election. According to the representative of the election commission, Navalny is accused of a serious crime, so he will be able to run only after 10 years. Navalny himself, speaking to the members of the election commission, said that the decision of the Central Election Commission violates the constitution.
