At a court hearing in the case of a poet from Krom, who is accused of inciting hatred towards Russians, the prosecutor demanded that the dissemination of information about the progress of the trial be stopped.
January 17, 2018 at a meeting on the case of the poet from the village of Kromy Alexander Byvshev in Trosnyansky district court of the Oryol region, the prosecutor of the Kromsky district said that against defendant initiated another criminal case - this time under Art. 294 of the Criminal Code (obstruction administration of justice and preliminary investigation). The prosecutor explained that the initiation of the case was due to the fact that Byvshev publishes reports and gives interviews to the media about the progress of the trial in his case, thereby putting pressure on witnesses for the prosecution and making it difficult to justice. Except In addition, the prosecutor petitioned to change the preventive measure against Byvshev from recognizance not to leave for detention, because, being at large, he will continue such activities. According to Byvshev, the prosecutor also demanded further hearings on the case behind closed doors in the absence of the press in connection with the interrogation in court of "acting FSB officers and full-time covert intelligence officers in order to exclude the disclosure of state secrets. "On February 14, 2018, Byvshev was searched in a new case, the police seized the only computer he had. from our point of view, an attempt by the prosecutor's office to prevent coverage of the trial unlawful, just as unlawful is the criminal charge brought against him for incitement to hatred, which is considered by the Trosnyansky District Court.
Consideration of a criminal case against Byvshev under Part 1 of Art. 282 of the Criminal Code (inciting national hatred) for publication of the poem "On independence of Ukraine" began on December 26, 2017. the case was initiated by the fact that Byvshev published a poem "For the independence of Ukraine" on his page in the social network "VKontakte" February 22, 2015. Byvshev was accused of inciting hatred towards Russians on the part of ethnic Ukrainians. October 30, 2017 to him charged , and already on November 2 , the investigation was completed.
From our point of view, in poem "On the Independence of Ukraine" really contains statements that could be interpreted as derogatory to Russians, but we we believe that the poem has a political and not a xenophobic character, and in addition, humiliation of dignity should be excluded from the criminal articles as an act of minor gravity.
IN 2015 Byvshev for the publication of the poem "Ukrainian patriots" was sentenced by Kromsky district court of the Orel region for the same part. 1 Article. 282 of the Criminal Code by 300 hours compulsory work with a ban on the profession (teaching at school) for two years and laptop confiscation. On August 26, 2015, the verdict was confirmed by Orlovsky regional court and later entered into force. complaint about this sentence passed to consideration by the ECtHR and communicated .
