The polemic around the judicial persecution of doctors recently stirred in connection with the history of the Moscow hematologist Elena Misyurina, accused of a mistake led to the death of the patient and convicted of two years. In this discussion, two positions were formulated: doctors say that the threat of criminal prosecution makes their work almost impossible. - The balance is easy to find. Of course, we encounter every day with the carelessness of doctors, and with rudeness, and with a lack of drugs and beds, and so on. But it is necessary to share these things. The fact that there are not enough drugs, beds, ambulances is not from indifference, it is from poverty. From the fact that there is Syria, Donbass, Crimea and so on. There are many cases when it is impossible to save a person only because an ambulance cannot come to him: there is no bridge over the river, there is no gasoline, there is no driver, there is no bet ... This is not to be changed either by landing or an appeal to the prosecutor’s office, this must be done at the level of the ministry, budget and political will of the authorities, so that it nevertheless transferred money from one pocket and stops pinching from medicine, education and culture.

Another thing is when we really face medical negligence. Here, of course, the prosecutor’s office and the court are needed. But I urge the same thing I call for other difficult matters, for example, in the economy. [It turns out that] our doctors are poorly educated, our teachers are poorly educated, our entrepreneurs and economists are poorly educated, but the investigators are well formed, and therefore they are versed in everything and can distinguish one drug from another. Or as an investigator in particularly important cases in the famous pedophilian case, Makarov told in court how he saw that the girl was raped: "I took a sample in urine, I see - there is human DNA, I see spermatozoa." He sees! Therefore, when the investigator decides that the doctor had to apply one or another drug, one or another procedure, I, in general, guess how he does it, and I’m not sure what he will do with some understanding of what is happening.

- In the examples you cited, do you see the signs of a certain campaign from law enforcement agencies?

- It is one thing when a person dies or becomes a disabled person as a result of medical intervention: it is clear that there was a tragedy, and it is not known why it happened. And you must first engage in organizing your own life, and then think about who is to blame and to blame, the person died of an incurable illness, old age, injury, or the doctor really did something wrong. And then the prosecutor comes and says: "Hey, write a statement, we will plant everyone there." How do you feel, should you restrain yourself after the funeral? Or will you think: my loved one died because everything around is bastards, and doctors first of all - and write a statement? The chief physician should deal with medical negligence, indifference. If the patient or his relative has claims, they must first go to the head doctor, and not to the prosecutor. Then, after the trial of the head physician, qualified trial, law enforcement agencies are already possible. As well as it is impossible to whitewash all entrepreneurs, all doctors, all the traffic police, all customs officers - it cannot be said that they are all bad or they are all good - you can not be taken into the campaign.

The same with doctors. We drag the boxes of sweets, envelopes with money, chocolates, bottles of whiskey, and this, on the one hand, is gratitude, and on the other hand, bribes. We ourselves buy bandages, iodine, medicines and drag it all into hospitals, because the doctor does not have this ... The same thing happens with quotas for expensive operations. We work a lot with charity funds that are engaged in urgent assistance in quotas, knocking out quotas, and see how this happens. Having a real disease, having indications for an urgent road operation on quota, you can not always get it. This is all from poverty, and not from the fact that someone is bad.

- But why law enforcement agencies conduct a campaign against doctors?

- It is simple, convenient, and the enemy is obvious. We really know many cases when, due to non-ordering of medical care, newborn, pregnant women, old women, and so on, died. This causes irritation and righteous anger. The state of medicine and empathy in society at an extremely low level, and here he is the enemy, in walking distance - the enemy in a white coat, an indifferent cattle that drinks, does not fit on time to the woman in labor, does not give medicine, sells drugs to the left and so on - grab it! This is a completely existing image. People are unhappy with the state of medicine, and who is to blame? Doctor! This is not to blame for the state of medical education, the state of healthcare is to blame. Of course, it cannot be said that all our doctors are an example of devoted service to society. But what will we change the landings? Will someone be pleased from the fact that five doctors of the district clinic were planted? And who will come in their place? I think no one. At all.

Popular discontent must be canalize, and medicine is an excellent channel

- There is a subtle question. This law enforcement system just needs to investigate something and did she find a convenient object? Or is the law enforcement system are allowed to do the doctors-someone more standing-to take dissatisfaction with medicine?

In fact, I want to intercede for doctors in advance, because now all doctors will fall under this comb.

Here Romanova addresses the Misyurina case and leads the opinion of Pavel Chikov, a lawyer, head of the Agora human rights organization, that there is a problem in negligent doctors.

Olga Romanova agrees that Misyurina has a problem of poor medical care, but says that the patient died not because of her, but because of other doctors:

Or, I think, very quickly the Investigative Committee and the prosecutor’s office will find the same “clearing” as in already dispossessed entrepreneurs. [Among them] there is no one to dispossess, but there was still a rather rich industry - private paid medicine, insanely expensive and not so very good. And this is a wonderful sewage system of popular discontent and a wonderful bait to the usual corruption component of law enforcement officers: you come to a large private clinic, you begin to investigate and live for your bribes for a while. And then you act as with entrepreneurs: when they end with money, you "close" it. Why do you need free? You drew them, and when a person is exhausted, it is easier to plant him.

And here we came to the fact that March 18 is the presidential election

-It turns out that before law enforcement agencies will investigate doctors, entrepreneurs, anyone, it is necessary for someone to investigate law enforcement agencies?

- Oh, no! If we focus on the question of what to do with all this, we very quickly reach the chain to the final problem. What to do with what they are trying in prisons? What to do with what schools are not taught? What to do with the fact that they are not treated in hospitals? What to do so that law enforcement agencies do not take? What to do for the judges to be judged, and not as now? Yes, reforms are needed, money is needed. And we will quickly come to the question: why do we have no reforms? Because it is unprofitable. To whom? And then we came to the fact that March 18 is the presidential election. I see, yes? We need political will. Why don't the courts judge? Because they completely and completely on the side of the authorities, at the right time, make the right decision - therefore, everything else is allowed. Why do law enforcement agencies investigate this, and not another? Because it is beneficial to power. Why aren't they taught in schools? Yes, because teachers serve the electoral process, and they can do everything because they do it - the most important thing from the point of view of the authorities, what they should do. And what do you do? Nothing, let them go! This is not an element that is completely necessary for anyone.
