Crimea: the criminal case under Art. 282

In Crimea, the case of 27-year-old resident of Yalta Elina Mamedova, who was accused of inciting ethnic hatred, was dismissed.

In January 2019, in Crimea, the investigator decided, due to the lack of corpus delicti, to dismiss the case of Elina Mamedova, a 27-year-old resident of Yalta, who was charged under Part 1 of Art. 282 of the Criminal Code (inciting national hatred). This decision is connected with the partial decriminalization of Art. 282 of the Criminal Code.

The case against Mamedova was initiated in June 2018 in Crimea. The reason was the publications on VKontakte made in 2014-2015.

On June 13, Mamedova was detained at her home in the Chekhovo microdistrict (formerly the village of Autka). A netbook, tablet and mobile phone were confiscated from her. After the search, she was taken first to the city department of the FSB, and from there to the city department of the investigative agency. A measure of restraint in the form of a written undertaking not to leave was chosen against Mammadova.

Elina Mammadova pleaded not guilty, but confirmed that she had indeed posted the entries mentioned in the materials. The lawyer insisted that she did not have " "a goal in inciting enmity and hatred, humiliating the Russian nation . Unfortunately, we cannot say which publications were discussed.

In September 2018, it became known that the investigation demanded DNA, saliva and voice samples from Mammadova. Her lawyer Aleksey Ladin suggested that this data is "needed to form the base of 'extremists'" . The girl refused to provide samples.
