The Supreme Court declared the detention of Daniil Konstantinov illegal

On June 20, 2018, the Presidium of the RF Armed Forces declared illegal long-term detention of nationalist Daniil Konstantinov.

On June 20, 2018, the Presidium of the Supreme Court of Russia recognized illegal repeated extensions of the leader's detention nationalist movement "Moscow Defense League" Daniil Konstantinov. Previously to the decision that the period of detention was excessive came The European Court of Human Rights, which ruled in December 2016 that the respondent state must pay Konstantinov within three months 2700 euro compensation.

Recall that Konstantinov was detained on March 22, 2012 in Moscow on suspicion of complicity in the murder (Article 105 of the Criminal Code of the Russian Federation) Alexander Temnikova in December 2011.

According to the initial version of the investigation, on December 3, 2011, Konstantinov, being in the company of acquaintances near the lobby of the metro station "Ulitsa Academician Yangel”, attacked Muscovites Alexander Temnikov (born in 1988) and Andrey Safronov. It was reported that the nationalist decided that Temnikov "looked like punk" and spat at him, and after a verbal skirmish, together with his friends, he beat the young man and stabbed him twice in the chest.

Konstantinov denied all accusations. He and his relatives assured that the nationalist on the day of the murder was at the celebration of his mother's birthday and couldn't have been in the area of ​​the crime scene.

The court did not accept this alibi, but also to prove what exactly Konstantinov's stabbing failed. In the end, the matter was reclassified from Art. 105 of the Criminal Code (murder) at Art. 213 of the Criminal Code (hooliganism). Konstantinov was found guilty, sentenced to 3 years in a penal colony and immediately amnestied.

By the time the verdict was passed, Konstantinov had spent imprisonment for more than 2.5 years.

Shortly after his release, Daniil Konstantinov left Russia. Received political asylum in Lithuania.

The case of Konstantinov had a great public outcry, in thanks in large part to a campaign organized by his father, a well-known politician of the period perestroika and the beginning of the 90s by Ilya Konstantinov. According to the human rights Society "Memorial", Daniil Konstantinov recognized as a political prisoner.
