The arrest of Miloserdov was extended on the night after the expiration of the previous period

The judge of the Moscow City Court Pavel Melekhin again extended to the political technologist Peter Miloserdov, who accused of extremism, the term of detention of a pre -trial detention center until September 24. In July, the Judge of the Khamovnichesky District Court of Moscow Marina Syrova already extended to Moroserdov the arrest until the same date, however, on the 15th day of this month, the Moscow City Court limited the term of the politicalese in the pre-trial detention center on August 22, inclusive. On midnight on the 23rd, he was supposed to be released.

However, in the evening of August 22, the investigator of the Department of the Investigative Committee of the Central District of Moscow, Major of Justice, Natalya Talaeva, notified lawyers about the urgent meeting in the Moscow City Court. “The lawyers talked with the investigator yesterday and the day before yesterday and Monday - she didn’t tell them anything, and they asked what would happen next,” Natalya Miloserdova, Politzec’s wife, remarked Mediazone.

The hearings lasted from about 23 o’clock. The meeting was not held in the courtroom, in the convoy room - in office No. 143. It is adjacent to the 144th cabinet known as the torture camera of prisoners . Only Melekhin with the secretary, Talaev, the prosecutor, lawyers and Miloserov himself were present at the trial - the judge did not allow the Politsek’s wife.

During the meeting, the 42-year-old Miloserov was lying on a stretcher due to pain in the back.

The decision to extend the political zoke of the period of detention in the pre -trial detention center was issued about 1 a.m. - that is, an hour after the expiration of the previous period of arrest.

The Talaeva petition in the city, and not to the Mediazona district, explains by the fact that half a year of arrest is the deadline allowed on the charges that were incriminated to Miloserodov - has expired a month ago. Meanwhile, as a month ago, he was extended to arrest in the district court.

Zen insists that his client had to be released back in July. However, the investigation has long been completed, and Miloserov with lawyers has already completed familiarization with the case file. In such cases, Article 109 of the Code of Criminal Procedure allows the extension of the arrest before sending the case to the court.

In 2015-2016, the investigator Talaev fabricated the first "case of the army of the will of the people." Judge Melekhin is known in particular by sentences in the case of ABTO , the second case of Vladimir Kvachkov , the maincase of the murder of Anna Politkovskaya and the case of leader Born Ilya Goryachev .

Miloserov disappeared after the former co-chair of the ethnopolitical association "Russians" Alexander Belov (Potkin), who was issued in August 2016, was taken out in August 2016. On January 23 of this year, he was detained in Moscow with a fake passport for someone else's name and two days later sent to a pre -trial detention center .

Initially, part 1 of Article 282 (arousal of hatred or enmity) and two episodes qualified under paragraph 2 of the same article (the same actions in an organized group), as well as part 1 of Article 282.1 of the Criminal Code (creation of an extremist community), were incriminated.

Part 1 of Article 282 Miloserdov was charged for chanting the slogan "Russia for Russians! Moscow for Muscovites!" At one of the demonstrations of nationalists back in 2011. Article 282.1, as well as Potkin before, was charged with the organization of a community that set the task of overthrowing the Nursultan Nazarbayev regime in Kazakhstan. The remaining two charges were also similar to the accusations of Potkin. Their both were charged with the publication of two texts: “The Project“ The Evil Kazakh ”about the preparations for the“ color revolution ”in Kazakhstan and the“ estimated plan for the preparation of the action on December 16 ”, also in Kazakhstan, who allegedly passed in Kyrgyzstan, also in Kazakhstan.

However, in the final edition of the resolution on the attraction of Graoserdov as the accused, which Talaeva issued on June 15, from the listed accusations remained only - under Part 1 of Article 282.1 of the Criminal Code (as amended 2011 - up to 4 years of colony).

In the future, part 1 of Article 282 was excluded from the case of the expiration of the statute of limitations, and episodes in part 2 of the same article - to bring the charge in accordance with the appeal ruling in the Potkin case. In March of this year, following the results of a repeated appeal for a sentence, episodes under Part 2 of Article 282 of the Code were excluded from the case as excessively imputed .

Miloserdov was also charged with part 5 of Article 33 - part 1 of Article 327 (aiding in falsification of documents; up to 2 years of colony) and part 3 of Article 327 of the Criminal Code (using a knowingly forgery document; up to six months of arrest).

Politzek completely denies guilt.

Miloserov has been engaged in politics since the mid-2000s. In 2005, he ran for the Moscow City Duma from the Communist Party . In 2007, he became the chairman of the Executive Committee of the Number . He repeatedly took part in Russian marches. In 2011, the media conveyed about the intention of the “right-handed”, the Party-Party Mikhail Prokhorov, to include Miloserdov in the list of candidates in the elections to the State Duma .
