The North Caucasus District Military Court granted the appeal of the prosecutor's office.
On November 8, 2018, the Judicial Collegium of the North Caucasus District Military Court satisfied the appeal complaint of the prosecutor's office and canceled the decision of the same court of September 5, 2018 of the year on the return of the case initiated in Simferopol on participation in the Islamic radical party Hizb ut-Tahrir, banned in Russia, for further investigation by the prosecutor to correct the violations committed. The case must be transferred to the court for a hearing on the merits.
Recall that five defendants are involved in the case, Rustem Ismailov, Ayder Saledinov, Emil Dzhemadenov, Uzeir and Teymur Abdullayev, all of them were arrested under Art. 205.5 of the Criminal Code (organization of the activities of a terrorist organization or participation in such) in October 2016, at the moment the term of arrest is set until December 11, 2018.
We believe that accusing Hizb ut-Tahrir members of propaganda terrorism only on the basis of party activities (holding meetings, reading literature, etc.) and prosecuting them under anti-terrorist articles illegally.
