A new case has been initiated against wheelchair-bound Amir Gilyazov under Art. 205.2 CC.
On January 31, 2019, the investigator of the Federal Security Service for the Chelyabinsk region informed the disabled Amir Gilyazov that a new criminal case had been initiated against him under Part 2 of Art. 205.2 of the Criminal Code (public justification of terrorism on the Internet). Accusation under Part 2 of Art. 205.5 of the Criminal Code (participation in the activities of a terrorist organization) also remains in force.
What is the reason for the new accusation is still unclear. Earlier, when Gilyazov was detained in the first case, his relatives reported that the charge was related to the publication of a certain video on the network. However, sources in law enforcement agencies said that the Chelyabinsk citizen recruited acquaintances to the Islamic radical party Hizb ut-Tahrir, which is recognized as terrorist in Russia, and facilitated their transfer to Syria to participate in hostilities. Gilyazov spent two months in custody, after which he was released on bail.
As far as we know, Hizb ut-Tahrir does not resort to terrorist methods of struggle and does not participate in the recruitment of personnel to participate in hostilities in the Middle Eastern countries. Therefore, we consider it unlawful to accuse the followers of this banned party of terrorism only on the basis of party activities (holding meetings, reading literature, etc.).
