Criminal cases terminated by the investigation due to the partial decriminalization of Art. 282 CC

On December 27, 2018, Russian President Vladimir Putin signed a package of laws on the partial decriminalization of Art. 282 of the Criminal Code (incitement of hatred or enmity, as well as humiliation of human dignity) by introducing a mechanism of administrative prejudice. A new article was added to the Code of Administrative Offences. 20.3.1 , the disposition of which coincides with Part 1 of Art. 282 of the Criminal Code. Cases under Part 1 of Art. 282 of the Criminal Code, begun before the signed laws entered into force, cannot be reclassified to the new Art. *20.3.1 Code of Administrative Offences, because it did not exist at the time the case was initiated, but may be closed on the basis of decriminalization.*
In this list we collect all criminal cases under Art. 282 of the Criminal Code, which were terminated at the investigation stage on the basis of these laws. We have collected cases dismissed at the trial stage (including in the appellate instance) here , and sentences overturned by the court here .

On February 16, 2020, the investigation stopped proceedings in the case of activists from Buryatia Nadezhda Nizovkina and Tatyana Stetsura. Nizovkina and Stetsura were charged under Part 1 of Art. 282 of the Criminal Code (incitement of hatred) for distributing leaflets in Ulan-Ud that form a “negative image” of the Russian military, police officers and persons working in investigative agencies, FSB officers and the criminal correctional system.
On April 22, 2019, it became known that in Yekaterinburg the investigation droppedthe criminal case , in which searches were carried out at four local nationalists in December 2018.
On April 10, 2019, it became known that in the city of Barnaul, Altai Territory, the investigation dropped the criminal case against a previously convicted local resident, Anton Angel, who was suspected of publishing some anti-Semitic images on a social network.
On April 9, 2019, it became known that in the Sverdlovsk region the investigation droppedthe criminal case against Yekaterinburg resident Pavel Volkov (born 1987). The man was accused of publishing a video on VKontakte showing the arson of the Solomon restaurant , and leaving a nationalist inscription in the elevator of an apartment building. Volkov’s case had previouslybeen terminated , and then resumed again and sent by the court for further investigation several times.
On March 20, 2019, it became known that in Bashkiria the investigation closed the criminal case under Art. 282 of the Criminal Code against a resident of Birsk, Konstantin Kirchner, who for several months published videos on the Periscope application containing “propaganda of exclusivity, superiority, and inferiority of a person based on gender, race, origin.” His account had 1.2 thousand subscribers. It is also reported that on November 15, 2018, the Birsky Interdistrict Court of Bashkortostan placed Kirchner in a psychiatric hospital for examination, where he spent about a month.
On February 25, 2019, it became known that in Samara the investigation droppedthe criminal case under Art. 282 of the Criminal Code against a local resident who was suspected of publishing materials on a social network directed against blacks, as well as people from the Caucasus and Central Asia.
On February 11, 2019, it became known that in Tatarstan the investigation suspended the investigation of the criminal case against local opposition activist Sergei Andreev, the case against whom was initiated for speaking at an uncoordinated rally against corruption on March 26, 2017. The Investigative Committee planned to drop the case, but was forced to suspend it because Andreev fled the investigation abroad.
On February 11, 2019, it became known that in Ulyanovsk an investigator dropped the criminal case against 50-year-old Nikolai Tolubaev, who was suspected of publishing a racist article on the Internet “Why are nations needed and what is the benefit of Nazism.”
On February 5, 2019, it became known that in the Omsk region the Investigative Committee dropped the criminal case against feminist Lyubov Kalugina, who was accused under Part 1 of Art. 282 of the Criminal Code (incitement to hatred and enmity based on gender).
On January 29, 2019, in Moscow, the Investigative Committee dropped the criminal case against Alexei Kasyan, an employee of the Institute of Linguistics of the Russian Academy of Sciences, who was suspected of publishing three xenophobic posts on LiveJournal.
On January 25, 2019, it became known that in Crimea the investigation dropped the criminal case against anarchist activist Yevgeny Karakashev, who was suspected of publishing the banned video “The Last Interview of Primorye Partisans.”
On January 25, 2019, it became known that in Crimea the investigation dropped the criminal case against Alushta resident Gulsum Aliyeva, who was suspected of publishing on the social network Facebook a non-existent quote from the philosopher Ivan Ilyin, “inciting national discord.”
On January 21, 2019, it became known that in Crimea the investigation dropped the criminal case against 27-year-old Yalta resident Elina Mamedova, who was suspected of publishing certain posts on a social network directed against the “Russian nation.”
On January 10, 2019, it became known that in the city of Barnaul, Altai Territory, the investigation dropped the criminal case against local resident Maria Motuznaya, who, among other things, was suspected of publishing on the Internet two images aimed, according to the findings of the examination, at “ humiliating representatives of the Negroid race ” and " propaganda of the superiority of the Caucasian race over the Negroid race ."
On January 10, 2019, in the city of Barnaul, Altai Territory, the investigation droppedthe criminal case against Andrei Shasherin, who, among other things, was suspected of publishing on the Internet two xenophobic images directed against ethnic Russians and people from the Caucasus and Central Asia.
On January 9, 2019, it became known that in the city of Sovetskaya Gavan, Khabarovsk Territory, the investigation closed a criminal case against an anesthesiologist who was suspected of distributing a picture with “*statements aimed at humiliating the dignity of Russians ”*.
