Administrative cases under Art. 20.3.1 Code of Administrative Offences. April 2019

After the partial decriminalization of Art. 282 of the Criminal Code in the Code of Administrative Offenses, a new article appeared - 20.3.1 of the Code of Administrative Offenses (inciting hatred or enmity, as well as humiliation of human dignity). We collect the resolutions issued on it into a single list on a monthly basis.

On April 8, 2019, the Kursk Garrison Military Court convicted Pavel Zimin, a serviceman, of inciting hatred, who in 2016 published two xenophobic videos on his page on the VKontakte social network, "Immigrant, Go Home!" and "an excerpt from the film Russia 88". However, the case against Zimin was dismissed, and he, as a serviceman, will bear disciplinary responsibility in accordance with the Disciplinary Charter of the Armed Forces of the Russian Federation.
On April 5, 2019, the Surgut City Court of the Khanty-Mansiysk Autonomous Okrug - Ugra fined a local resident U. Magomedov 10,000 rubles for posting 4 images and 6 videos directed against Jews on the Odnoklassniki social network.
On April 3, 2019, the Ukhta City Court of the Komi Republic fined a local resident, E. Matievsky, who posted on the social network VKontakte a graphic image of some text and an audio clip that contained "indirect threats to commit violent acts against a group of people identified on a national basis " .
On April 2, 2019, the Oktyabrsky District Court of the city of Omsk fined local resident R. Dernyaev 10,000 rubles for publishing xenophobic comments directed against people from the Caucasus in one of the popular publics on the VKontakte social network. Dernyaev fully admitted his guilt.
On April 2, 2019, the Leninsky District Court of the city of Omsk fined local resident N. Drevel 10,000 rubles for posting xenophobic comments and images on her page on the VKontakte social network, directed against people from the Caucasus, Jews and Tatars.
On April 2, 2019, the Soviet District Court of the city of Samara imposed an administrative penalty on local resident P. Malygin. Unfortunately, the details of the case were not reported.
On April 2, 2019, the Ukhta City Court of the Komi Republic fined a local resident, S. Skripka, for posting xenophobic videos and text directed against Jews on the VKontakte social network.
On April 1, 2019, the Vorkuta City Court of the Komi Republic fined local resident Anton Mashtaler 10,000 rubles for posting xenophobic texts, pictures, comments and videos directed against Jews and representatives of a certain race on the VKontakte social network. During the trial, Mashtaler fully admitted his guilt and declared remorse.
On April 11, 2019, the Segezha City Court of the Republic of Karelia fined local resident E. Tochilkina 10,000 rubles for publishing materials on the VKontakte social network against Asians, whom he calls in one of his comments derogatory words "guki" and "dishonest "" and declares that they "do not deserve the right to even be called human."
On April 30, 2019, the Sysertsky District Court of the Sverdlovsk Region fined Stanislav Muromtsev under Article 20.3.1 of the Code of Administrative Offenses for making a homophobic comment on the VKontakte social network. The amount of the fine is 5 thousand rubles. We are talking about the comment left by Stanislav Muromtsev in the Sheremet News "Nine and a Half" group under the news about the children's drawing competition at school No. 115 in December 2018. Lawyer of the LGBT Resource Center Anna Plyusnina sent an appeal to the "E" center. The lawyers received a response in the case on June 25.
On April 4, 2019, in Udmurtia, the Yakshur-Bodyinsky District Court fined Andrei Traxler 10 thousand rubles for publishing two audio recordings on his VKontakte page, one of which calls for “fighting” with law enforcement officers, and the other contains their negative assessment. Unfortunately, we do not know what kind of audio recordings we are talking about, but we want to remind you that we do not consider law enforcement officers to be a social group requiring protection - they are already protected by other articles of Russian legislation.
On April 26, 2019, the Topkinsky City Court of the Kemerovo Region fined a local resident 5,000 rubles for publishing xenophobic materials directed against certain ethnic groups on his page and in various communities on the social network.
On April 18, 2019, it became known that the Sovetsky District Court of the city of Vladikavkaz, North Ossetia, fined a 26-year-old local resident of 10,000 rubles for publishing materials depicting Nazi symbols in one of the groups on the VKontakte social network, and also leaving a xenophobic comment in one from public, directed against representatives of certain ethnic groups. The young man fully admitted his guilt and declared remorse.
On April 16, 2019, the Naryan-Mar City Court of the Nenets Autonomous Okrug fined a 51-year-old local resident who, according to law enforcement agencies, in January 2019 published some xenophobic comments on the page of one of the public groups of the VKontakte social network, directed against representatives of certain ethnic groups. The comments have already been removed.
On April 18, 2019, it became known that in the village of Baikibashevo of the Republic of Bashkortostan, the court fined a local resident for 10 thousand rubles, who, according to law enforcement agencies, in September 2018 published in one of the communities on the VKontakte social network a certain text containing offensive and hostile statements against the inhabitants of the Caucasus.
On April 1, 2019, it became known that in Kaluga, the Kaluga District Court fined V.I. Subbotin, who posted on his VKontakte page a photo with the symbols of the banned RNE party and videos titled "Nationalists" and "You are a street soldier! Glory to Russia!", which called for xenophobic violence.
On April 15, 2019, it became known that in Perm, the Dzerzhinsky District Court fined journalist Roman Yushkov and HOA manager Dmitry Razzhivin. According to the materials of the case, the men posted announcements in the entrance of a residential building about holding public hearings on the issue of permission to build a synagogue of the Chabad Lubavitch community. Yushkov was fined 20 thousand rubles, and Razzhivin - 10. The examination considered it inciting hatred that the announcement mentioned the sentence to the Jewish school teacher Semyon Tykman, who was convicted in 2016 under Art. 282 of the Criminal Code (we recall that we considered this sentence unlawful).
On April 4, 2019, the Zarechensky District Court of Tula fined 22-year-old local resident D. Morozova 10,000 rubles for posting a comment against ethnic Chechens on her social network page . During the trial, Morozova fully admitted her guilt.
On April 1, 2019, in the Rostov Region, the Oktyabrsky District Court of Rostov-on-Don fined 24-year-old local resident Sergei Serenko 5,000 rubles for posting photos and videos on his VKontakte page that “incite hatred based on gender, race and nationality » . According to media reports, the young man is a disabled child.
