“Dealership centers cannot cost as much as two luxury apartments”: Rolf’s top manager has been placed under house arrest

The only detainee in the Rolf case, Anatoly Kairo, the head of the company's business development department, accused of withdrawing 4 billion rubles abroad, was placed under house arrest until August 25. This decision was made by the Basmanny Court of Moscow, fully satisfying the petition of the investigation. We wrote more about the Rolf case here and here .

How the matter was handled. The meeting was somewhat reminiscent of a court hearing on a measure of restraint for Michael Calvey and his colleagues at Baring Vostok in February 2019, when Judge Artur Karpov chastised investigators for poor preparation. However, at that time the prosecution had little time - the Calvey case was investigated in a record three days, and the “Rolf” case was being prepared, according to Sergei Petrov, for “two years”.

• First, Judge Natalia Dudar reprimanded investigator Yury Skirdenko for not giving a single argument in favor of house arrest provided for by the Criminal Procedure Code (CPC). The judge gave the investigator a volume of the Code of Criminal Procedure and announced a break, offering to study it, the correspondent of Open Media reported from the courtroom.
• The investigation also confused the concepts of “prohibitions” and “restrictions” and did not comply with the procedural deadlines in the petition (it was proposed to impose house arrest for an extra day in excess of the two months provided by law).
• Speaking about the accusation, the investigator made a paradoxical statement, noting that the purchase and sale of shares is not an entrepreneurial activity - although the Investigative Committee in its official reports admits that the crime in which the owner and managers of Rolf are suspected belongs to the field of entrepreneurial activity, noted "Open Media". This is an important point - for such crimes, the Criminal Procedure Code prohibits the placement of the accused in custody. That is why the UK from the very beginning petitioned for house arrest.
• Speaking about the essence of the accusation, the investigator cited the FSB certificate, according to which the real value of the Rolf Estate company, which the Cypriot company of Sergei Petrov sold to the head Rolf for 4 billion rubles, was 200 million rubles. The defense objected : all 17 Rolf's Moscow dealerships were registered with Rolf Estate, they cannot cost as much as two elite apartments in Moscow.
• Cairo refused to plead guilty, in court he called himself a law-abiding citizen and said that house arrest is an “excessive” measure. The defense offered a bail of 20 million rubles for him.

Nevertheless, the new arguments given by the investigator (having studied the Criminal Procedure Code, he explained the petition for house arrest by the fact that a Ukrainian citizen Kairo, who has a Russian residence permit, can hide), the judge has already been satisfied. Cairo was placed under house arrest for two months.
