New amendments have been submitted for consideration by the State Duma to limit the participation in non-profit organizations of persons allegedly involved in terrorist activities.
On July 5, 2019, the Russian government submitted a bill to the State Duma to expand the list of persons who are prohibited from being founders, participants and members of non-profit organizations, including public and religious associations.
According to the draft, in Part 3 of Art. 19 of the Law "On Public Associations", paragraph 1.2 of Art. 15 of the law "On non-profit organizations" and paragraph 3 of Art. 9 of the law "On freedom of conscience and religious associations" it is proposed to introduce a wording that will prohibit the establishment, participation and membership in the listed structures of organizations and individuals whose accounts have been frozen by the Interdepartmental Commission on Combating the Financing of Terrorism. In case of cancellation of such a decision, the ban will be automatically removed.
The explanatory note to the draft law states that it was developed in accordance with the recommendations of the intergovernmental Financial Action Task Force on Money Laundering (FATF), which require the use of proportionate deterrent measures against NPOs and persons acting on their behalf, to protect against the use of these organizations in for the financing of terrorism. in 2017-2018, In addition, it is noted that according to the results of the national assessment of terrorist financing risks cases of participation in the leadership of non-profit organizations of persons included in the list of extremists and terrorists of Rosfinmonitoring, despite the legislative ban, were revealed.
