The Moscow Court sent a pensioner to the pre-trial detention center because of the fine for insulting a government official

For 30 days, the Basmann District Court of Moscow placed a 66-year-old resident of Moscow Tamaru Vasiliev in a pre-trial detention center due to the fact that she allegedly evaded punishment under the article on insulting a representative of the authorities. This was reported by "Mediazona" with reference to her lawyer Dmitry Julaya.

According to protection, this verdict was made with numerous procedural disorders.

As Julai said, in 2015 Vasilieva arrived in the Krasnodar Territory to her sister, who complained that for several years the village administration did not react to requests to remove the puddle in front of her house and repair the road. “Then this grandmother went to the head of the administration of the rural settlement and with all the proletarian anger expressed him everything she thinks on this occasion,” the lawyer said.

After that, the head of the administration applied to law enforcement agencies with a statement to Vasiliev. In 2017, the justice of the peace in the Krasnodar Territory found the pensioner guilty of insulting a representative of the authorities and appointed her a fine of 7 thousand rubles. However, the woman had no money to pay a fine, and in March 2018, the justice of the peace in the Krasnodar Territory changed her punishment to restrict freedom. Since 1992, Vasilieva has been registered and has been living in Moscow, so the definition of a change in punishment should have been considered at the place of her residence, and not in the Krasnodar Territory.

Then in 2019, the Moscow Office of the Moscow Department of the FSIN already made a request to change Vasilyeva’s punishment. According to the department, Vasiliev evades restriction of freedom, and the punishment should be changed to imprisonment. According to the lawyer, Vasilieva did not know about the change in the punishment, the Krasnodar department of the FSIN could not find a pensioner to notify her.

The lawyer visited Vasiliev in a pre -trial detention center the day before. According to him, a woman feels bad: she has a uterine fibroids, mastopathy, a huge thyroid tumor throughout her neck. Vasilieva told the lawyer that she fainted during the announcement of the court ruling, and while she was unconscious, the FSIN employee took a court decision from her, so Vasiliev was left without any documents from the court.

“The punishment from the restriction of freedom for imprisonment changes in case of malicious evasion, and in the material for the detention of grandmother there are no notifications, certificates, reports that the FSIN went to her at the place of residence, especially considering that she lives in Moscow and the definition of replacing a fine for restriction of freedom was made in Krasnodar,” Julai said.

The punishment under the article on insulting the representative of the authorities does not provide for imprisonment, therefore, according to the lawyer, the pensioner’s detention is illegally. The defense appeals the verdict and prepares an appeal to the FSIN unit, at the request of which Vasiliev was arrested.
