Recall, the Department of Property and Land Relations of Rostov-on-Don appealed to the Arbitration Court of the Rostov Region with a claim against the Roman Catholic Church (parish of the "Last Supper"), in which he demanded to recover from the organization "debt for the actual use of the land plot in the period from July 30, 2013 to September 27, 2016 in the amount of RUB 4,414,252.70”, as well as interest “for use of other people's funds" in the amount of 1,327,723.35 rubles.
By the plaintiff’s opinion, “because the buildings located on the disputed land plot, began to belong to the organization on the right of ownership, and not on the right gratuitous use, since July 30, 2013 the organization has lost the right to granting her a land plot for free use.
However 21 February 2019, the court of the Arbitration Court of the Rostov Region denied the Department satisfaction of the claim. May 15, 2019 Fifteenth Arbitration Court of Appeal affirmed the decision of the court of first instance.
