Administrative cases under Art. 20.3.1 Code of Administrative Offences. April 2020

After the partial decriminalization of Art. 282 of the Criminal Code in the Code of Administrative Offenses, a new article appeared - 20.3.1 of the Code of Administrative Offenses (inciting hatred or enmity, as well as humiliation of human dignity). We collect the resolutions issued on it into a single list on a monthly basis.

On April 15, 2020, the Dzerzhinsky City Court of the Nizhny Novgorod Region fined local resident D. Tofelyuk 10,000 rubles for posting a certain text message in the “Overheard Dzerzhinsk” community on the social network, which was reportedly directed against representatives of a certain ethnic group.
On April 29, 2020, in the Trans-Baikal Territory, a court fined a resident of the Zheleznodorozhny district of Chita for 10,000 rubles for posting a xenophobic video on his social network page, included in the Federal List of Extremist Materials.
On April 29, 2020, it became known that a court in the Kemerovo Region fined a Novokuznetsk resident for 12,000 rubles for publishing statements on his VKontakte page “aimed at inciting hatred on the grounds of an attitude towards religion.”
On April 23, 2020, in the Tula Region, the Donskoy City Court fined sports coach Artur Kukovyakin 10,000 rubles for publishing some xenophobic materials on the Internet. The young man was also fined under Part 1 of Art. 20.3 of the Code of Administrative Offenses (demonstration of Nazi symbols).
On April 23, 2020, it became known that in the Penza Region, the Penza District Court fined a 31-year-old local resident for 10,000 rubles. According to the prosecutor’s office, on VKontakte, under a post about fines introduced in Penza for violating quarantine, a man left a comment calling for “the physical destruction of violators.” The prosecutor's office considered this an incitement of social hatred towards "a group of people who do not observe quarantine." Recall that the Sova Center advocates the exclusion of the vague concept of “social group” from the anti-extremist legislation.
On April 2, 2020, the Totemsky District Court of the Vologda Region announced that it had fined Yevgeny Monchik 10,000 rubles. According to the materials of the court, Monchik, from his page on the social network VKontakte under the post of the GULAG community, posted “informational materials that may incite hatred or enmity towards persons of a certain nationality”, and also left several xenophobic comments. The study was conducted by the ECC of the Ministry of Internal Affairs of Russia for the Vologda Oblast on November 22, 2019.
