Administrative cases under Art. 20.3.1 Code of Administrative Offences. June 2020

After the partial decriminalization of Art. 282 of the Criminal Code in the Code of Administrative Offenses, a new article appeared - 20.3.1 of the Code of Administrative Offenses (inciting hatred or enmity, as well as humiliation of human dignity). We collect the resolutions issued on it into a single list on a monthly basis.
- On June 10, 2020, the Mozdok District Court of the Republic of North Ossetia-Alania fined local resident Yevgeny Alentyev 10,000 rubles for posting a xenophobic comment against ethnic Uzbeks on the social network VKontakte on October 17, 2019.

On June 17, 2020, the Balakovo District Court of the Saratov Region fined local resident V. Orlov 10,000 rubles, who, being the administrator of a video hosting site, published several videos directed against people from the Caucasus on it.
On June 29, 2020, the Lebedyansky District Court of the Lipetsk Region fined a local resident, Leonid Shivtsov, 10,000 rubles for posting an anti-Semitic video on the social network VKontakte entitled “Jewish cattle on the Russian Land is mad with impunity – NON-JEWS SHOULD BE WATCHING”. The video is said to have contained incitement to violence.
On June 23, 2020, the Lebedyansky District Court of the Lipetsk Region fined local resident Sergei Ovchinnikov 10,000 rubles for posting an anti-Jewish image on the VKontakte social network. It is reported that the picture was viewed 18 times.
On June 30, 2020, the Nadym City Court of the Yamalo-Nenets Autonomous Okrug fined local resident Alexander Rezepov 10,000 rubles for posting xenophobic comments in various communities on the VKontakte social network. It is reported that his comments were directed against people from the Caucasus and Central Asia, Muslims, Jews and Ukrainians.
On June 2, 2020, the Segezha City Court of the Republic of Karelia fined a local resident S. Sak 5,000 rubles for publishing three comments directed against people from the Caucasus on the VKontakte social network on the page of the Segezha Online group. In these comments, Sak urged not to buy goods from sellers from the Caucasus who sell at "Belarusian fairs", because. allegedly this product is of inadequate quality and is sold too expensive. In addition, the comments contained xenophobic insults. At the trial, Sak pleaded guilty.
On June 26, 2020, the Ust-Koksinsky District Court of the Altai Republic assigned 60 hours of compulsory work to a local resident, Sergei Kolmakov, who posted an anti-Semitic comment on the VKontakte social network.
On June 4, 2020, the Surgut City Court of the Khanty-Mansiysk Autonomous Okrug fined a local resident 10,000 rubles for allegedly posting a racist video on Youtube.
On June 17, 2020, the Almetyevsk City Court of the Republic of Tatarstan fined two local residents L. Mukhametshin and S. Shaykhleeva 10,000 rubles for independently leaving xenophobic comments on the social network VKontakte under the post “about the beating on December 14, 2019 in a cafe” Oriental cuisine "young guy chocks". It is reported that both comments were directed against people from the Caucasus and Central Asia. Both Mukhametshin and Shaykhleeva admitted their guilt and declared their repentance.
On June 4, 2020, the Sovetsky District Court of the city of Ulan-Ude of the Republic of Buryatia sentenced local resident Polina Zamuraeva to 20 hours of compulsory work. According to the court order, twice in YouTube videos she made statements that, as the examination showed, were aimed at inciting hatred towards ethnic Russians. Zamuraeva pleaded guilty and declared remorse.
On June 29, 2020, it became known that in Tatarstan, the Moscow District Court of Kazan arrested K. Mikhailov for five days, who published on his page on the social network “statements containing signs <...> of hostile rejection of Jews, the peoples of Central Asia, the Caucasus and Transcaucasia on a national basis."
On June 28, 2020, it became known that in the Kemerovo Region, the Kuibyshevsky District Court of the city of Novokuznetsk fined a 31-year-old local resident 10,000 rubles for publishing texts about “immigrants from the Caucasus and Central Asia” on his VKontakte page, in which he “ urged the townspeople to forcefully drive them back to their homeland.
On June 26, 2020, it became known that in the Kemerovo Region, the Mezhdurechensky City Court fined Yegor Cherepanov 10,000 rubles for publishing some xenophobic comments on VKontakte under a post about a terrorist attack in a mosque.
On June 19, 2020, it became known that in the Kemerovo Region, the Mezhdurechensky City Court fined 61-year-old Irina Litvinenko 10,000 rubles for posting anti-Semitic materials on Vkontakte.
On June 18, 2020, it became known that the Orenburg Central District Court fined Dmitry Galaktionov 10,000 rubles for repeatedly posting xenophobic comments on VKontakte.
On June 1, 2020, the Gornozavodsky District Court of the Perm Territory fined 61-year-old pensioner Andrey Pervushinaz 10,000 rubles for reposting an anti-Semitic text on a social network. Pervushin did not agree with the court's decision and intends to appeal it.
On June 4, 2020, the Leninsk-Kuznetsk City Court of the Kemerovo Region issued a ruling imposing an administrative penalty on a local resident, Nina Shusharina, who posted messages on Odnoklassniki calling for violent acts against law enforcement officers.
On June 10, 2020, it became known that in the Kaluga Region, the Kaluga District Court fined a local resident born in 1993 for 10,000 rubles for posting a video on a social network “aimed at humiliating the dignity of a person or a group of persons united on the basis of nationality.”
On June 10, 2020, it became known that in Orenburg, the Leninsky District Court fined a 33-year-old local resident for 10 thousand rubles for publishing materials on his VKontakte page that “contain linguistic signs of propaganda of the inferiority of a particular national group, humiliation of a group of people according to national and religious signs.
On June 9, 2020, the Leninsky District Court of Saratov fined Dmitry Gavrilyuk 10,000 rubles. According to the court order, Gavrilyuk published two comments on VKontakte in the Saratov Online community under the article “Priests in the Saratov region refuse to close churches for Easter.” One of them is dedicated to Russians who hold atheistic views: Gavrilyuk writes that he is ready to sell the apartment and use the proceeds to run "gas stoves" and buy "Cyclone B" so that such people are "burned" and "poisoned". The second comment mentioned in the ruling is addressed to another user of the social network: Gavrilyuk writes that he considers her a woman “with low social responsibility” and condemns her for her alleged alcoholism. We note that we believe that the persecution of Gavrilyuk under Art. 20.3.1 of the Code of Administrative Offenses for the second comment, unlike the first, is unlawful: although he rudely addresses the interlocutor, he does not call for violent actions against any group of people.
On June 9, 2020, it became known that in the Kursk region, the Kastorensky District Court fined Viktor Sapelkin for 50,000 rubles, who, according to the prosecutor’s office, “posted negative statements about the peoples of the Caucasus on his page on the VKontakte social network several times.” Five administrative cases were initiated against the man, for each of which he was fined 10,000 rubles.
On June 3, 2020, the Kaluga District Court announced that a young man (born in 1996) was fined 10,000 rubles for posting xenophobic material on a social network. According to the prosecutor's office of the Kaluga region, "since the beginning of the year, eight episodes of such violations have been registered."
On June 1, 2020, it became known that in the Republic of Mordovia, the Lyambirsky District Court fined Rishat Abdullov 10,000 rubles for publishing a “video with extremist content” on a social network, which was interpreted as public actions aimed at humiliating the dignity of a person or a group of persons “on the grounds of attitude to religion, as well as belonging to any social group.
