The court returned Dymovsky's case to the prosecutor

Ex-policeman Aleksey Dymovsky was transferred under house arrest, and his case under Art. 222.1 of the Criminal Code was returned to the prosecutor to eliminate violations.

On August 11, 2020, the Oktyabrsky District Court of Novorossiysk returned to the prosecutor the case of ex-major of the Ministry of Internal Affairs Alexei Dymovsky, accused of illegal storage and transportation of explosives (part 1 of article 222.1 of the Criminal Code). At the same time, the court changed his preventive measure from detention to house arrest.

On October 14, 2019, Dymovsky recorded and posted on YouTube a video titled "Aleksey Dymovsky: I thought of killing Putin..." (author's spelling). In this video, he was driving around Novorossiysk in a taxi to the police department in order to voluntarily hand over explosives. According to him, in 2016 he found a whole dump of material evidence to be destroyed, including TNT and drugs. He informed the CPE of the Main Directorate of the Ministry of Internal Affairs of Russia for the Krasnodar Territory about the find, but there he was advised to contact the territorial police department. Then the ex-policeman took the TNT for himself, and he " wanted to use this TNT against Putin Vladimir Vladimirovich ", since he considered the president responsible for the plight of the people. Subsequently, Dymovsky said, he realized that Putin could not be blamed for this, since he was " a mentally ill person ," which is expressed in the fact that " he has no conscience ." On the video, Dymovsky also called on all honest people to unite and invites them to a meeting.

Shortly after recording the video, the car with Dymovsky, who did not reach the police department, was stopped by traffic police, and then Dymovsky decided to give out TNT on the spot. After the explosives were seized, Dymovsky was taken to the police station, where he was interrogated and allowed to go home. However, on October 17, he was taken into custody on charges under Art. 222.1 of the Criminal Code. In January 2020, materials under Art . 280 of the Criminal Code (public calls for extremist activity).

According to the lawyer, the court returned the case to the prosecutor due to the fact that some of the materials that the defense intended to use as evidence of Dymovsky's innocence disappeared from the case - in particular, the protocols of interrogations of the taxi driver and video operator, as well as the disk with the video itself, on which the ex-major declares his intention to voluntarily hand over the explosives.

Aleksey Dymovsky rose to prominence in 2009 when he publicly addressed Russian officers and Prime Minister Vladimir Putin with a story about the "cane system" and corruption in the Interior Ministry system. After that, he was dismissed from the internal affairs bodies, and a case was opened against him under Part 3 of Art. 159 of the Criminal Code (fraud committed using one's official position), which was later stopped. Dymovsky's speech became a notable event in the public discussion that preceded the reform of the Ministry of Internal Affairs.

We believe that the persecution of Dymovsky under Art. 280 of the Criminal Code would be unlawful. His video did not contain any calls for violence against the president or other officials, and the call for the unification of all honest people was also peaceful.
