Update: After the publication of the Vedomosti article, the Ministry of Finance denied the introduction of tax from the sale of used things, as reported by TASS with reference to the press service of the department.
Sales of things on online platforms Avito and Yula are subject to taxation on a common basis at a rate of 13%. This was reported by the newspaper "Vedomosti" with reference to the Ministry of Finance.
According to the publication, the obligations to calculate and pay tax will be assigned to the seller.
According to the ministry, at present the legislation does not impose the functions of tax agents on social networks and electronic platforms with which users sell things. In this regard, platforms cannot pay tax from user funds. At the same time, individuals, upon receipt of income from the sale of property belonging to them “on the right of ownership of a less maximum deadline,” make tax on their own.
It is noted that the Yula service enables users to place an ad on the sale for free, but at the same time does not act as a participant in the process of purchase and sale. The Avito press service emphasized that the seller himself is responsible for taxation of his income.
In a conversation with Vedomosti, the partner of the law firm Rustam Kurmayev and partners Dmitry Kalochkin noted that the tax is successfully charged when selling real estate and cars. “The amounts of transactions and tax are sufficient to be attractive to the state,” the expert added.
The Ministry of Finance emphasized that, according to the Tax Code, with the exception of property, with the exception of real estate, with a period of ownership of more than three, the tax is not paid. Taxpayers also have the possibility of a property tax deduction in the amount of 250 thousand rubles per tax period.
Pavel Zhelevod, lawyer of tax disputes PKF tax disputes in a conversation with the publication noted that this would not be easy to use, since the problem is to prove the period of ownership for a period of more than three years.
According to experts, such an attempt to collect taxes from the sale will ultimately lead to the refusal of users from the online platforms.
