The court granted the request for parole release of the defendant in the “Moscow case”

The Mtsensky District Court of the Oryol Region granted the request for parole release of the defendant in the “Moscow case” Danil Beglets. This was reported by the head of the international human rights group "Agora" Pavel Chikov in his Telegram channel with reference to lawyer Leonid Solovyov.

The prosecutor's office and the administration of the colony settlement where Danil Beglets is serving his sentence were against parole. In its description, the administration noted that it considers it “inappropriate” to grant him parole due to his unstable behavior. It is also noted in the documents that the prisoner is registered as a person prone to attacking law enforcement officers.

“At the trial, a representative of the colony administration only read out Danil’s description. The representative of the prosecutor's office also repeated the phrase about unstable behavior and preventive accounting. In response to my question, an administration employee confirmed that everyone who was convicted under Article 318 of the Criminal Code of the Russian Federation is automatically placed on preventive registration. And it cannot be canceled, according to the order of the Ministry of Justice. The court, in its decision, accepted our arguments and decided to release Danil on parole,” said Solovyov.

Danil Beglets could be released in 10 days if the prosecutor’s office does not appeal the court’s decision. The colony administration will receive the court decision on October 21.

Earlier, the Fugitive went on a hunger strike due to the violation of his religious rights in the colony: prisoners are forced to work on Saturday, which is prohibited by the rules of Judaism.

• On October 19, the Sukhinichi District Court of the Kaluga Region denied parole from the colony to another defendant in the “Moscow case,” Ivan Podkopaev.
• After the decision of the Second Court of Cassation, which decided to send Danil Beglets from a general regime colony to a settlement colony, the defense petitioned to replace the remaining term with a more lenient punishment - for example, a fine or correctional labor. The district court left the Begulet in prison; the regional court rejected the appeal against this decision.
• On September 3, the Tverskoy District Court sentenced Beglets to two years in prison under the article on the use of violence against a government official (Part 1 of Article 318 of the Criminal Code). According to the prosecution, during the action on July 27, 2019, the Fugitive grabbed a police officer by the wrist and “squeezed it strongly and pulled it to the side.” In court, he admitted his guilt and asked the investigation to consider the case in a special manner. Because of this, the defense's complaint only asked for a reduction in the sentence, which they considered excessively harsh. The fugitive is survived by his wife, two-year-old son and three-month-old daughter.
• Previously, Beglets apologized to the injured security officer, after which the lawyer of the protest participant on July 27 petitioned to dismiss the case in connection with the reconciliation of the parties. However, the policeman refused to confirm the fact of reconciliation.
