Administrative cases under Art. 20.3.1 Code of Administrative Offences. December 2020

After the partial decriminalization of Art. 282 of the Criminal Code in the Code of Administrative Offenses, a new article appeared - 20.3.1 of the Code of Administrative Offenses (inciting hatred or enmity, as well as humiliation of human dignity). We collect the resolutions issued on it into a single list on a monthly basis.

In December 2020, the Apatity City Court fined a local resident 10,000 rubles for comments on a social network. According to the conclusion of an expert from the Murmansk Forensic Laboratory, “the totality of comments contains linguistic and psychological signs of humiliation of human dignity on the basis of religion, as well as linguistic and psychological signs of inciting hostility, hatred (discord) in relation to a group of persons united on religious grounds. ". The defendant pleaded guilty and repented.
On December 25, 2020, the Volodarsky District Court of Bryansk fined Nikita Mitchenko (born in 1993) 10,000 rubles for creating a group on a social network where he posted "texts containing propaganda of the exclusivity and superiority of a person on the basis of his nationality." It should be noted that Nikita Mitchenko was a former DPR militiaman who fought in the Donbass.
On December 2, 2020, the Pryazhinsky District Court of the Republic of Karelia fined Ruslan Yurik 10,000 rubles for posting two comments in public on VKontakte, one of which negatively assessed "a group of persons belonging to a certain nationality and origin", and also included " a statement about the need to commit a hostile act" in relation to this group, and the other contained a negative assessment of a group of persons "united by belonging to a certain race" and a statement "expressing the rationale for the permissibility of committing a hostile (violent) act in relation to this group."

On December 24, 2020, the Zavodsky District Court of Kemerovo fined Grigory Grishko 10,000 rubles. According to the court, on September 29, 2020, Grishko posted a free comment on the social network VKontakte inciting hatred towards the natives of the Caucasus and Central Asia. In court, Grishko did not fully admit his guilt in committing an administrative offense and explained that the VKontakte page belongs to him, he repents of his deed, the comment has now been deleted.
On December 9, 2020, the Lysvensky City Court of the Perm Territory fined Vladislav Kartashev 10,000 rubles for publishing a video in free access on the VKontakte social network that incites hatred towards "representatives of "non-white" races, non-Slavic nationalities." On November 25, an administrative offense case was initiated. Kartashev partially admitted his guilt. He said that in 2012 on his VKontakte page he posted the video “Wake up Russia” for personal viewing, he did not have the goal of distributing this video.

On December 3, 2020, the Novoshakhtinsky District Court of the Rostov Region fined Rodion Abashin 10,000 rubles for publishing in the public domain on his page on the social network VKontakte an image of a man with a scarf on his face, a Koran and a knife in his hands with the inscription "ISLAM - PEACE RELIGION, if you don't believe, we'll kill you", recognized as extremist and included in the federal list of extremist materials. Abashin pleaded guilty to the court and removed the image from his page.
On December 2, 2020, the Ostrovsky City Court of the Pskov Region fined a 40-year-old local resident 5,000 rubles. for the publication in the public domain on the social network VKontakte of materials "containing incitement to hatred, enmity, to commit violent acts against police officers and against representatives of the State Duma of the Russian Federation." As a reminder, we believe that government representatives and law enforcement officers are not a social group protected by anti-extremist legislation, especially since special rules are provided for their protection. In addition, the Ruling of the Supreme Court of the Russian Federation of July 28, 2011 states that "criticism in the media of officials (professional politicians), their actions and beliefs should not in itself be considered in all cases as an action aimed at humiliating human dignity or a group of persons, inasmuch as the limits of permissible criticism are wider in relation to said persons than in relation to individuals."
