A court in St. Petersburg refused to consider the claim of a defendant in the Network case for compensation
The Lomonosovsky District Court of St. Petersburg refused to consider the claim of Yuli Boyarshinov, a defendant in the Network case, for compensation due to the conditions of detention in the Gorelovo pre-trial detention center. This was reported by MBKH Media with reference to lawyer Olga Krivonos.
“The judge ruled to leave the claim without consideration, since, in her opinion, a similar claim had already been considered in court,” the publication quotes the lawyer.
Krivonos clarified that in 2018 Boyarshinov filed a lawsuit in connection with the conditions in the pre-trial detention center. “Then the court refused to transfer to another cell room, because Boyarshinov had left the pre-trial detention center at the time of consideration of the claim, he was no longer there. Now we demand that he be awarded compensation, and the court considers that these are the same requirements,” the lawyer emphasized.
In a lawsuit filed in July 2020, Boyarshinov demanded compensation in the amount of 400 thousand rubles. The person involved in the “Network” case stated that he was in torture conditions, namely in a cell designed for 116 people, where in reality there were 130 prisoners and there was no place for eating.
On June 22, a court in St. Petersburg sentenced two defendants in the Network case, Viktor Filinkov and Yuli Boyarshinov, to imprisonment. Filinkov was sentenced to seven years in a general regime colony, Boyarshinov - five and a half. The court found them both guilty of participating in a terrorist community (Part 2 of Article 205.4 of the Criminal Code), Boyarshinov was also found guilty of illegal possession of explosives (Part 1 of Article 222.1 of the Criminal Code).
