
Vladimir Putin signed the law on the expansion of guarantees to the ex-president and his family. The corresponding document is published on the official Internet portal of legal information.
The authors of the initiative prepared in connection with the amendments to the Constitution were the head of the Federation Council Committee on Constitutional Law and State Construction Andrei Klishas and the head of the State Duma Committee on State Building and Legislation Pavel Krasheninnikov.
According to the law, the former head of state receives inviolability: they cannot be brought to criminal or administrative responsibility, detain, arrest, interrogate, searched or personal search. This rule also applies to residential and office premises, vehicles, means of communication, documents, baggage and correspondence. The privileges relate not only to actions during the execution of the presidential powers, but also to the subsequent acts of the former head of state, which thereby receives life immunity.
From the text of the bill, we can conclude that to hold an ex-president liable for committing administrative offenses, as well as criminal offenses of insignificant or moderate severity, which include beatings or even causing death by negligence (for example, as a result of an accident or self-defense), it will not be possible.
It will be extremely difficult to deprive the immunity of the former leader if you follow the procedure provided for by law. The Council of the Federation Council on the basis of the accusation of the accusation of the State Duma in the State Duma or a friend of a serious crime made by the decision: two -thirds of the parliamentarians of each chamber should be made on the initiative of at least one third of the State Duma deputies and in the presence of its special commission.
In this case, the prosecution must confirm the supreme and constitutional courts. The upper house is obliged to solve the issue of deprivation of immunity no later than three months after the prosecution. Otherwise, he will be rejected.
The procedure provided is similar to the procedure for the renunciation of the current head of state.
