Administrative cases under Art. 20.3.1 Code of Administrative Offences. March 2021

After the partial decriminalization of Art. 282 of the Criminal Code in the Code of Administrative Offenses, a new article - 20.3.1 of the Code of Administrative Offenses (inciting hatred or enmity, as well as humiliation of human dignity). In March 2021, in Mordovia, a 27-year-old local resident was fined 10,000 rubles for posting on the wall of a community on the VKontakte social network under a false name a comment "containing linguistic signs of propaganda of exclusivity, inferiority on the grounds of racial, national, religious or linguistic accessories".
On March 18, 2021, in the Kemerovo Region, the Kemerovo District Court fined Ekaterina Kilina 10,000 rubles for posting a xenophobic comment on her VKontakte page.
On March 17, 2021, in the Kemerovo Region, the Central District Court of Novokuznetsk fined Victoria Sorokina 10,000 rubles for posting xenophobic comments on VKontakte.
In March 2021, the Prigorodny District Court of the Republic of North Ossetia-Alania fined a local resident for posting comments on one of the social networks aimed at humiliating the dignity of a group of people united on the basis of nationality and origin.
In March 2021, the Leninsky Court of Saransk fined a 3rd year student of the Ruzaevsky Railway Industrial College, who works as a courier at Yandex Food, for 11,000 rubles. According to police data, in the winter of 2019, he posted a free video on his page on the VKontakte social network calling for "inciting hatred towards people of a certain nationality." In the summer of 2020, a student posted videos depicting Nazi symbols.
On March 16, 2021, the Zavodsky District Court of Kemerovo fined 28-year-old Ivan Lukashevich 10,000 rubles for publishing posts on social networks calling for violence against people from Central Asia and the Caucasus.
On March 15, 2021, it became known that in the Kemerovo Region, the Prokopyevskiy District Court fined 30-year-old Alexander Belozerskikh for 10,000 rubles for posting calls for violence against immigrants from Central Asia and the Caucasus on social networks.
On March 10, 2021, it became known that in Kemerovo, the Leninsky District Court fined a 30-year-old local resident for 10,000 rubles for posting comments on VKontakte calling for “violence against people from Central Asia and the Caucasus.”

In March 2021, a resident of Syzran was fined 12,000 rubles for publishing extremist materials in the public domain on the VKontakte social network, inciting hostility towards natives of the Caucasus and Jews, and displaying Nazi symbols. He was also punished under Article 20.29 of the Code of Administrative Offenses (distribution of extremist materials), 20.3 of the Code of Administrative Offenses (demonstration of Nazi symbols). A resident of Syzran admitted his guilt, repented and voluntarily removed the prohibited materials.
On March 5, 2021, the press service of the Ministry of Internal Affairs of Russia for the Kaluga Region reported that a 23-year-old young man posted a video on his personal page on the social network, "in which they revealed signs of inciting hatred for national superiority, as well as statements calling for actions of a negative nature based on interracial hatred. An administrative case was opened. The court imposed a sentence of administrative arrest.
Since the beginning of 2021, the courts of Tatarstan have received 26 cases under Art. 20.3 (demonstration of Nazi symbols) and 20.3.1 of the Code of Administrative Offenses. In the first case - 20 cases, and in the second - six. In three cases, decisions have not yet been made, in four cases the cases were returned back to the police due to violations found in the protocols, in 19 cases decisions were made to impose fines. Unfortunately, it is not clear on what articles of the Code of Administrative Offenses decisions were made, and how these decisions were made.
On March 1, 2021, the Nogai District Court of Dagestan fined a local resident for posting a video and two posts with photos and comments on a social network "in which he spoke derogatoryly about certain social and religious groups."
