Administrative cases under Art. 20.3.1 Code of Administrative Offences. April 2021

After the partial decriminalization of Art. 282 of the Criminal Code in the Code of Administrative Offenses, a new article - 20.3.1 of the Code of Administrative Offenses (inciting hatred or enmity, as well as humiliation of human dignity). • On April 16, 2021, the Lyambirsky District Court of the Republic of Mordovia arrested Nikolai Piskunov, a resident of the Kommunar state farm, for 5 days, finding him guilty of publishing anti-Semitic materials on a social network.

• On April 26, 2021, it became known that in the Ulyanovsk Region, the Mainsky District Court sentenced 38-year-old R. Dvoryanchikov to 50 hours of compulsory labor for a comment posted on a social network “aimed at provoking ethnic conflicts.”

• On April 19, 2021, in the Penza Region, the Serdobsky City Court fined 34-year-old Pavel Lagutin 10,000 rubles for posting a comment on one of the social networks "in which he justified the need for hostile actions against law enforcement officers." Unfortunately, we do not know what kind of comment we are talking about, but we believe that law enforcement officers and government officials should not be considered a vulnerable social group protected by anti-extremist legislation. Moreover, Sova stands for the exclusion of the vague concept of "social group" from the anti-extremist legislation.

• In April 2021, in the Kemerovo region, the court fined 10 thousand rubles. 25-year-old resident of Belovo for posting freely available comments on the VKontakte social network, in which, according to the results of a linguistic examination, "there is a negative assessment on the grounds of race / language / origin, as well as statements expressing the assertion of the need to commit hostile actions in relation to a group of persons united on the basis of power. Previously, he had already been prosecuted under Article 282 of the Criminal Code (inciting hatred or enmity), as well as administratively liable under Article 20.3 of the Code of Administrative Offenses (propaganda or public demonstration of Nazi paraphernalia or symbols).

• In April 2021, the Kaluga District Court fined a local resident (born in 1982) 10,000 for xenophobic comments and images on his page on one of the popular social networks.

• On April 12, 2021, it became known that in the Kaluga Region, the Dzerzhinsky District Court fined a Kaluga resident born in 1997 for 10,000 rubles for posting a xenophobic video on his social network page. The young man was also fined under Art. 20.29 of the Code of Administrative Offenses .

• On April 5, 2021, the Sokolsky District Court of the Vologda Oblast fined Dmitry Belov 10,000 rubles for posting a comment on VKontakte in the Sokol Gossip group that “negatively evaluates” labor migrants from the Transcaucasus and Central Asia.

• In April 2021, the Bogoroditsky District Court of the Tula Region fined a resident of the village of Volovo 1,000 rubles.

• On April 6, 2021, the Leninsky District Court of Kostroma fined a local resident 5,000 rubles for posting videos copied from other pages on his social network page and leaving comments under them "containing signs of humiliation and incitement of enmity and hatred towards people of the Jewish nation and the religion of Judaism , as well as a call for hostile action against the Jews." In court, a resident of Kostroma said that he had a negative attitude towards Jews, but when he posted these materials on his page, he did not know that any responsibility was provided for this. And now that he knows it, his opinion has not changed.

• On April 6, 2021, it became known that in March, the Zavodsky District Court of Kemerovo fined two local residents, Kirill Veko and Ivan Lukashevich, 10,000 rubles for posting xenophobic comments on their VKontakte pages.
