A criminal case was opened because of the damage to the banners.
On August 4, 2022, it became known that a criminal case against a 19-year-old student accused under Art. 214 of the Criminal Code (vandalism). The student is charged with part 2 of this article - most likely, we are talking about vandalism motivated by political or ideological hatred or enmity.
According to investigators, the girl poured paint over the banners that were placed in the city for Victory Day. It is reported that the Kemerovo woman thus expressed her disagreement with the holding of the NWO in Ukraine.
It is also reported that during the investigation of the criminal case, the student was fined 15 thousand rubles under Part 1 of Art. 20.3.3 of the Code of Administrative Offenses (discrediting the armed forces).
We doubt the validity of prosecution for politically motivated vandalism. In our opinion, in fact, we are talking about one of the forms of political criticism. The manifestation of political hostility in itself is not criminalized, and if such vandalism is not associated with the promotion of violence and xenophobia, the degree of its public danger is low, and it is unlikely to require criminal prosecution. In general, from our point of view, when damage to property is not too serious, cases under Art. 214 of the Criminal Code should be terminated for insignificance. For those cases when it is impossible to do this, but the damage is still relatively small, it would be possible to introduce an article similar to Art. 7.17 of the Code of Administrative Offenses on the destruction or damage of other people's property, or clarify this article itself by including vandalism that did not cause major damage.
