On August 17, 2020, the Supreme Court of Russia recognized the public movement "Prisoner Criminal Unity" (AUE) as extremist.
We believe that the ideology of the criminal world and the AUE subculture is focused on illegal activities and is by its nature incompatible with the implementation of the constitutional rights of citizens. Activities to spread such an ideology can be banned and criminalized, but this ideology is not political and is not aimed at changing the constitutional order, and therefore, from our point of view, should not be the subject of anti-extremist legal regulation. In addition, we do not have data that would allow us to say that the AUE is not a subculture, but a structured movement.
We decided to track information about criminal cases initiated in connection with the activities of the AUE as an extremist organization - this publication will contain information received from the beginning of 2023. The first part of the document, covering the period from 2020 to 2022, can be found here . At the same time, we do not assess the validity of state interference in the rights of citizens to express opinion and freedom of association, but only state that in the fight against the AUE ideology, the use of anti-extremist legal norms, in our opinion, is inappropriate.
As a rule, defendants in cases of involvement in the AUE are prosecuted under Part 1 (organization of the activities of an extremist organization), Part 2 (participation in the activities of an extremist organization), Part 1.1 (involvement in the activities of an extremist organization) Art. 282.2 of the Criminal Code and under Part 1 of Art. 282.3 of the Criminal Code (financing the activities of an extremist organization).
- On June 30, 2023, the Investigative Committee of the Investigative Committee and the Russian Ministry of Internal Affairs for the Trans-Baikal Territory announced the initiation of a case under Part 1 of Art. 282.2 of the Criminal Code in relation to two prisoners who organized an AUE cell in the colony. According to investigators, they built a strict hierarchy of prisoners in the colony, demanded that they observe criminal traditions, organized the collection and accounting of money and parcels (which were distributed among the “higher caste”), monitored the movement of UFSIN officers, and beat those who disagreed. Their phones, bank cards, weapons, ammunition, "thieves' common fund" were confiscated.
- On June 29, 2023, the Investigative Committee of the Investigative Committee of Russia for the Rostov Region opened a criminal case under Part 2 of Art. 282.2 of the Criminal Code in relation to three ex-prisoners of IK-2: 41-year-old Alexander Gudkov, 41-year-old Temur Mkheidze and 45-year-old Gegham Hovhannisyan. According to the investigation, in 2021 they joined the AUE and began to control the observance of the "thieves' concepts" among the convicts.
- On June 20, 2023, the Krasnoturyinsky City Court of the Sverdlovsk Region sentenced a 35-year-old prisoner to seven and a half years in a special regime colony in the case of involvement in the banned AUE movement. The defendant was found guilty under Part 2 of Art. 282.2 of the Criminal Code and part 3. art. 321 of the Criminal Code (use of violence against a convicted person out of revenge for his assistance to the administration of the institution). According to the investigation, the prisoner, while serving his sentence in a regional colony, in the period from 2021-2022 took an active part in the activities of the cell of the AUE movement and "actively planted his ideology among other convicts." In addition, he also beat another prisoner who cooperated with the administration of the correctional facility.
- On June 21, 2023, the Investigative Committee of the Investigative Committee of Russia for the Amur Region reported that the Belogorsk City Court appointed a 31-year-old native of Tynda a total of 14 years in prison with the first 5 years in prison, the rest in a special regime colony, with deprivation of the right to engage in organizational activity in public associations for five years and with restriction of freedom for one and a half years. He was found guilty under Part 1 of Art. 282.2, part 1 of Art. 282.3 and and part 2 of Art. 228 of the Criminal Code (illegal possession of drugs on a large scale). The investigation and the court established that since December 2019, while serving a ten-year sentence for drug trafficking, he organized the activities of the AUE in the penal colony in the village of Vozzhaevka, attracted nine convicts to it, and collected money at the expense of a relative.
- On June 16, 2023, the joint press service of the courts of the Kaluga region circulated a message about the transfer to the court of the case against three prisoners who served their sentences in IK-5 in the Kaluga region in 2021-2022, and who created an AUE cell there, the "founder and leader" of which "became a 40-year-old native of another state, occupying the highest position in the criminal hierarchy." Recall, on March 22, 2023, it became known that the Investigative Committee of the Investigative Committee for the Kaluga Region opened a criminal case against 38-year-old native of Abkhazia Giorgi Shonia. He was suspected under Part 1 of Art. 282.3 of the Criminal Code and Art. 210.1 of the Criminal Code (occupation of the highest position in the criminal hierarchy). According to investigators, when Shonia was serving his sentence in a previous criminal case in IK-5 of the Kaluga region, he founded a cell of the banned AUE movement and spread the ideology of the criminal world and the “prisoner” society, and also raised money for the operation of the cell; according to the UK, he was assisted in this by a 32-year-old resident of the Tver region.
- On June 15, 2023, the department of the Investigative Committee for the Novosibirsk Region reported on the initiation of a criminal case under Part 2 of Art. 282.2 of the Criminal Code against a 35-year-old prisoner serving a sentence for theft in IK-15 in the region. According to the investigation, the convict, while in a correctional facility, from 2020 to 2023 tried to create a cell of the banned movement AUE, promoted the ideology of the organization and extorted money from other convicts to replenish the “common fund”.
- On June 7, 2023, the Department of the Investigative Committee for Adygea reported on the initiation of a criminal case against a 33-year-old prisoner serving a sentence in one of the regional colonies, under Part 2 of Art. 282.2 of the Criminal Code. According to investigators, while serving a sentence in a correctional institution, in 2019 the suspect joined the banned AUE movement, he also actively participated in its activities and spoke out in support of it.
- On June 1, 2023, it became known that a court in the Astrakhan region sentenced a local resident to nine years in a special regime colony in the case of involvement in the banned AUE movement. He was found guilty under Part 1 of Art. 282.2 of the Criminal Code and Part 1 of Art. 282.3 of the Criminal Code, as well as under Art. 210.1 of the Criminal Code (occupation of the highest position in the criminal hierarchy). According to the investigation, the convict, while serving his sentence in the previous criminal case in the regional IK-6, organized the activities of the banned movement on the territory of the cell, promoted its ideology and controlled the conduct of gambling by prisoners in order to replenish the “common fund”. in 2017 It is likely that we are talking about a prisoner who was sentenced to eight years in prison for selling drugs. The case of involvement in the AUE against him was initiated in the fall of 2022.
- On May 31, 2023, the Angarsk City Court sentenced Dmitry Kozlov, a resident of the village of Utulik, Slyudyansky district, Irkutsk region, to five years and two months in a strict regime colony and six months of restriction of freedom in the case of involvement in the banned AUE movement. He was found guilty under Part 2 of Art. 282.2 of the Criminal Code. According to investigators, while in the regional pre-trial detention center-1 and pre-trial detention center-6, as well as in the temporary detention center in the city of Slyudyanka, Kozlov propagandized the AUE ideology to the convicts and detainees, explained and interpreted its "concepts" and "foundations", despite the ban on the movement's activities .
- On May 30, 2023, it became known that Vladimir Taranenko, one of the coordinators of the Siberia Legal project to help prisoners, was convicted in Kemerovo. Presumably, we are talking about the verdict that the Zavodsky District Court of Kemerovo handed down on May 29 under Part 2 of Art. 321 of the Criminal Code (disorganization of the activities of institutions that ensure isolation from society, with the use of violence against an employee) and ch. 1.1 and 2 Art. 282.2 of the Criminal Code. Taranenko was given a suspended sentence of imprisonment (its duration is still unknown), as well as restriction of freedom. Earlier, on May 9, 2023, it was reported that during the debate of the parties in the Zavodskoy District Court, the prosecutor asked Taranenko to be sentenced to five years in prison. Prior to that, on August 2, 2022, Taranenko was sentenced by the Kirovsky District Court of Kemerovo to two years and four months in a penal colony under paragraphs. "a", "c" part 2 of Art. 163 of the Criminal Code (extortion), taking into account the unserved part of the punishment under Part 1 of Art. 228 of the Criminal Code (possession of drugs), assigned to him in May 2020. On the initiation of a case against Taranenko under Art. 282.2 of the Criminal Code by the investigation department for the Zavodskoy district of Kemerovo, the Investigative Department of the Investigative Committee of Russia for the Kemerovo region became known on November 25, 2021. According to the investigation, while serving his sentence, he promoted the activities of the AUE, involved the convicts and those arrested in this movement "by persuading and suggesting the need to teach the rules and principles of the AUE." Taranenko was also previously arrested for nine days under Art. 20.3.1 of the Code of Administrative Offenses (inciting hatred or enmity).
- On May 25, 2023, it became known that a case was opened in North Ossetia under Art. 282.2 of the Criminal Code in relation to the five alleged organizers and participants of the AUE cell. According to investigators, the cell was organized in 2021 by the wanted thief in law Dato Vladikavkazsky and a crime boss nicknamed Igorek, who appointed “watchers” in three pre-trial detention centers and colonies in the region. As part of the investigation, searches were carried out at 15 imprisoned crime bosses and their accomplices. They seized AUE paraphernalia, records with data on the replenishment of the “cash”, about 200 SIM-cards, ammunition, edged weapons, bank cards and telephones.
- On May 23, 2023, the Leninsky District Court of Novosibirsk sentenced prisoner Nikolai Shpunko to six years in a special regime colony and restriction of freedom for a year and a half after his release. He was found guilty under Part 1.1 and Part 2 of Art. 282.2 of the Criminal Code. In addition, Shpunko was banned from driving for two years. According to investigators, between November 3, 2020 and May 13, 2022, the prisoner actively participated in the activities of the cell of the banned AUE movement, helped raise money for its work and promoted the ideology of the movement, attracting new members to the organization.
- On May 19, 2023, the Investigative Committee of the Russian Investigative Committee for the Krasnodar Territory announced the initiation of a case under CC. 1, 1.1 and 2 Art. 282.2 of the Criminal Code in relation to the alleged organizer of the AUE cell and seven of its members. According to investigators, from August 2020 to May 2022, a 38-year-old prisoner of the Krasnodar pre-trial detention center organized an AUE cell there, built a hierarchy in it, promoted criminal ideology and collected money for representatives of the criminal world.
- On May 12, 2023, the Ivanovsky District Court of the Amur Region sentenced a 40-year-old native of Belogorsk, who is serving a sentence in IK-3 in the village of Srednebelaya for the murder and attempted murder of two persons, to seven years in a strict regime colony and a year of restriction of freedom after his release. The prisoner was considered involved in the banned AUE movement, he was found guilty under Part 1 of Art. 282.2 of the Criminal Code and Part 1 of Art. 282.3 of the Criminal Code. In addition, he was forbidden to engage in organizational activities in public associations for five years. According to investigators, while in a correctional institution, a native of Belogorsk attracted 11 convicts to participate in the activities of the AUE, “defining each of them the role and area of responsibility for coordinating the actions of other persons serving sentences.” Materials regarding other members of the group are separated into a separate proceeding. According to the Investigative Committee, the prisoners promoted criminal ideology and collected funds through the account of a relative of one of the convicts "to provide material support to representatives of the criminal world who are in places of deprivation of liberty, to form a base for replenishing the ranks of the criminal community."
- On May 15, 2023, it became known that the Dimitrovgrad City Court sentenced A. Ebekkuev, a prisoner in IK-10 in the Ulyanovsk Region, to 21 years in prison with a year and 11 months of restriction of liberty under Part 1 of Art. 282.2 of the Criminal Code, and found three more prisoners guilty under Part 2 of Art. 282.2 of the Criminal Code and appointed A. Tretyakov nine years in prison with a year of restriction of freedom, E. Parotkin - eight years in prison with a year of restriction of freedom, E. Aminov - two years and a month in prison. It can be assumed that the terms of punishment were appointed taking into account the previous ones. The Ulyanovsk Regional Court upheld this sentence, and it entered into force; the dates of both decisions were not reported. According to the version of the investigation, with which the court agreed, Ebekkuev, “having the status of the so-called. “watcher”, involved three other prisoners in the activities of the AUE, on his instructions they “propagated among the special contingent the so-called. “thieves” ideology, they extorted money from convicts for the subsequent financing of criminal structures.”
- On May 2, 2023, the department of the Federal Penitentiary Service for Tatarstan announced the suppression of the activities of the cell of the banned AUE movement on the territory of the republic and the initiation of a criminal case under Art. 282.1 of the Criminal Code (organization of an extremist community). The defendants in the case were convicts serving their sentences in correctional colony No. 8 in Almetyevsk, and remand prisoners in SIZO-3 of Bugulma. As follows from the report of the Federal Penitentiary Service, the suspects, adhering to the views of the AUE extremist movement, “propagated the ideology of thieves, antisocial behavior, the prestige of committing crimes, hatred, aggression and violence against the law enforcement system.”
- On April 29, 2023, the Department of the Investigative Committee for the Khabarovsk Territory and the Jewish Autonomous Region reported on the initiation of a criminal case under Part 1 of Art. 282.2 of the Criminal Code in respect of a resident of the Sakhalin Region serving a sentence in one of the colonies of the Khabarovsk Territory. According to investigators, since 2021, the convict has been the leader of the cell of the banned AUE movement and, while in the colony, "managed the criminal environment under his control."
- On April 25, 2023, the investigative department of the Russian Investigative Committee for the Ulyanovsk Region announced the initiation of a case under CC. 1 and 2 Art. 282.2 of the Criminal Code in connection with the activities of the AUE cell in Dimitrovgrad. According to investigators, since 2021, members of the organization have been promoting criminal ideology and collecting money for prisoners. The alleged organizers seized 1.2 million rubles, the court took him into custody. More than 300 thousand rubles were confiscated from three participants, they were sent under house arrest.
- On April 24, 2023, it became known about the detention in the Karachay-Cherkess Republic of seven people, alleged adherents of the AUE, as suspects under Part 1 of Art. 282.2 of the Criminal Code. According to investigators, they planned to establish the power of the prisoners of the Circassian pre-trial detention center over the guards, for which they were going to take on the recent crimes committed in the republic, and, once in the pre-trial detention center, provoke a riot. It is reported that for this they delivered weapons, money, drugs and phones to their comrades in the pre-trial detention center using drones. In addition, they are suspected of committing numerous thefts and extortion in different regions of Russia.
- On April 24, 2023, the Department of the Investigative Committee for the Republic of Adygea announced the indictment of “a convict occupying the highest position in the criminal hierarchy”, serving a sentence in one of the penal colonies of the republic, under Part 1 of Art. 282.2 of the Criminal Code, part 1 of Art. 282.3 of the Criminal Code, part 3 of Art. 171.2 of the Criminal Code (organization and conduct of gambling using gaming equipment outside the gambling zone, committed by an organized group) art. 210.1 of the Criminal Code (occupation of the highest position in the criminal hierarchy). According to the investigation, the convict created an AUE cell on the territory of the republican correctional institutions and headed it, and to finance it, he “organized systematic gambling among other convicts.” Five alleged members of the cell (their number is not reported) were charged under Part 2 of Art. 282.2, part 1 of Art. 282.3, part 3 of Art. 171.2 of the Criminal Code. On May 25, 2023, the Investigative Committee announced the completion of the investigation of the case and sending it to court.
- On April 14, 2023, the Main Investigative Directorate of the Investigative Committee and the Federal Security Service of Russia for Crimea and Sevastopol announced the initiation of cases under Part 1 of Art. 282.2 of the Criminal Code in respect of a previously convicted 29-year-old resident of Bakhchisaray and under Part 2 of Art. 282.2 of the Criminal Code - in relation to two of his accomplices. Earlier, they were charged with kidnapping and extortion by a group of people. According to investigators, the main suspect organized an AUE cell in the Bakhchisaray district in November 2020. Together with his accomplices, he extorted money from local residents, monitored the appearance of police officers on the territory, collected a “common fund”, promoted criminal traditions, etc. In particular, near the village of Frontovoe, Nakhimovsky district of Sevastopol, they kidnapped a 23-year-old that he had no money and valuables with him, they beat him with baseball bats and wooden sticks, loaded him into the trunk of a car and drove him around the area until he ran away, according to the UK. Investigators are also sure that the defendants in the case extorted 11,000 rubles from a 16-year-old boy.
- On April 12, 2023, the Investigative Committee of the Investigative Committee for Bashkortostan reported on the initiation of a case against a 39-year-old resident of the city of Baymak. He is suspected of 1 and 2 Art. 282.2 of the Criminal Code and Part 1 of Art. 321 of the Criminal Code (disorganization of the activities of institutions that ensure isolation from society). According to investigators, in June 2022, while in custody on another criminal case, he organized a cell of the AUE movement on the territory of the pre-trial detention center of Beloretsk, distributed the symbols of the banned organization, promoted the ideology of the AUE and involved new supporters in the movement. In addition, he, according to the UK, organized a mass hunger strike on the territory of the pre-trial detention center.
- On April 10, 2023, the Sverdlovsk Regional Court sentenced Alexander Krasiev (nicknamed Tito) and Alexei Kolbasov in the case of organizing an AUE cell in IK-52. According to the investigation, with which the court agreed, Krasiev, previously convicted of property crimes, organized an AUE cell in the colony in 2021 and took the highest position in the criminal hierarchy. He was considered a “polite” from thieves in law: using the phone and letters, he distributed the values of the criminal subculture among the convicts, appointed “watchers” for the detachments, and formed a common fund (“common fund”). The court found Krasiev guilty under Art. 210.1 (occupation of the highest position in the criminal hierarchy), part 1 of Art. 282.2 of the Criminal Code and Part 3 of Art. 321 of the Criminal Code (disruption of the activities of the colony with the use of violence or as part of an organized group; eight episodes) and sentenced to 10 years in prison in a special regime colony with a ban on leading public associations for five years and two years of restriction of freedom. Kolbasov received six years in a special regime colony with a three-year ban on participation in public associations and a year of restriction of freedom under Part 2 of Art. 282.2 and part 3 of Art. 321 of the Criminal Code. The defendants fully pleaded guilty and do not intend to appeal the verdict.
- On April 6, 2023, the Investigative Committee of the Investigative Committee for the Trans-Baikal Territory reported on the completion of the investigation into the involvement in the banned AUE movement in relation to two prisoners. The 37-year-old defendant in the case is charged under Part 1 of Art. 282.2 of the Criminal Code. According to investigators, while serving a sentence for especially serious crimes, he promoted the thieves' ideology, collected a "common fund" and, through an intermediary, a 40-year-old prisoner accused under Part 2 of Art. 282.2 of the Criminal Code, - involved others in the activities of the AUE. The case of both prisoners was sent to court for consideration.
- On April 4, 2023, it became known that the investigators of the Federal Security Service of Russia for Chuvashia opened a criminal case under Part 1 of Art. 282.2 of the Criminal Code in relation to a 38-year-old prisoner of IK-9. According to investigators, in 2022 he organized an AUE cell, involved other convicts in it, established an intra-group hierarchy with the distribution of roles and functions of its participants, formed their adherence to the "thieves' law", determined the ways of illegal communication with each other, the procedure for obtaining and distributing material and financial resources.
- On April 4, 2023, from the message of the GUFSIN of Russia in the Krasnoyarsk Territory, it became known about the verdict passed on two prisoners. On March 2, the Yemelyanovsky District Court sentenced Andrey Skripkalev to four years and one month in prison in a strict regime colony and restriction of freedom for a year and a half under Parts 1.1 and 2 of Art. 282.2 of the Criminal Code. Sergei Nikulin received two years in prison with restriction of freedom for eight months. Both were serving sentences in IK-7 in the Krasnoyarsk Territory for committing grave crimes and, according to the investigation, with which the court agreed, they participated in the activities of the AUE there.
- On April 3, 2023, the Investigative Committee of the Investigative Committee for the Samara Region announced the initiation of a criminal case under Part 2 of Art. 282.2 of the Criminal Code in relation to a resident of Syzran, born in 1993. According to investigators, in the period from October 2022 to February 2023, the suspect, who was detained for committing theft, actively participated in the activities of the AUE in the local pre-trial detention center, “carrying out illegal correspondence with prisoners held in other cells of the pre-trial detention center, in order to promote the activities the above organization and the search for like-minded people for their further inclination and involvement in the activities of an extremist organization.
- On March 15, 2023, the prosecutor's office of the Republic of Tyva reported that the Kyzyl City Court sentenced a 36-year-old local resident to four years in a strict regime colony and a year of restriction of freedom in the case of involvement in the AUE movement. He was found guilty under part 2 of p. 282.2 of the Criminal Code. According to investigators, while serving his sentence in a colony-settlement, the convict promoted the AUE ideology.
- On February 16, 2023, it became known that Marat Musin, a prisoner from the Perm penal colony No. 9, was charged with involvement in the banned AUE movement, apparently under Art. 282.2 of the Criminal Code. According to investigators, from 2020 to 2022, Musin controlled the activities of the AUE cell and promoted the ideology of the movement in the correctional facility. Under what article exactly the case was initiated is not yet known.
- On February 15, 2023, the Yashkulsky District Court of the Republic of Kalmykia sentenced six defendants in a criminal case on involvement in the banned AUE movement. According to the investigation, with which the court agreed, one of the prisoners organized an AUE cell on the territory of IK-2 Yashkul, and the rest became its participants. The convicts carried out propaganda of the "thieves' ideology", attracted new members to their ranks and incited hatred and enmity towards law enforcement officers. The organizer of the cell was found guilty under Part 1 of Art. 282.2 of the Criminal Code with the application of Part 3 of Art. 33 of the Criminal Code, the rest of the defendants - under Part 2 of Art. 282.2 of the Criminal Code. All of them were sentenced to imprisonment with serving sentences in penal colonies of strict and special regime. The initiation of a criminal case against the prisoners became known in February 2021.
- On February 9, 2023, from the message of the Federal Security Service of Russia for the Jewish Autonomous Region, it became known that a case was initiated against a prisoner from SIZO No. 1 under Part 2 of Art. 282.2 of the Criminal Code. According to law enforcement agencies, he monitored the observance of the thieves' "laws", propagandized the AUE, held conversations, explained the thieves' traditions and the penalties for violating them.
- On February 8, 2023, the Investigative Committee of the Investigative Committee of Russia for the Republic of Adygea announced the initiation of a criminal case under Part 2 of Art. 282.2 and part 1 of Art. 282.3 of the Criminal Code in relation to a 36-year-old resident of the Stavropol Territory, who, while in a correctional institution in Adygea, collected a "common fund", the funds of which were spent to ensure the activities of the AUE.
- On February 2, 2023, it became known that the Federal Security Service of the Republic of Komi opened a criminal case under Part 2 of Art. 282.2 of the Criminal Code in relation to a 31-year-old native of Ukhta, who is serving a sentence in IK-31 in Mikun. According to investigators, the prisoner was involved in the banned movement AUE, in the colony he promoted the ideology of the movement and called for the disorganization of the activities of the correctional institution.
- On January 28, 2023, the Investigative Committee of the Investigative Committee of the Russian Federation for the Republic of Adygea announced the initiation of a criminal case under Part 2 of Art. 282.2 and part 1 of Art. 282.3 of the Criminal Code in relation to a prisoner who, while serving a sentence in one of the local correctional institutions, “from April 2022 until the suppression of his illegal activities, systematically collected money from other convicts to the general cash desk, the so-called “common fund””; these funds, according to the investigation, were spent on ensuring the activities of the AUE.
- On January 23, 2023, the Investigative Committee of the Investigative Committee of the Russian Federation for the Vladimir Region announced the initiation of a criminal case under Part 1 of Art. 282.2 of the Criminal Code in relation to a prisoner of the Pokrov prison (FKU T-1), who, in the period from July 30, 2021 to June 1, 2022, “took active steps to organize” AUE activities in the colony.
- On January 16, 2023, the Ostrovsky City Court of the Pskov Region delivered a verdict in the case of involvement in the banned AUE movement against a prisoner from the regional IK-2. He was assigned a year of imprisonment under Part 2 of Art. 282.2 of the Criminal Code, taking into account the previous sentence, the punishment will be a year and eight months in prison. According to investigators, in 2020, the prisoner joined “a cell of an extremist movement whose activities are based on criminal extremist ideology,” and until 2022 he propagated its values and committed illegal actions against the administration of the institution.
