Tesak's case has been dismissed

The criminal case was closed on non-exonerating grounds - due to the death of the accused.

On February 21, 2023, the Mytishchi City Court of the Moscow Region, at the request of relatives, stopped the criminal prosecution of nationalist Maxim (Tesak) Martsinkevich. The criminal case was closed on non-exonerating grounds - due to the death of the accused.

As lawyer Alexey Mikhalchik explained, the decision was made after, at the end of 2022, a court near Moscow rejected the request of relatives that the case against Martsinkevich be tried posthumously with the participation of a jury, citing decisions of the Supreme and Constitutional Courts. “The relatives were interested in finding out in court the circumstances of the death..., but when the trial was conducted by one judge, this was completely excluded,” the lawyer said.

The victims also did not object to the dismissal of the case, citing difficulties associated with coming to court hearings.

Let us recall that on December 20, 2022, in the Mytishchi City Court of the Moscow Region, the criminal case of Maxim (Tesak) Martsinkevich and his accomplices was divided into two parts. Defendants Semyon Tokmakov, Alexander Lysenkov, Andrey Keil, Maxim Khatulev, Alexey Gudilin, Pavel Khrulev and representatives of Maxim Martsinkevich petitioned to have their case considered by a jury. However, as a result, the case of the six accused was sent to court in Sergiev Posad, where, according to the Investigative Committee, the crimes were committed, and the case of Martsinkevich was left in Mytishchi.

The defendants in the criminal case are charged with several murders: two people in the Smolensk region in the fall of 2003, two people in the Sergiev Posad district of the Moscow region in December 2003, the murder of a native of Dagestan in 2007 in the Losiny Ostrov park.

In December 2020, the Basmanny District Court of Moscow arrested the detainees Andrei Kayl, Maxim Khotulev, Alexander Lysenko, Pavel Khrulev, Alexey Gudilin. Semyon Tokmakov was arrested on December 23. Later, Maxim Aristarkhov , who was already serving his sentence, was charged in the same case. Those arrested were charged with committing murders by an organized group, motivated by national hatred and enmity (paragraphs “a”, “g”, “l”, part 2 of article 105 of the Criminal Code).

The Investigative Committee reported that the crimes were revealed as part of an investigation into the brutal murder of two people, a video of which appeared on the Internet in the summer of 2007. The murder became known when a video appeared on the Internet, where a native of Dagestan, Shamil Udamanov (Odamanov), and a native of Central Asia were brutally killed against the background of a flag with a swastika. The ultra-right cut off Udamanov’s head, and shot the second victim at point-blank range. According to investigators, the murder was committed in April 2007 near the town of Korolev, Moscow Region, “for the purpose of promoting nationalist ideology.” The investigation believes that the former leader of the Format 18 and Restrukt organizations, Maxim Martsinkevich , who was found dead in a pre-trial detention center in September 2020, also took part in the murder.

Martsinkevich also testified about committing, together with members of nationalist organizations, other murders of people of “non-Slavic appearance” in 2002-2006.
