In the Moscow region, a criminal case was initiated under Art. 280 of the Criminal Code against Mikhail Shendakov.
On March 7, 2023, it became known that a criminal case had been opened in the Moscow Region under Art. 280 of the Criminal Code (public calls for the implementation of extremist activities) and p "a" part 2 of Art. 282 of the Criminal Code (inciting hatred) against Mikhail Shendakov. It is reported that he "published a video with personal participation in one of the social networks, which, according to the expert's conclusion, contains calls for violent actions against law enforcement officers and government officials."
According to the wife of the person involved in the case, on February 1, a search was carried out in their house, and Shendakov himself was detained on January 31.
In March, a psychological and psychiatric examination found Shendakov in need of compulsory medical measures. Experts call Shendakov's "persistent delusional ideas" the basis for compulsory treatment. At the same time, he did not show signs of alcohol, drug or other dependence. Shendakov appealed the conclusions of the examination.
On June 16, 2023, the Krasnogorsk city court decided to send Shendakov to a psychiatric hospital for compulsory treatment.
Previously, Shendakov was repeatedly brought to administrative and criminal liability under Art. 282 of the Criminal Code (inciting hatred or enmity, as well as humiliation of human dignity), art. 280 of the Criminal Code (public calls for extremist activities), as well as under Art. 20.3.3 of the Code of Administrative Offenses of the Russian Federation (discrediting the Armed Forces of the Russian Federation).
Recall that on February 2, 2021, the Krasnogorsk City Court of the Moscow Region found the activist and Colonel of the Armed Forces in the reserve Mikhail Shendakov guilty under Part 1 of Art. 282 of the Criminal Code (inciting hatred towards a social group) and Part 2 of Art. 280 of the Criminal Code (public calls for extremism on the Internet) and sentenced him to two and a half years probation for the video “Surkov promised war to Donbass.” In November 2021, in the case of inciting hatred with the threat of violence (clause “a”, part 2, article 282 of the Criminal Code) for the video “ Colonel Shendakov told a joke about the National Guard” . The Krasnogorsk city court found him guilty and sentenced him to 3 years of probation.
On October 9, 2019, the Krasnogorsk City Court of the Moscow Region held Shendakov liable under Art. 20.3.1 of the Code of Administrative Offenses (inciting hatred) - the court fined him 10 thousand rubles for his speech “Chechens and Ingush, kill each other” (paragraph 4995 of the Federal List of Extremist Materials). According to the website of the Krasnogorsk city court, Shendakov was again brought to justice under Art. 20.3.1 of the Code of Administrative Offenses on March 2, 2020.
In 2022, Mikhail Shendakov was twice brought to administrative responsibility for discrediting the army (part 1 of article 20.3.3 of the Code of Administrative Offenses). On October 28, the court fined him 30,000 rubles because of Shendakov's publications in Odnoklassniki. On November 23, another administrative punishment was imposed on him. Administrative violations can be used as a reason to replace a suspended sentence with a real one.
On February 1, 2023, the Krasnogorsk City Court replaced retired colonel and activist Mikhail Shendakov with a suspended sentence due to the video “Surkov promised war to Donbass!” to two and a half years of a real term of imprisonment.
Shendakov repeatedly participated in the Moscow "Russian Marches" (in 2017 , 2018 and 2019 ).
