In Russia, the opportunity to avoid criminal punishment has already become commonplace by going to war. The method is gaining popularity not only among marginals, but also among former officials. On June 2, 2023, the Russian media circled the news about the deputy of the Alapaevsky municipal Duma Ilya Chizhe, sentenced to two years in prison for beating two young guys. "Simple guy", director of the kindergarten

Ilya Nikolayevich Chizh in December last year turned 35 years old. From at least 2016 to the present, he has been listed as a deputy of the Duma of the Alapaevskoye municipality in the constituency No. 2, and part -time - also the head of the Alapaevsky DOSAAF driving school.

The deputy of the Legislative Assembly of the Sverdlovsk Region Andrei Alshevsky on his blog characterizes Chizh as a “simple guy” who travels on an old “Volga” and makes local authorities work more efficiently. From this blog we also learn that Chizh previously served in special forces, worked as a lawyer, and then - the director of the kindergarten, from where he was fired when he decided to bring the problems of the institution he headed to the regional level.

This injustice, apparently, did not make Chizh the opposition and did not teach critical thinking. Being non-partisan and sometimes criticizing the local leadership, he generally remained quite loyal to both the Governor of the Sable Russian Evgeny Kuyvashev and President Putin. In 2021, Chizh nearly became the head of the Duma of Alapaevsk.

Judging by social networks, our hero, despite the emphasized brutality, is not very similar to the inverse “Wagnerist” with a sledgehammer, rather, on the contrary, gives the impression of a pleasant smiling person, a little naive and even romantic, capable of empathy, hot, not deprived of kindness and artistry. Either he runs along the snow with a naked torso, then bathes in an ice hole, then squats with a bar in a fitness club, then stood up for the humiliated and insulted fellow countrymen.

The Chizh also regularly posted requests to the official bodies about social problems identified in his district and answers to them, reported on the arrangement of children's holidays, announced charitable fees in favor of the disadvantaged, sometimes criticized the chairman and speaker of the Alapaevsky municipal Duma, without encroaching on the superiors of a higher. Moreover, the story that he got into.

"It would be a little bit, and he would have pushed my eyes"

On the evening of April 20, 2022, returning home in a service car, Chizh saw in his court a company of unfamiliar young guys. The athlete plans to change and go to the evening cross. As he later told the correspondent of one network edition, such a massive cluster in his native courtyard of the brutal type of youth greatly surprised him. Trying to see from the window of the service car, if there was something potentially “socially dangerous” in their behavior, he may have attracted their attention, and someone shouted after him an obscene phrase, something like: “Do you look?”

“I immediately stopped, because such rudeness ... opened the door without leaving the car, I say,“ What is the problem? ” Well, that is, I did not want any conflicts. Some provocations began. And one of them begins to approach me with obscenities, that is, I see that he is aggressive, and the time was already dark. I realized that there will be an attack now, ”Chizh told the journalist URA.RU more than a year ago.

Then the deputy jumped out of the car without drowning out the motor. After that, according to the participants in the events, a brawl occurred, as a result of which all nine opponents of the athlete of the Contact Processing were forced to flee.

Ilya claimed that while he found out relations with one of them, others, taking advantage of a numerical advantage, opened the door to his car, tried to steal the phone from there and broke the rear -view mirror.

“I was turning around, some of them ran, that is, I did not have time to catch up with them,” the deputy recalled. -I assembled a mirror, put it in the car and decided to at least find any of them to deliver to the police department, because they broke the mirror, but I will now sit an offender and pour tears. ”

Further, Ilya Nikolaevich for some time traveled the streets in search of his offenders, saw two running figures in the dark, overtook and shouts: "Who is brave?" - entered into an unequal battle with them.

According to Chizh, he managed to protect his head, setting his left hand, as a result of which he received a fracture of his hand with a displacement, but at the same time he was able to knock out the board from the attacker and somehow “neutralize it”. (“Neutralized” in this way Nikita Osinov subsequently fell into intensive care with a fracture of the cheekbone and the base of the arch of the skull). At this time, the second “opponent” hit the deputy behind the bottle on the head. The bottle crashed, and a “rose” formed in the attacker's hand.

“And he cuts me with a rose on his left hand with the phalanx of his fingers, you will get a lick. That is, I really assessed that there was a threat of my life. Still a little bit, and he would have pushed my eyes ... If I were sitting and chewing snot, in intensive care, probably, or maybe I would be in the cemetery now, ”the deputy concludes his dramatic story.

"Who is brave?"

The editorial office of the victim Nikita Osinov, who suffered a trepanation of the skull, this story sounds somewhat different. A heartbreaking video has been published on the Internet, where the bandaged Osinov, who had barely departed after anesthesia, tells his misadventures on the camera. They, they say, sat peacefully in the yard with friends in the amount of nine people, when suddenly a DOSAAF car abruptly braked near them. According to Osinov, his friend Nazmiev decided to joke and shouted, as if he had been driving his leg. The driver jumped out of the car and also shouted: "Who is brave?" Comrade Nikita, apparently considering himself as such, decided to find out what was the matter, and here the athlete-Konkertorets for the first time cooled it with a bat, after which the whole youth company fled in different directions.

Having lost sight of his friends, Osinov began to call Nazmiev on the phone, and they agreed to meet with a transformer booth. But near the Board of Nazmiev, an angry bachelor of jurisprudence again overtook. As Chizh later claimed in court, he found Nazmiev in the bushes lying on the ground, tried to lift it by the jacket, but he did not want to get up, but he raised a scream. Nikita Osinov with a one and a half meter board in his hands ran to this cry. According to him, Osinov decided that the Nazmiev was beaten, and wanted to distract the attacker. The enemy did not force himself to persuade himself for a long time, a brawl occurred, as a result of which Chizh was in a gypsum, and aspen in intensive care.

"In the fact of my hand broken"

Chizh tried to bring opponents to criminal liability. He recorded both trauma and damage, as many as 22 witnesses appeared in the case. However, Osinov, who broke his hand, was recognized as the result of the defending side, was refused the initiation of the case. According to Chizh, such a reaction to the accusations he made was the result of a political order:

“The police of the city of Alapaevsk once again violates the Criminal Procedure Code of the Russian Federation. A pre -investigation verification on the fact of my hand broken in the framework of Art. 112 of the Criminal Code of the Russian Federation (intentional infliction of moderate harm to health) of the Ministry of Internal Affairs of the Alapaevsky Ministry of Internal Affairs was carried out with gross violations ... What does our valiant police of the city of Alapaevsk do: it does not bypass the resolution and checks not according to Art. 112 of the Criminal Code of the Russian Federation, and under Article 118 of the Criminal Code of the Russian Federation (causing serious harm to health by negligence) to me. The investigation in the case lasted more than a year, as a result, the court completely took the side of the victims and on June 2 sentenced the deputy to two years in prison. Chizh did not appear to be announced to the sentence, hiding in an unknown direction, while renaming his account on VKontakte in Christian Gray - a contradictory, charming and mysterious character of an erotic thriller “50 shades of gray”.

"Wagner" instead of the sentence

Familiar Chizh informed the Jaan to reporters that he had concluded a contract with the Wagner PMC and went to fight to Ukraine. The former special forces Ilya Chizh showed sincere support of the so -called “Swear” from its first days and even touched to go to the front immediately after the mobilization was announced. He was not released, because by that time the criminal case had already been instituted .

According to lawyer Roman Kachanov,

The release of such persons from custody is preceded by the presidential decree on pardon, which cannot appear earlier than the conviction.

- What contract he will be able to submit to the court, I am also not very clear. PMC "Wagner" does not have a legal entity; in principle, it cannot be. “Wagner” is an illegal armed formation, no PMCs are in principle provided for by Russian law. If tomorrow Prigozhin falls out of disgrace, practice can change, and all these people will easily go under the articles “terrorism”, “mercenarism”, “Creation of illegal armed groups”, “illegal methods of conducting military operations” ... - These articles simply cry, ”Kachanov concludes.

There is no more fairness

This is not the first time that the deputy leaves for war in Ukraine to avoid punishment. Back in November last year, “important stories” wrote that Russian courts soften punishment to criminals who took part in the so -called “sucker”. On May 11, Komsomolskaya Pravda Ryazan reported that the Ryazan deputy Nikita Usachev went to fight two days before the court sentenced him to a criminal case of fraud. In March, the police put on the wanted list of the mayor of the Bolshoi Stone Rustusham Abushaev for fraud with the ground, but he went to war, and the court canceled the search.

This loophole in modern Russia is actively used not only by representatives of the authorities, but also by ordinary citizens, and even citizens of other states. In February 2023, the City Court of Kineshma of the Ivanovo region announced the wanted list of the accused in the illegal circulation of drugs of a local resident, 27-year-old Nikolai Nikola, who left the note: “He went to fight for Ukraine. Do not remember dashing! " It is reported by Kommersant .

In March 2023, a court hearing from ATMs was postponed in the Pervouralsky City Court due to the fact that one of the three defendants, whose surname is not called, became a participant in a special military operation in Ukraine. The trial is suspended. The court hearing is postponed to "check the arguments for the conclusion of the contract."

In the same March, the Vyborg District Court of St. Petersburg refused the investigation to detain a citizen of Tunisia Ben Ahmed Sheriff, accused of theft. As follows from the court decision, the decisive factor was that the Tunisian served in the Wagner PMC, took part in the hostilities in Ukraine and has a state award of the Russian Federation.

At the end of May, the court in the Tomsk Region delayed the execution of the sentence to a local resident who was convicted of six months restrictions on the case of a threat to the murder and illegal storage of weapons, as he went to war in Ukraine.

Similarly, the court in Yekaterinburg released Evgeny Teterin, accused of mediation of a bribe, to Ukraine. This is not the first time that Teterin leaves for the fighting zone, being under investigation.

Last year, he went to the Donbass, despite the subscription about the lower room. After that, the measure of restraint was not tightened to him.

“I think all this is very bad, the whole society suffers from this, including even those who have nothing against the current government,” says lawyer Roman Kachanov. - Because in this case, the court does not restore social justice. Normally, when a person is condemned by the court, there is a victim there, which is interested in this. The convicts themselves often do not know that the decree on pardon comes out earlier than they find themselves on the front line, but from the point of view of the law, after that, you can not go to any war at all. The pardon is in advance, I do not know how this actually happens. In theory, Putin’s personal signature should be on each decree, otherwise this is already a fictitious document. The fact that the first half a year after liberation should be served in the army, not legally recorded in the army, and since a person was pardoned-it means that he is free. What is the "social justice"? Not only does he not be will pay off, most likely, he will no longer compensate the victim, because when the criminal is free, he does not have any incentives to pay voluntarily.
