The Bakhtin family with a child suffering from SMA won a lawsuit against the Ministry of Health

The Leninsky District Court of Yekaterinburg considered the case of providing three-year-old Misha Bakhtin with medications for a rare genetic disease, spinal muscular atrophy (SMA) type 1. Judge Irina Yushkova ruled that the Ministry of Health of the Sverdlovsk Region must immediately provide him with medicine, Yulia Lipinskaya, a representative of the Bakhtin family, told Kholod.

In 2022, the Bakhtins already won the court - it decided to provide Misha with medicine at the expense of the regional budget of the Sverdlovsk region. However, the Ministry of Health delayed the procedure for issuing it, and also filed an application challenging the court decision based on the decisions of the council. Lipinskaya told Kholod that on February 16 the court decided not to grant the Ministry of Health’s application.

“The Bakhtins have already won the court, which ruled that Misha must be provided with medicine. This decision was confirmed by the court of cassation. The decision has entered into legal force and has not been cancelled, says Lipinskaya. — Representatives of the Ministry of Health claim that, taking into account the medical commissions and consultations held, the need to provide Misha with medicine supposedly disappeared. I argued that in this case, it is simply impossible to terminate the enforcement proceedings; this would be a violation in terms of the execution of the court decision that has entered into legal force on the immediate provision of the child with the drug Spinraza. The court sided with the Bakhtins.”

Dmitry and Yana Bakhtin, Misha’s parents, have been fighting for almost two years to ensure that their son receives expensive treatment. Spinal muscular atrophy is a disease whose progression can only be stopped in rare cases. Other children and adults born with SMA must take medications for life. While the Ministry of Health of the Sverdlovsk Region refuses to provide the Bakhtins with the medicine, they themselves raise money for the drug with the help of charitable foundations and philanthropists.

Misha’s father Dmitry Bakhtin from time to time goes out on single pickets: for example, in August 2023 he stood with a poster on Red Square, in December 2023 he stood for more than 10 hours in the cold near the building of the Ministry of Health of the Sverdlovsk Region. On February 15, 2024, the day of President Putin’s arrival in Yekaterinburg, Bakhtin also picketed. He was detained and later fined 10 thousand rubles under the article on violating the rules of holding a rally (Part 5 of Article 20.2 of the Administrative Code).
