Ukraine filed a notification to the European Council that it would stop adhering to the provisions of the Human Rights Convention during the war

Ukraine has applied to the European Council about the partial suspension of the actions in the country of some clauses of the European Convention on Human Rights and Freedom in connection with the military situation. The corresponding document is published on the website of the Council of Europe, it is specified that the application was submitted on April 4.

According to it, it is assumed that Ukraine during the war will stop adhering to the following provisions of the Convention:

• Inviolability of housing;
• The secret of correspondence, telephone negotiations and other correspondence;
• Non -interference in personal and family life;
• Freedom movement, free choice of place of residence, the right to freely leave and return to the territory of the country;
• The right to freedom of thought and word, free expression of opinions and beliefs, as well as the right to freely collect, store, use and disseminate information;
• The right to hold meetings, rallies, processions and demonstrations, as well as the right to strikes;
• The right to own, use and dispose of your property.

The document also lists specific measures and actions that can be introduced and undertaken during martial law in violation of the Convention. This:

• Forced alienation of private or communal property for the needs of the state;
• The introduction of commandant;
• A special regime of entry and exit, restriction of the movement of citizens, foreigners and stateless persons, traffic;
• Inspection of things, transport, baggage, goods, office premises and housing of citizens;
• A ban on peaceful assemblies, rallies, processions, demonstrations and other events;
• A ban or restriction on the choice of a place or place of residence;
• Prohibition of citizens who are on military or special accounting, change their place of residence or stay without proper permission;
• The establishment of a military fee for physical and legal entities.
