In June 2023, the Krasnogorsk City Court ruled to send Shendakov for compulsory treatment in a psychiatric hospital, but instead the retired colonel was sent to a penal colony. He was released from the colony at the request of the head of one of the Ryazan colonies, who "did not want to take responsibility for the detention of Shendakov with a psychiatric diagnosis." After his release, Shendakov was required to report for compulsory treatment himself, but he did not do so.
Previously, Shendakov was repeatedly brought to administrative and criminal liability under Article 282 of the Criminal Code (incitement of hatred or enmity, as well as humiliation of human dignity), Article 280 of the Criminal Code (public calls for extremist activity), and also under Article 20.3.3 of the Code of Administrative Offenses of the Russian Federation (discrediting the Supreme Court of the Russian Federation).
On February 2, 2021, the Krasnogorsk City Court of the Moscow Region found Shendakov guilty under Part 1 of Article 282 of the Criminal Code (incitement of hatred towards a social group) and Part 2 of Article 280 of the Criminal Code (public calls for extremism on the Internet) and sentenced him to two and a half years probation for the video "Surkov promised war to Donbass". In November 2021, in the case of incitement of hatred with the threat of violence (paragraph "a" of Part 2 of Article 282 of the Criminal Code) for the video "Colonel Shendakov told a joke about the Russian National Guard" . The Krasnogorsk City Court found him guilty and sentenced him to three years of probation.
On October 9, 2019, the Krasnogorsk City Court of the Moscow Region held Shendakov accountable under Article 20.3.1 of the Code of Administrative Offenses (incitement to hatred) — the court fined him 10,000 rubles for his speech "Chechens and Ingush, kill each other" (item 4995 of the Federal List of Extremist Materials). According to the website of the Krasnogorsk City Court, Shendakov was again held accountable under Article 20.3.1 of the Code of Administrative Offenses on March 2, 2020.
In 2022, Mikhail Shendakov was twice brought to administrative responsibility for discrediting the army (Part 1 of Article 20.3.3 of the Code of Administrative Offenses). On October 28, the court imposed a fine of 30 thousand rubles on him due to Shendakov's publications on Odnoklassniki. On November 23, he was given another administrative penalty. Administrative violations can be used as a reason to replace a suspended sentence with a real one.
On February 1, 2023, the Krasnogorsk City Court replaced Mikhail Shendakov's suspended sentence for the video "Surkov promised war to Donbass!" with two and a half years of real imprisonment.
