According to a police officer who spoke to them, the detainees committed the crime out of hooligan motives. A criminal case has been initiated under Art. 244 of the Criminal Code of the Russian Federation (desecration of burial places).

On May 5, 2010, the Astrakhan Oblast Investigative Committee of the Russian Federation initiated a criminal case under Part 1 of Article 282 of the Criminal Code of the Russian Federation (incitement of hatred or enmity, as well as humiliation of human dignity) on the fact of the appearance on the Internet of the text of a poem calling for the incitement of national hatred, and images Nazi symbols.

On April 23, 2010, the Kovrov City Court (Vladimir Region) delivered a verdict in the case under Part 1 of Art. 282 (inciting national hatred committed in public) against 19-year-old Alexander Kulkov. The court sentenced Kulkov to 120 hours of compulsory work. It should be reminded that in January 2009 the defendant painted xenophobic graffiti on the walls of Kovrov's residential buildings. The case was sent to court on March 25, 2010. On May 5, the verdict entered into force.

On May 7, 2010, Russian President Dmitry Medvedev signed the law "On Amendments to the Criminal Code of the Russian Federation in terms of sentencing in the form of compulsory work." The law was adopted by the State Duma on April 23, 2010 and approved by the Federation Council on April 28, 2010. The law expands the list of articles of the Criminal Code of the Russian Federation, the sanctions of which contain punishment in the form of compulsory work.
