The Supreme Court of Karelia increased from 3.5 years in a colony to 13 years of strict regime the term of punishment to the chairman of the Karelian branch of the Memorial Society Yuri Dmitriev, Mediazon reports with reference to the lawyer of the adoptive daughter of the historian Igor Perov.
Such a punishment Dmitriev is imposed on parts 3.4 of Article 132 of the Criminal Code (violent acts of a sexual nature against a minor), the publication claims. Meanwhile, the Court's Card Card states that under the 132nd article Dmitriev, its paragraph "B" of part 4 (violent actions of a sexual nature with a person who has not reached the age of fourteen) is charged.
For other articles of the prosecution, on which Dmitriev was justified in the court of first instance, the case was sent for consideration to the City Court of Petrozavodsk.
The consideration of the case in the appeal by judge Alla Rats was closed. The process took three meetings - they took place on September 16, 22 and 29.
Dmitrieva defended the lawyer Artem Cherkasov appointed by the Armed Forces. Victor Anufriev, representing Dmitriev throughout the process, fell ill. Dmitriev stated that he was not satisfied with the appointed defender. To decide whether to appeal the decision of the Court of Appeal, Dmitriev will be with Anufriev, Cherkasov said .
Cherkasov had three days to get acquainted with a multi -volume business.
Assuming the possible bias in the consideration of the Dmitriev case, 250 people signed under an open letter published in Novaya Gazeta, the chairman of the court Anatoly Nakvasu. They called him to refer the case to the court of any other Russian region. Among the signatures of the letter are famous actors, directors, politicians, human rights activists, journalists. The court replied that only persons participating in the process can petition the transfer of the case.
On July 22, the Judge of the Petrozavodsk City Court Alexander Merkov sentenced Dmitriev to 3 and a half years in prison , declaring guilty of violent acts of a sexual nature in relation to the adopted daughter. At the same time, on charges of depraved actions (part 3 of Article 135 of the Criminal Code as amended by 2009 and Article 135 as amended by 2004), the manufacture of children's pornography (paragraph "in paragraph 2 of Article 242 of the Criminal Code) and storage of the main parts of firearms (part 1 of Article 222 of the Criminal Code), the Dmitriev court acquitted.
If this sentence stood in an appeal, Dmitriev would be released on November 12.
At the Petrozavodsky City Court on July 22, 2020, on the day the sentence was sentenced to Yuri Dmitrieva:
In the second case, Dmitriev is accused of the fact that in 2012-2016 he subjected the adopted daughter of Natalia sexual violence. According to Novaya Gazeta, the essence of the prosecution is that the historian touched the girl’s crotch several times. The prosecution was based on the statements of the girls made during the "conversations" on May 18 and June 6, 2018. The first of these "conversations" was carried out by Valentina Frollenkov, the grandmother of Natalia, and the psychologist, the second - the psychologist and investigator Maxim Zavadsky. Dmitriev himself explained that he could touch the child "for his clothes and could climb under the clothes when the clothes were raw, that is, when the child was written." "On one of the days, in the morning, when (daughter. - Ed.) I came to me and, as usual, sat on my knees, I felt the smell of urine, I realized that it was described. Naturally, I touched the panties and front and back in the genital area, I realized that the child was described, after which we went to wash. This was a week before her premises in the republican hospital about the night. Enorez, ”he said.
At the end of May last year, Anufriev said that the cellmates in the Petrozavodsky pre -trial detention center forced Dmitriev to write a confession , threatening to “lower it” otherwise. After the Politsyk told the insulator administration that he would "be forced to defend his life and honor and the case may end with a corpse", he was transferred to another camera.
Dmitriev was detained on December 13, 2016 and two days later sent to a pre-trial detention center, where he was until January 27, 2018, when he was released on a recognizance not to leave. First, he was charged with photographing the adoptive daughter of naked and storing the house of circumcision. In total, 9 photos of the girl made by Dmitriev appeared in the case when she was 3, 4 and 6 years old. Dmitriev claims that he took the first four pictures at the request of her daughter herself, four more - when she fell ill in the groin, and the last one - when she felt discomfort in the groin, rolling on the pony.
Enofriev’s lawyer emphasized that Dmitriev adopted a child with slow development and he was recommended to periodically photograph the girl to fix her condition. Pictures were stored on the home computer of a historian; He did not print them, did not publish and did not send anyone. As for the cut, Dmitriev took it a few years earlier from the children in the yard, and for shooting weapons are no longer suitable.
On April 5, 2018, the Judge of Petrozavodsk City Court Marina Nosova condemned Dmitrieva to two and a half years of restriction of freedom under Article 222, and the charges under Articles 135 and 242.2 of the Code withdrew from him as unproven. Given the time previously spent by the convict in the pre -trial detention center, out of two and a half years of restriction of freedom, he had to leave only three months.
However, the prosecutor of Askerov appealed the verdict. Valentina Frollenkov, Grandma of Natalia, also filed an appeal. On June 14, 2018, the Supreme Court of Karelia canceled the sentence to Dmitriev . The case was returned to the City Court for a new consideration. The historian was taken by a non -departure. On the 27th day of the same month, Dmitriev went by car from Petrozavodsk to the Svirsky Monastery on Lake Ladoga (Leningrad Region). In Olonz, the traffic cops detained his car and detained the historian. The investigator of the Petrozavodsk city department of the Investigative Committee of Zavadsky opened the second case against Dmitriev and the next day he was sent to the pre -trial detention center.
Dmitriev is known in particular as a researcher of the Sandarmokh tract in the Medvezhyegorsk district of Karelia. This is a place of mass Stalin's executions. In 2018, the Russian Military Historical Society, headed by the then Minister of Culture Vladimir Medinsky, conducted its own excavations in Sandarmokh in order to prove the falsified thesis that the NKVD, but the Finnish army during the Second World War carried out executions in the tract.
