Recently, there has been an increase in demands on telecom operators to block websites containing "extremist materials." However, prosecutors everywhere and regularly oblige operators links restrict access to sites due to one or more materials found there, recognized as extremist (and often not recognized as such by the court, but only suspected by the prosecutor's office of "sedition"). Sometimes these requirements also apply to sites of religious organizations and groups. Our position on the problem of site blocking is detailed here .
Now the prosecution authorities, as a rule, require blocking without going to court, and these actions are motivated by the Ruling issued on May 10, 2011 by the Judicial Collegium for Civil Cases of the Supreme Court of the Russian Federation. This document summarizes news about site blocking where we have reason to believe that law enforcement agencies have exceeded their authority, such as requesting blocking access to a site that does not contain materials included in the Federal List, or where such materials are an atypical exception (for example, in a network library).

On December 25, 2015, it became known that the Kalininsky District Court of Chelyabinsk fined the local telecom operator ER-Telecom Holding JSC for 100 thousand rubles under Art. 20.29 of the Code of Administrative Offenses (mass production and distribution of extremist materials). The reason was that from the computers of the Secondary School No. 1 of Chelyabinsk, which was served by this telecom operator, it was possible to access prohibited sites. From our point of view, the operator was punished wrongfully. Firstly, special filters were to be installed on school computers to limit schoolchildren's access to prohibited information, and secondly, the operator's actions cannot be qualified under an article against the deliberate mass distribution of extremist materials.
On May 25, 2015, the prosecutor's office of the Sengileevsky district of the Ulyanovsk region announced the submission made to the director of the Ulyanovsk branch of OJSC Rostelecom. The reason for the sanction was that the provider did not restrict access to a number of sites, including nameofrussia.net/blog/faith/961, halifat.info/maktaby/kitab/390-concepciya-, goodbasis.com/info/74, which, during the verification, texts included in the Federal List of Extremist Materials were found. Among such materials is the book "Counterfeit Church" by K. Tovbin, the recognition of which as extremist, we consider unlawful.
On May 15, 2015, the prosecutor's office of the Vygonichsky district of the Bryansk region announced a lawsuit to the Sovetsky District Court of Bryansk, in which it demanded that OJSC Rostelecom be required to block access to sites containing information whose distribution is prohibited in Russia. The reason for the lawsuit was that from the computers of the Vygonichi School. Pavel Zaitsev had access to the site with the books "Guide for Youth" by Said Nursi and "The Doctrine of Fascism" by Benito Mussolini, included in the Federal List of Extremist Materials. It is not clear from the prosecutor's report whether content filters are installed on school computers, but we assume that otherwise the prosecutor's office would point out their absence. On April 3, 2015, the Vsevolozhsk City Prosecutor's Office of the Leningrad Region announced a submission made to the Internet provider CJSC Neva Television Cable Network. The reason for the sanction was that in part of the educational institutions of the city " the system of content filtering on computers has not been established " and therefore there is access to prohibited materials. It is not possible to understand from the prosecutor's report whether the schools had a system of content filtering, however, we proceed from the fact that otherwise it would have been indicated that it did not exist.
On April 1, 2015, the prosecutor's office of the Narovchatsky district of the Penza region announced the initiation of a case under Part 2 of Art. 6.17 of the Code of Administrative Offenses (non-use by a person organizing access to information disseminated through information and telecommunication networks (including the Internet) in places accessible to children, administrative and organizational measures, technical, software and hardware to protect children from information that is harmful to their health and (or) development) in relation to the entrepreneur - the owner of the "Fresh Bakery" store. The case has been taken to court. The store had WiFi, which was not equipped with a content filtering system. At the same time, according to the prosecutor's office, "children who come to the store can use the access to the Wi-Fi network through their phone," and thus gain access to prohibited information. As a reminder, we oppose prosecution for the lack of content filtering of the owners and administration of cafes, Internet cafes, hotels, shops and other similar establishments, since they are designed not only for children (supervised by parents), but also for adult users whose rights should not be restricted.
On March 31, 2015, the prosecutor's office of the Penza district of the Penza region announced the submission made to the director of the Penza branch of OJSC Rostelecom. The reason for the sanction was that the provider, having the technical ability, did not block access to materials included in the Federal List of Extremist Materials, in particular, to the book of Jehovah's Witnesses "What the Bible Really Teach". As a reminder, we consider the persecution of Jehovah's Witnesses and the banning of their texts for extremism unlawful and perceive it as religious discrimination.
On March 5, 2015, it became known that the prosecutor's office opened administrative cases under Part 2 of Art. 6.17 of the Code of Administrative Offenses (violation of the legislation of the Russian Federation on the protection of children from information harmful to their health and (or) development) against five legal entities that own city cafes. Cases against three of them have already been considered: cafes "Peoples", "New York Pizza" and "ShashlykoFF" were fined 20 thousand rubles each. The reason was that the cafes provided visitors with the opportunity to access the Internet (obviously, via Wi-Fi), however, "appropriate measures and means were not taken to protect children from information that is harmful to their health and development - access to the site where extremist materials posted. At the same time, it remains unclear whether the cafe lacked a content filtering system or the filters did not fully cope with the task. As a reminder, we are against holding the administration of cafes, Internet cafes, hotels and other similar establishments liable for the lack of content filtering, since they are designed not only for children (supervised by parents), but also for adult users whose rights are not should be limited.
On February 4, 2015, it became known that the deputy prosecutor of the Chechen Republic filed a lawsuit to oblige republican providers to restrict access to 17 pages of the Instagram social network. From the point of view of the Chechen prosecutor's office, they contain "texts of extremist content, as well as photographs and other materials that offend the religious feelings of believers" .
