Criminal cases dismissed by the court due to the partial decriminalization of Art. 282 CC

On December 27, 2018, Russian President Vladimir Putin signed a package of laws on the partial decriminalization of Art. 282 of the Criminal Code (inciting hatred or enmity, as well as humiliation of human dignity) by introducing a mechanism of administrative prejudice. A new article was added to the Code of Administrative Offenses. 20.3.1 , the disposition of which coincides with Part 1 of Art. 282 of the Criminal Code. Cases under Part 1 of Art. 282 of the Criminal Code, begun before the entry into force of the signed laws, cannot be reclassified to a new art. 20.3.1 of the Code of Administrative Offenses, because it did not exist at the time of the initiation of the case, but can be closed on the basis of decriminalization.

In this list, we collect all criminal cases under Art. 282 of the Criminal Code, which were terminated by a court decision after the entry into force of the new laws. We have collected cases terminated at the investigation stage here , and sentences canceled by the court are here .

On October 29, 2019, in the Oryol region, the Kromsky district court dismissed the criminal case under Art. 282 of the Criminal Code against the local poet Alexander Byvshev, who was accused of publishing the poems "Russian Spirit" and "Mighty Heap".
On July 31, 2019, it became known that in the city of Yuzhno-Sakhalinsk, the court terminated the criminal case under Art. 282 of the Criminal Code against a 38-year-old local resident, who was accused of publishing xenophobic materials in the Vozmezdie group on the VKontakte social network.
On May 20, 2019, the Bolotninsky District Court of the Novosibirsk Region terminated the criminal case under Part 1 of Art. 282 of the Criminal Code against the school teacher Natalya Oganisyan. The reason for initiating the case was that, according to investigators, during a school meeting a woman insulted the mother of one of the students, a citizen of Uzbekistan. After the court decision, Oganisyan appealed to the Novosibirsk Regional Court, demanding to consider the case and find her innocent. However, the higher authority upheld the decision of the Bolotninsky District Court.
On May 7, 2019, the Suvorovsky District Court of the Tula Region terminated the criminal case under Part 1 of Art. 282 of the Criminal Code against Alexei Menyailov, the founder of the Partisan Truth of Partisans movement, and his wife Slatana Menyailova, who were accused of creating and publishing videos directed against women on the Internet.
On March 15, 2019, the Supreme Court of Kabardino-Balkaria approved the decision made by the Maysky District Court on January 23 to terminate the prosecution under Part 1 of Art. 282 of the Criminal Code of Yuri Zalipaev, who was accused of distributing banned brochures of Jehovah's Witnesses. He has been given the right to rehabilitation.
On March 7, 2019, the Preobrazhensky District Court in Moscow stopped the prosecution of Yevgeny Khoroshilov, Maxim Gadzhimagomedov, Roman Parshin, Nikita Bobrovsky and Stanislav Moskalev — Lokomotiv fans who were accused of shouting xenophobic slogans during the Lokomotiv-Skenderbeu match.
On March 1, 2019, the Supreme Court of Kabardino-Balkaria terminated the criminal case under Part 1 of Art. 282 of the Criminal Code against pensioner Arkadi Akopyan from the town of Prokhladny, who was convicted of distributing banned brochures of Jehovah's Witnesses.
On February 26, 2019, the Supreme Court of Ingushetia terminated the criminal case under Part 1 of Art. 282 of the Criminal Code against opposition activist Magomed Khazbiev, convicted of inciting hatred against local authorities.
On February 21, 2019, the Nakhimovsky District Court of Sevastopol terminated the criminal case under Art. 282 of the Criminal Code against the chairman of the Union of Workers of Sevastopol, the secretary of the Sevastopol branch of the ROT FRONT party, Valery Bolshakov, who was suspected of publishing materials on social networks directed against the “social group Terek Cossacks”, as well as calling for the overthrow of the “Putin’s “regime”” and the establishment of “ dictatorship of the proletariat ."
On February 20, 2019, it became known that in Rostov-on-Don, the Kirovsky District Court terminated the criminal case under Art. 282 of the Criminal Code against Alexander Guliyev, a member of the Yuzhnye group. Details of the case, unfortunately, are unknown.
On January 24, 2019, it became known that the Novo-Savinovsky District Court of the city of Kazan of the Republic of Tatarstan closed the criminal case against 49-year-old Olga Ziyatdinova, who was accused of publishing a comment insulting the Tatars on VKontakte.
On January 24, 2019, it became known that in Novosibirsk a court dismissed a criminal case against a previously convicted local resident who, during a conflict in a shopping center, shouted xenophobic insults at security guards.
On January 21, 2019, in the Altai Territory, the Barnaul Railway Court dismissed a criminal case against student Daniil Markin, who was accused of humiliating the dignity of Christians for publishing atheistic memes in the public domain on his personal page on VKontakte from December 2013 to January 2017.
On January 21, 2019, it became known that in St. Petersburg, the Kirovsky District Court dismissed a criminal case against a local resident who was accused of publishing certain xenophobic images on his page on the VKontakte network, "containing an offensive and contemptuous attitude towards representatives of non-Russian nationality."
On January 18, 2019, it became known that the Kurtamyshsky District Court of the Kurgan Region dropped a criminal case against a local resident who was accused of publishing certain videos and photographs on the VKontakte social network in 2015 and 2016 that promoted the ideology of National Socialism.
On January 15, 2019, in St. Petersburg, the Nevsky District Court dismissed the criminal case against Eduard Nikitin, a 43-year-old unemployed disabled person of the second group, who was accused of publishing several xenophobic posts and comments on them, directed, according to experts, against “representatives of the Russian nation” and "groups of persons on the basis of state affiliation - Russians."
On January 14, 2019, in the Republic of Bashkortostan, the Kirovsky District Court of Ufa dismissed the case of 35-year-old Amin Shayakhmetov, who was accused of inciting hatred and humiliating dignity on the grounds of nationality, language, and attitude to religion, due to the lack of corpus delicti.
