Recently, demands for telecom operators to block sites containing “extremist materials” have become more frequent. Nevertheless, prosecutors' offices everywhere and regularly oblige telecom operators to restrict access to sites because of one or more materials found there that are recognized as extremist (and often not recognized as such by the court, but only suspected by the prosecutor's office of "sedition"). Sometimes these requirements also apply to the websites of religious organizations and groups. Our position on the issue of website blocking is outlined in detail here .
Now the prosecutor's office, as a rule, demands blocking without going to court, and these actions are motivated by the Ruling issued on May 10, 2011 by the Judicial Collegium for Civil Cases of the Supreme Court of the Russian Federation. We believe that often such actions are still unlawful. Read more about this here .
This document combines those news about blocking of sites, in relation to which we have reason to believe that law enforcement agencies exceeded their powers, for example, they demanded to block access to a site that does not contain materials included in the Federal List, or on which such materials represent is an atypical exception (for example, in a network library).

On November 19, 2014, the prosecutor's office of the Inzensky district of the Ulyanovsk region announced a proposal made to the director of the Ulyanovsk branch of OJSC Rostelecom. On November 5, 2014, the prosecutor's office of the Ulyanovsk region reported that the prosecutor of the Sengileevsky district made a representation to the director of the Ulyanovsk branch of OJSC Rostelecom with a demand to immediately take measures to limit access to Internet resources that promote the inferiority of citizens based on their nationality and religion , and bring to strict liability all guilty officials. The reason was, among other things, that subscribers of the Ulyanovsk branch of OJSC Rostelecom had access to the official website of Jehovah's Witnesses jw.org, on which one can find the text of the prohibited brochure “What Does the Bible Really Teach?” Let us remind you that we consider the ban on literature of Jehovah's Witnesses to be unlawful.
On September 8, 2014, the prosecutor's office of the Republic of Udmurtia reported that the magistrate court of the Votkinsk district judicial district sentenced the director of the Ural Dawns sanatorium-preventorium to a fine of 20,000 rubles under Part 2 of Art. 6.17 of the Code of Administrative Offenses (non-use by a person organizing access to means of protecting children from information harmful to their health and (or) development distributed through information and telecommunication networks). Other employees found guilty were subject to disciplinary action. The reason was that Wi-Fi worked on the territory of the sanatorium, but a content filtering system was not installed and age confirmation was not provided. On September 4, 2014, the prosecutor's office of the Lipetsk region reported that the heads of ten campaigns-regional telecom operators - Media Network LLC, Telecom TZ LLC, BIG Telecom Lipetsk LLC, Aikotel LLC, New Communication Technologies LLC, LLC "Raduga-Telecom", CJSC "Lipetsk Mobile", LLC "Lipetsk Cable Networks", LLC "IT-Net" and IP Ilinu V.N. - proposals were made to eliminate violations of the legislation on countering extremist activities. It is reported that the demands of the prosecutors have been satisfied: 3 officials have been disciplined for violations, and access to prohibited literature has been blocked. Apparently, we are talking about a website that contains the works of the Turkish theologian Said Nursi, the ban of which we consider unlawful.
On August 25, 2014, the Magistrate Court of Judicial District No. 4 of Budennovsk, Stavropol Territory, at the request of the Budennovsk Interdistrict Prosecutor's Office of the Stavropol Territory, sentenced under Art. 6.17 of the Code of Administrative Offenses of the Russian Federation (violation of the legislation of the Russian Federation on the protection of children from information harmful to their health and (or) development) cafe owners Victoria Selyametova and Yulia Sarah to a fine of 5 thousand rubles each. The reason was that access to prohibited information, including extremist materials, was possible through the establishment’s wireless Wi-Fi network. On July 22, 2014, the prosecutor's office of Dmitrovgrad, Ulyanovsk region, announced a claim against the Ulyanovsk branch of OJSC Rostelecom for the obligation to restrict access to the " History " section of the "Audiobooks" network library and to the " Torrentino " torrent tracker. The reason for the lawsuit was the discovery of G. Picker’s book “Hitler’s Table Talks” on these resources, which was included in the Federal List of Extremist Materials. In addition, the prosecutor's report about the statement of claim refers to the Format 18 video "I am Russian" (item 1781 of the Federal List of Extremist Materials), but provides a link to the torrent of Picker's book. On July 14, 2014, the prosecutor's office of the Ulyanovsk region reported that the prosecutor's office of the Zavolzhsky district of Ulyanovsk went to court with a demand to limit access to three sites due to the fact that they posted the banned book "Grebe" by Ernst Chiemer (a children's propaganda book from the time of the Third Reich). In particular, we are talking about the network library free-audiokniga.narod.ru, which contains a variety of materials. From our point of view, the prosecutor’s office should have sought to restrict access specifically to that page of the library that contained the book Chimera, and not to the entire resource as a whole.
On June 27, 2014, the prosecutor's office of the Perm region reported that the Leninsky District Court of Perm satisfied the claim of the prosecutor of the city of Krasnokamsk against the Perm branch of Rostelecom OJSC and blocked a number of online libraries containing extremist materials, including books by Said Nursi. We consider the ban on Nursi’s works to be unlawful, and in addition we oppose the blocking of large resources due to individual pages.
On June 3, 2014, it became known that the Vyborg City Prosecutor's Office sent a statement of claim to the court, in which it demands to oblige the Internet provider LLC "SUCCESS" to limit access to extremist materials that were available to students of the Vyborg Technical School of Agro-Industrial and Forestry Complex. It is impossible to understand from the prosecutor's report whether the computer club had a content filtering system, but we assume that otherwise it would have been indicated that it did not exist.
On April 29, 2014, it became known that by decision of the Central District Court of Barnaul dated January 28, 2014, Rostelecom OJSC was ordered (among other materials included in the Federal List of Extremist Materials) to block access to the Good Truth Machine leaflet, recognized as extremist 12 December 2012 by the judicial panel of the Vologda Regional Court. Rostelecom introduced blocking by IP address, thus blocking the sites navalny.ru, dacha.fbk.ru and delo.navalny.ru.
On April 11, 2014, it became known about the claim of the prosecutor's office of the Kalininsky district of Cheboksary against the provider ZAO ER-TELECOM HOLDING, filed in the Leninsky district court of Cheboksary, which contains a demand to limit access to extremist sites. The reason for the lawsuit was the results of a prosecutor's investigation, which revealed that the Cheboksary computer club, which used the services of this provider, had access to materials included in the Federal List. It is impossible to understand from the prosecutor's report whether the computer club had a content filtering system, but we assume that otherwise it would have been indicated that it did not exist. On April 2, 2014, the prosecutor's office of the Chelyabinsk region reported that, at the request of the prosecutor's office of Novocheboksarsk, the Moscow District Court of Novocheboksarsk sentenced the provider Internet Center LLC (CHEBNET) under Art. 20.29 of the Code of Administrative Offenses (distribution of extremist materials) to a fine of 50 thousand rubles, and the Leninsky District Court of Cheboksary, under the same article, fined the director of the city branch of Rostelecom OJSC two thousand rubles for the fact that providers did not block materials recognized as extremist by the decision of Kirovsky District Court of Novosibirsk dated June 21, 2013. In particular, we are talking about the wrongfully banned video of Navalny’s supporters “Let us remember the Crooks and Thieves their Manifesto 2002.” In addition, from our point of view, it is unlawful to hold providers liable under Art. 20.29 of the Code of Administrative Offences, since they are not involved in the deliberate distribution of prohibited materials.
On April 1, 2014, the Rostelecom provider was forced to block the website of the well-known newspaper Kopeysky Rabochiy in the Chelyabinsk region. The bona fide resource was blocked because the Central District Court of Barnaul decided to block access to sites containing extremist materials via IP. “Kopeysky Worker” was also located at the same IP. Administrators of the newspaper's website transferred it to another IP.
On April 1, 2014, it became known about claims against providers OJSC Rostelecom and LLC Net By Net Holding, obliging them to limit access to sites of an extremist nature, prepared by the prosecutor's office of Volgodonsk, Rostov region. The reason for the lawsuits was that, despite the content filters available on computers in the pedagogical and medical colleges of Volgodonsk, inspectors were able to gain access to prohibited materials, in particular, to the poem “Eternal Trouble” by A. Trubin, included in the Federal List of Extremist Materials .
On March 26, 2014, the Sergiev-Posad city prosecutor's office of the Moscow region reported 12 lawsuits to the Sergiev-Posad city court demanding that providers of the Sergiev-Posad municipal district be prohibited from accessing network libraries www.akt-zakon.ru, militera.lib.ru, www .martial-site.ru and to the forum of Jehovah's Witnesses www.jwforum.name. On March 13, 2014, Alexei Navalny’s blog on Live Journal (navalny.livejournal.com) was added to the unified register of prohibited information. As the prosecutor's office stated, the operation of this Internet page violates the provisions of the court decision on the selection of a preventive measure for a citizen against whom a criminal case has been initiated. Due to the republication of entries on Navalny’s blog, on March 13-14, the website of the radio station “Echo of Moscow” (echo.msk.ru) was also temporarily completely blocked. It is not clear what relation a hypothetical violation of a preventive measure has to the law on extrajudicial blocking of sites, which provides for restriction of access if the published information contains “calls for mass riots, extremist activities, incitement of interethnic and (or) interfaith hatred, participation in terrorist activities.” activities, participation in public mass events held in violation of the established order." On March 13, 2014, Roskomnadzor, at the request of the Prosecutor General's Office, included the sites Grani.ru, Kasparov.ru and Daily Journal (ej.ru) into the unified register of prohibited information and sent a request to providers to immediately restrict access to them. From the point of view of prosecutors, these sites contain calls for illegal activities and participation in mass events held in violation of the established order. The supervisory authorities did not explain exactly what materials they were talking about, and the sites were completely blocked.
During the period from March 7 to March 12, 2014, various Russian providers blocked the YouTube portal for some time. The reason was that the General Prosecutor's Office, in accordance with the new blocking mechanism, ordered to close access to the video of Valeria Novodvorskaya and Konstantin Borovoy with an appeal to the residents of Ukraine. This ban in itself is controversial from a formal point of view, since the video contains inflammatory calls addressed to people inhabiting the territory of another state. On February 18, 2014, it became known that the Leninsky District Court of Rostov-on-Don, following a claim by the prosecutor's office of the Kasharsky district of the Rostov region against OJSC Rostelecom, decided to restrict access to a number of sites containing materials recognized as extremist. The names and exact number of sites are not reported, but it is known that among them there are several online libraries, and among the materials to which access must be prohibited are books by Said Nursi. The court decision has not yet entered into legal force. Let us recall that, from our point of view, the decision to block online libraries was unlawful (only individual pages should have been blocked); It is also unlawful to recognize Nursi’s books as extremist.
On December 5, 2013, the prosecutor's office of the Republic of Bashkortostan reported that the prosecutor's office of the Aurgazinsky district through the court ordered the telecom operator Bashinformsvyaz to block the site containing the text of Yuri Mukhin's book "It's a shame for the state!" On November 13, 2013, the prosecutor's office of the Krasnoyarsk Territory reported that the prosecutor's office of the Evenki Autonomous Okrug had submitted a proposal to eliminate violations of the law to the provider of MP EMR "CITS", which provides Internet communications in the Ilimpiysk region. The reason was that the provider did not block access to the recognized extremist site "Ingushetia" (apparently one of the successors of the site "Ingushetia.ru"). On November 1, 2013, a number of providers, including Rostelecom and Beeline, blocked the website of the social platform “It’s a Small World.” The reason for the blocking was the decision of the Leninsky District Court of Samara, which ordered the blocking of access to the banned book “Removal of Doubts” by Muhammad ibn Suleiman al-Tamimi, excerpts from which were posted on one of the platform’s blogs. However, the court did not notify either the site administration or Roskomnadzor about its decision. When, contrary to a court decision, providers mistakenly blocked not a single blog, but the entire site, the site administration, ready to immediately remove the prohibited content, for a long time could not find out the reason for the blocking. As a result, the quickest way out for site owners was to change the IP, which they did without waiting for the providers to figure out the situation. This incident reflects the imperfection of the system for blocking prohibited content in the Russian segment of the Internet.

On July 15, 2013, the Kirovsky District Court of Samara upheld the claim of the district prosecutor's office and ordered local providers to limit access to the site on which the banned brochure by Ahmad ibn Hadjar Allu Butami "Cleansing the heart and body from the dirt of polytheism and unbelief" is posted. The book is dedicated to explaining the meaning and significance of the ritual side of Islam and, from our point of view, does not contain signs of extremism, therefore we regard the blocking of the site, as well as the banning of the book, as unlawful actions.
On July 11, 2013, it became known about a lawsuit against the providers Maxima+ LLC, Novline LLC, Rostelecom OJSC, Alfakom LLC, filed in the Novgorod District Court by the prosecutor's office of the Novgorod region, which contained a requirement to restrict access to the Witnesses website Jehovah (probably referring to www.jw.org), since it contains texts included in the Federal List of Extremist Materials. The claim was satisfied, access to the site is limited. Let us remind you that we consider it unlawful to ban the literature of Jehovah's Witnesses, as well as to block sites that are not recognized as extremist, just because they contain several extremist materials.
On June 27, 2013, it became known about a statement of claim against the Tula branch of OJSC Rostelecom, with which the prosecutor's office of the Dubensky district of the Tula region appealed to the Odoevsky district court of the Tula region. In the lawsuit, the prosecutor's office demanded that the provider limit access to extremist sites discovered during an inspection of Dubenskaya and Voskresenskaya secondary schools, citing the fact that OJSC Rostelecom, in accordance with an agreement concluded with schools, filters content. The proceedings in the case were terminated due to the voluntary compliance with the demands of the prosecutor's office. The information message does not say anything about the absence of content filters on school computers, from which one can conclude that filters were installed.
On June 24, 2013, it became known that the prosecutor's office of Surgut (KhMAO) filed lawsuits against the Tyumen branch of Vympel-Communications OJSC and the Ural branch of MegaFon OJSC, which demanded to limit access to the websites of the National Bolshevik Party (NBP) and the "Slavic Power" movement, as well as "other extremist organizations." Let us recall that in our opinion, the ban on the NBP as extremist was unlawful. In addition, a ban on an organization under Russian law does not entail an automatic ban on its materials and websites. Websites should be blocked only after a reasoned court decision has been made to ban them.

On June 3, 2013, the prosecutor's office of the Republic of Chuvashia reported that the Novocheboksarsk City Court sentenced the head of a local provider company to a fine of 2,000 rubles under Art. 20.29 of the Code of Administrative Offenses (production and distribution of extremist materials) for failing to restrict user access to materials prohibited for extremism on the Internet. We consider this decision unlawful, since Art. 20.29 of the Code of Administrative Offenses provides for punishment for an intentional offense, and not for an offense committed through negligence.

On April 17, 2013, it became known that the prosecutor's office of the Lagansky district of the Republic of Kalmykia sent a statement of claim to restrict access to extremist materials to the management of the Kalmyk branch of OJSC Rostelecom. On April 10, 2013, the prosecutor's office of the Kirov district of the city of Ufa announced that during an inspection it had discovered a banned book by Yuri Mukhin, “It’s a shame for the state!” on 13 Internet sites. On March 28, 2013, the prosecutor's office of the Sverdlovsk region reported that the Verkh-Isetsky district court of Yekaterinburg satisfied the demands of the prosecutor's office of the Talitsky district and ordered the Ural branch of Rostelecom OJSC to restrict access to the Internet page on which the brochure "The need to comply with the Sunnah of the Messenger of Allah" is posted. Меры реагирования приняты, поскольку у пользователей Республики Алтай имеется доступ к видеохостингу YouTube, на котором размещен трейлер фильм "Невинность мусульман", и потребовала закрыть доступ к фильму. Предостережения объявлены несмотря на то, что иск Генеральной прокуратуры РФ о признании фильма экстремистским материалом поступил в Тверской суд Москвы 17 сентября 2012 года и еще не рассмотрен.
19 сентября 2012 года прокуратура Кабардино-Балкарской Республики сообщила о предостережениях о недопустимости нарушения закона, объявленных основным республиканским провайдерам в связи с имеющимся доступом к фильму "Невинность мусульман". Предостережения объявлены несмотря на то, что иск Генеральной прокуратуры РФ о признании фильма экстремистским материалом поступил в Тверской суд Москвы 17 сентября 2012 года и еще не рассмотрен. " С учетом экстремистского характера " материала и " общественного резонанса, вызванного его размещением в сети Интернет ", прокуратура КБР обязала провайдеров ограничить к нему доступ до рассмотрения судом заявления Генеральной прокуратуры РФ. Поручения о принятии аналогичных мер направлены в территориальные подразделения прокуратуры и в Управление Роскомнадзора.
19 сентября 2012 года стало известно, что прокуратура Омской области объявила предостережения о недопустимости нарушения закона руководителям регионального отделения Сибирского филиала ОАО "МегаФон", филиалов ОАО "Ростелеком", "МТС", "ВымпелКом" и Омского регионального представительства ЗАО "Зап-СибТранстелеком" . Поводом для предостережений стало то, что в пользователи области имели доступ к видеохостингу YouTube, на котором размещен трейлер фильма "Невинность мусульман" (скандального любительского фильма о пророке Мухаммеда, появление которого вызвало протест сразу в нескольких странах мусульманского мира). Предостережения объявлены несмотря на то, что иск Генеральной прокуратуры РФ о признании фильма экстремистским материалом поступил в Тверской суд Москвы 17 сентября 2012 года и еще не рассмотрен. Прокуратура письмом потребовала принять меры по блокировке доступа к фильму, в результате чего "Ростелеком" на семь часов заблокировал доступ ко всему YouTube на территории Омской области.
11 сентября 2012 года стало известно, что Надымский городской суд ЯНАО по иску прокуратуры Надыма обязал окружной филиал ОАО "Ростелеком" ограничить доступ к сайтам narod.ru и zhurnal.lib.ru в связи с тем, что на них обнаружены материалы, включенные в Федеральный список экстремистских материалов. Ограничение доступа по решению суда должно осуществляться путем фильтрации IP-адреса на пограничном маршрутизаторе. В результате городской провайдер "ВКС-Интернет" прекратил доступ ко всем ресурсам доменов lib.ru и narod.ru. Напомним, сетевой журнал "Самиздат" при библиотеке Мошкова уже был запрещен в апреле 2009 года Череповецким городским судом Вологодской области из-за статей одного автора, после чего журнал переехал на новый адрес.
16 августа 2012 года стало известно, что 11 июля 2012 года Ленинский районный суд Ставрополя удовлетворил иск, поданный прокуратурой Ставропольского края к ОАО "Вымпелком" и ОАО "МегаФон" . Прокуратура требовала от провайдеров запретить доступ к ряду сайтов, признанных экстремистскими. Среди сайтов, доступ к которым предписано заблокировать, – популярный татарский портал tatarlar.ru и сайт НБП , запрет которых мы считаем неправомерным.
14 августа 2012 года прокуратура Курска сообщила, что вынесла 13 предостережений о недопустимости нарушения законодательства о противодействии экстремистской деятельности провайдерам, работающим в Курской области. Поводом для предупреждений стало то, что пользователи интернета в области имели доступ к сайту Свидетелей Иеговы. Требование прокуратуры было выполнено, доступ к сайту заблокирован. Напомним, никакие сайты Свидетелей Иеговы в России не запрещены, а признание материалов Свидетелей Иеговы экстремистскими мы считаем неправомерным.
10 августа 2012 года прокуратура Красноярского края сообщила, что Енисейской межрайонной прокуратурой было внесено представление в адрес местного провайдера ООО "ЕнисейСвязьСервис" с требованием блокировать доступ к сайту Свидетелей Иеговы. Требование прокуратуры было выполнено. Напомним, никакие сайты Свидетелей Иеговы в России не запрещены, поводом для блокировки послужило то, что на сайте размещены материалы Свидетелей Иеговы, признанные экстремистскими, однако мы считаем, что последние были запрещены неправомерно.
3 августа 2012 года "Известия" сообщили, что прокурор Железнодорожного района Рязани обратился с иском к сотовому оператору "МегаФон" в Замоскворецкий суд Москвы (по месту регистрации компании). Прокурор требует, чтобы "МегаФон" ограничил доступ пользователей к ряду сайтов, на которых выложена признанная экстремистской книга Владимира Истархова "Удар русских богов". В их числе оказался YouTube, на котором размещена аудиоверсия книги. Сообщается, что работники рязанской прокуратуры добивались блокировки YouTube и от местного филиала компании "Ростелеком", однако безуспешно: "пока тянулись судебные процессы о закрытии доступа к YouTube, администрация этого ресурса по обращению российских компетентных органов снимала противозаконные материалы, и предмет иска исчезал" .
17 июля 2012 года стало известно, что Ярославский областной суд подтвердил решение Кировского районного суда Ярославля, который по ходатайству районной прокуратуры обязал местного провайдера "Нетис Телеком" заблокировать доступ к блог-платформе Livejournal.com. Поводом для блокировки ресурса явилось стремление прокуратуры закрыть доступ к одному из блогов: признанному экстремистским в 2009 году дневнику pat-index.livejournal com. Попытка "Нетис Телеком" оспорить решение районного суда в областном не увенчалась успехом, и 6000 абонентов лишились доступа к ЖЖ. 20 июля 2012 года провайдер открыл доступ пользователям к Livejournal.com и заявил о намерении продолжать требовать отмены судебного решения, приравнивающего провайдера к распространителю информации.
11 июля 2012 года стало известно об иске, поданном в Калужский районный суд прокуратурой Калуги к ОАО "ЦентрТелеком" в связи с тем, что в калужских гимназии № 19, лицеях № 9, 36, школах № 3, 5, 11, 12, 14 и детском доме № 3 оказался возможен доступ к материалам экстремистского характера. В соответствии с договорами между ОАО "ЦентрТелеком" и школами фильтрация контента осуществлялась провайдером централизованно, однако не была " обеспечена полная защита ".
4 июля 2012 года стало известно об иске, поданном прокуратурой Добринского района Липецкой области к местному филиалу ОАО "Ростелеком" об ограничении доступа на территории Липецкой области к сайтам путем применения правил фильтрации на DNS серверах. Названия сайтов не сообщаются. Иск был подан в связи с тем, что в школе поселка Петровский имелся доступ к " сайтам, содержащим экстремистские материалы ". Суд требования прокуратуры удовлетворил. Из сообщения прокуратуры при этом следует, что на школьных компьютерах были установлены контент-фильтры.
2 июля 2012 года прокуратура Новоалександровского района Ставропольского края сообщила, что направила исковое заявление к ОАО "Ростелеком" об ограничении доступа к сайтам, на которых размещены экстремистские материалы. Среди сайтов, доступ к которым требуется заблокировать, - интернет-библиотека http://www.rulit.net.
