YUKOS CASE
The YUKOS case is one of the landmark, milestone events in Russian politics in recent years. It became an external reflection of the attack on the business elite by Yeltsin’s call, a sharp limitation of its political influence and destruction as an independent political force. The YUKOS affair cleared the way for the concentration of the most strategically important and profitable sectors of the Russian economy in the hands of state-owned companies, which are controlled by the current ruling elite. At the same time, the actions of law enforcement and judicial bodies, carried out with the approval of the supreme power, caused almost more damage to Russian democracy than the very fact of the ruling group’s destruction of alternative centers of influence or the nationalization of the economy. The prosecutor's office appeared in this case as a repressive machine, and the courts demonstrated the lack of any independence when considering cases of political significance.
Brief chronology of the "YUKOS case"
The beginning of the “YUKOS case” can be considered February 19, 2003, when at a meeting of the president with representatives of the Russian Union of Industrialists and Entrepreneurs, a public polemic between Vladimir Putin and Mikhail Khodorkovsky took place. According to Novaya Gazeta , Khodorkovsky asked the president a question about a dubious deal , as a result of which the state company Rosneft became the owner of another oil company, Severnaya Neft. Putin reacted unexpectedly harshly: Rosneft, a state-owned company that does not have its own excess reserves, intended to increase them. "YUKOS has excess reserves, but how they appeared is a big question."
On May 23, a provocative report by the National Strategy Council entitled “An oligarchic coup is being prepared in Russia,” presented by SNS General Director Stanislav Belkovsky, was published, and on July 2, the Chairman of the Board of Directors of the Menatep MFO Platon Lebedev was arrested on suspicion of embezzling 20% in 1994. stake in OJSC Apatit, owned by the state, in the amount of $283.142 million.
On July 4, Khodorkovsky was summoned to the Prosecutor General's Office to testify in this case, along with his former deputy Leonid Nevzlin.
On July 9, the Prosecutor General's Office began checking the request of State Duma deputy Mikhail Bugera, who claimed that YUKOS underpaid taxes in 2002.
On July 10, the “Lebedev case” began. From that moment on, the prosecutor conducted numerous searches in NK YUKOS, MFO Menatep and other structures associated with Khodorkovsky, Lebedev and other YUKOS shareholders. Only directly at YUKOS for the period from July 2003 to November 2004. 150 searches were carried out.
On October 25, Khodorkovsky was detained at Tolmachevo airport in Novosibirsk, sent on a special flight to Moscow and placed in the Matrosskaya Tishina pre-trial detention center. On the same day, the Prosecutor General's Office charged him with theft by deception of another's property on a large scale as part of an organized group; malicious failure to comply with a court decision that has entered into legal force; causing property damage by deception; tax evasion on an especially large scale by a group of persons by prior conspiracy; evasion of tax by an individual; falsification of official documents and embezzlement of other people's property.
On December 29, 2003, the Ministry of Taxes and Duties officially presented NK Yukos with a demand to pay taxes in the amount of 100 billion rubles ($3.4 billion).
On June 16, 2004, hearings began in the Meshchansky Court of Moscow in the case of Khodorkovsky and Lebedev. The court announced an indictment against Khodorkovsky, Lebedev and the former head of Volna AOZT Andrei Krainov. Khodorkovsky was charged with 11 counts under 7 articles of the Russian Criminal Code. None of the three admitted their guilt.
On July 26, the Basmanny Court of Moscow issued a warrant for the arrest of the former first deputy chairman of the board of Yukos, Leonid Nevzlin. He was accused of organizing the murder and “attempted murder of competitors and persons disliked by YUKOS.”
In November 2004, the main oil-producing structure of YUKOS, Yuganskneftegaz, was put up for auction to pay off a multibillion-dollar tax debt additionally accrued to the campaign. On December 19, 2004, the Tver-based Baikalfinansgrup LLC (an unknown structure to anyone except, as it later turned out , President Putin) became the winner of the Russian Federal Property Fund auction for the sale of 76.79% of the shares of Yuganskneftegaz OJSC, offering $9.35 billion for them.
On January 14, 2005, it became known that another criminal case had been initiated against Khodorovsky and Lebedev - for money laundering.
On March 30, the court sentenced Yukos security officer Alexei Pichugin to twenty years in prison in a maximum security colony. Alexey Peshkun, who is involved in the same case as an accomplice, received four years.
On May 16, the announcement of the verdict against Khodorkovsky and Lebedev began, which lasted until May 31. All this time, pickets in support of Khodorkovsky and against him ( organized , it is believed, by the authorities ) took place near the building of the Meshchansky Court. On May 31, 2005, Khodorkovsky and Lebedev were each sentenced to 9 years in prison in a general regime colony. On September 22, after considering cassation appeals , the sentence came into force, while the Moscow City Court reduced their sentence by one year - to eight years.
On August 23, 2005, it became known about the formation of an initiative group to nominate Mikhail Khodorkovsky as a candidate for deputy of the Russian State Duma in the 201st University District of Moscow. Khodorkovsky's attempt to register as a candidate did not materialize : Khodorkovsky's official application for self-nomination, certified by the head of the Matrosskaya Silence pretrial detention center, eight days in advance - from September 15 to 22 - never reached the election commission. At the same time, the Prosecutor General's Office accused almost all of Khodorkovsky's lawyers of obstruction of justice and initiated an audit of their activities. At the same time, the judges who participated in the YUKOS case were awarded orders and medals.
In October, Platon Lebedev was sent to general security colony No. 98/3, located above the Arctic Circle, in the village of Kharp, Yamalo-Nenets Autonomous Okrug, and Mikhail Khodorkovsky was sent to general security colony YAG-14/10 near the city of Krasnokamensk, Chita region.

Yulia Latynina, “Echo of Moscow”, “Novaya Gazeta”, “Daily Journal”: This is not even a political process, it is some kind of social process of redistributing the property of the president’s enemies in favor of the president’s friends. Moreover, both the economic component is important in it (the president’s friends are ready to declare a person an enemy of Russia, if only this will allow them to get hold of his property), and the political component: it is very important for those around President Putin to explain to President Putin that there are all enemies around him who must be destroyed, and they are the only friends he can rely on. That is, this is a process that not only gave the president’s entourage property and the status of new oligarchs, but also radically narrowed the president’s social base.
Lev Levinson, Institute of Human Rights, Institute for Public Expertise: This was truly a landmark story. I would be calm about Khodorkovsky's sentence if he were found guilty of tax evasion. But if the authorities took responsibility and defended the public interest, then there was no need to destroy the company and there was no need to imprison or deprive Khodorkovsky of his freedom - guilt, if any, would have been enough to resolve with penalties. And the fact that this was an indicative destruction of a strong political and economic entity, in a sense a competitor, showed: the government identifies itself with all-Russian property and wants the entire bundle of property rights to be concentrated in its hands.
But I don't think it's forever; this is certainly not forever.
Joseph Dzyaloshinsky, Independent Institute of Communication Studies: It is very interesting, it seems to me, that the process of nationalization of the court has emerged, when the executive power clearly shows that the court is also not an independent institution, but a state one, and the court must protect state interests. On the one hand, this is a demonstrative case of YUKOS. On the other hand, there were many small court cases, which also indicate that the court, when choosing the measure of punishment, the form of punishment and in general, determining whether to punish or not, did not proceed from the presumption of innocence, not from the adversarial nature of the trial - the case was decided in favor of prosecutor, if it was against the state. The idea of the “Basmanny court” has become a household name.
Alexander Ryklin, Daily Journal: This whole trial undoubtedly had a huge impact on all institutions in Russia, including democratic ones. Legislation, further tightening of legislation, regulation of public organizations and everything else is of such a draconian nature.
Valentin Gefter, Institute of Human Rights: The trial of Khodorkovsky, among other things, marked a reverse movement in the sense of reform of judicial and law enforcement agencies. These are specific trials - YUKOS, NBP, cases against many Muslims - both Hizb-ut-Tahrirov and others on charges of Wahhabism, radicalism, extremism, etc. This is a continuation of the “spy” cases and the confirmation of Danilov’s sentence by the Supreme Court. These are the decisions that were made in cases such as the Ullman case. And the final one is, of course, the decision of the Constitutional Court on the gubernatorial elections, which was determined by political expediency.
At the same time, it was clear that law enforcement agencies, the police and partly the FSB, especially at the local level - these are the cases of Blagoveshchensk, Nalchik, cases related to Chechnya and Borozdinovskaya and many others - are no longer regulated and are making more and more extra-legal and counter-legal efforts. These two factors - the increasing autonomy and unconstitutionality of many actions of law enforcement agencies, plus judicial patronage of them (and the fact that the judicial system is not truly independent was evident in various cases) - indicate that a certain turning point has been passed and that now changes in these two most powerful systems are no longer moving in the wrong direction.
BILL ON NON-GOVERNMENTAL ORGANIZATIONS
Signed by the President on January 10, 2006, the law significantly limits, mainly through various bureaucratic conditions and procedures, the exercise of the right to association and, on the contrary, expands the control powers of government bodies in relation to non-governmental organizations. In particular, control over those NGOs that receive funding from foreign funds is being strengthened. In this way, the authorities create leverage over NGOs, the last sphere of public activity that has retained relative independence from the state.
In November 2005, it became known that the government was coordinating a bill that would significantly tighten control over the activities of Russian non-governmental organizations (NGOs). Already on November 24, it was adopted in the first reading.
Deputies refused to discuss the bill with representatives of interested public organizations ; even the Commissioner for Human Rights in the Russian Federation, Vladimir Lukin, who wrote a letter to State Duma Chairman Boris Gryzlov with a proposal to postpone consideration of the bill in order to join in its discussion, was not invited to participate in the discussion of the bill. a circle of public organizations, as well as the Public Chamber, which, in fact, was created, among other things, for the examination of bills.
The bill caused active protest both in Russia and abroad . Within a few days, more than 5,000 people signed the statement of Russian NGOs “No to tightening control over civil society.” A number of independent examinations of the bill appeared, all of them were sharply critical.
Ella Pamfilova, Chairman of the Russian Presidential Council for Promoting the Development of Civil Society Institutions and Human Rights, met with President Putin on this issue . The draft law was personally opposed by the Commissioner for Human Rights in the Russian Federation, Vladimir Lukin , and a member of the Public Chamber and the Presidential Council for the Development of Civil Society Institutions and Human Rights, Dr. Leonid Roshal .
Concern over the adoption of the bill was expressed by Amnesty International , the MacArthur Foundation , members of the Bundestag , the US Government Commission on Security and Cooperation in Europe, and the US Deputy Secretary of State. The first appeal to the State Duma was signed on November 15 by 21 members of the OP from the then 42, and on December 3 by the OP consisting of 84 people unanimously adopted a new appeal to the State Duma with a demand to postpone the adoption of the bill until the completion of the formation of the Public Chamber, which intends to conduct its examination.
From the very beginning, it was assumed that tightening the legislation on NGOs was a preventive measure by the authorities to prevent an “Orange Revolution” in Russia. First Deputy Minister of Internal Affairs Alexander Chekalin, Deputy Director of the FSB Viktor Komogorov and Head of the Security Council Igor Ivanov spoke about their vision of the tasks that the law on NGOs should solve at a conference at MGIMO on December 1. “In half the cases, Russian NGOs arose not on the initiative of our citizens, but at the will of our foreign partners, most importantly, for their money,” Komogorov said. According to him, some NGOs "are a means of monitoring the situation in the country and influencing public opinion." “The nature of the activities of many NGOs in Russia causes at least misunderstanding,” he said and noted among these organizations the representative office of the Agency for International Development, for some reason classifying it as an NGO: “The American NGO, the representative office of the Agency for International Development, has begun to implement programs aimed “no more and no less for the transformation of the Russian state system and the establishment of control over the Russian information space.” He also emphasized that public organizations operating in Russia interact with foreign structures, receive financial assistance from them and are “conductors of their political interests.” The FSB representative is convinced that the bill, adopted in the first reading by the State Duma, will have to normalize the situation in the system of NGOs operating in Russia. He, according to Komogorov, “is directed in the right direction,” wrote Nezavisimaya Gazeta. And the director of the Foreign Intelligence Service, Sergei Lebedev, in an interview with Rossiyskaya Gazeta, stated that “humanitarian missions and non-governmental organizations are very attractive to all intelligence services in the world. An intelligence officer needs cover, a mask, a screen.”
On December 3, Vladimir Putin himself, at a meeting with permanent members of the Security Council, once again repeated that the situation in which some organizations are funded from abroad and actually engage in political activities is unacceptable, but expressed the hope that the law will not harm the interaction of non-governmental Russian organizations with their colleagues abroad.
On December 9, the Presidential Opinion on the bill was published with proposals for its mitigation.
On December 21, the State Duma adopted the bill in the second reading, and on December 23 - in the third , final reading.
The majority of independent experts still consider the bill to be contrary to international norms and the Constitution.
On December 27, the Federation Council approved the law on NGOs with one vote against and one abstention.
On January 10, President Putin signed the law on NPOs.

Joseph Dzyaloshinsky, an independent institution of communicativeness: the law on non -profit organizations showed that the state itself will determine that there is a "third sector", how it should be built, which organizations have the right to exist, etc. This is a clear trend in the state of the "third sector". And in the regions there were many small events that also indicate that now the governors determine which organizations are good, which are bad. All these small public chambers and tents under the governors have now become quite state structures, the governors themselves perform in them and invite the leaders of non -profit structures.
Well, and the whole whistle about the Public Chamber of Russia also showed that the authorities pays a lot of attention to ensuring that the “third sector” was with her.
Valentin Hefter, Institute of Human Rights: this is a trend in the state regulation of society, which includes the regulation of the media, NGOs, intervention and manipulation of party life. It is still far from talking about the totalitarian, police influence of the state on society, but it is obvious that the level of control is increasing.
Lev Levinson, Institute of Human Rights, Institute of Public Expertise: the danger of the Law on NGOs, which involves control, intervention, cut off the objectionable ones is obvious. I thought that it could be called positive, and one plus still remembered: this is the adoption of favorable tax amendments regarding grants. This is still not our town business, we are talking about social grants, for health care, to science and culture, to protect human rights. All those threats that were associated with the conditions for receiving grants, which we spoke out against, disappeared as a result of the final version of the law, and, in general, turned out to be positive changes in which the taxation of the whole large block of grants has arrived. And the now adopted law on NGOs does not cancel this, and this plus remains a plus.
Lyudmila Alekseeva, Moscow Helsinki Group: people close to the presidential administration explained to me as follows: the president would give in requests not to sign this law if the US Congress did not express his sharp position on this subject. And it turns out that it is inferior to the US Congress. That is, people determine their policy not by the interests of the country, but by considerations, so that, God forbid, they would not think that they are afraid of someone or are inferior to someone. They need to play with stillets and be decisive and unshakable. This is a strategy. Although we are wrong, even though it is to the detriment of society, to the detriment of the state - but since we decided, we are not inferior, otherwise they will think that we are weak. The desire to look, inflate cheeks - for them this is the main thing, and not the success of politics.
The decision of the Constitutional Court on the appointment of the heads of regions. Consolidation of a new political order
From 2000 to 2005 President Putin actually carried out political reform, thanks to which the president and his administration got the opportunity to actually appoint regional leaders, to influence the creation and functioning of political parties, as well as the formation of representative bodies. The latest innovations were proposed by the president after the tragic events in Beslan.
On September 13, 2004, at a government meeting dedicated to the consequences of tragic events in Beslan, Vladimir Putin said that in order to increase the effectiveness of the fight against terrorism, it is necessary to cancel the popular election of the heads of regions. They must be elected local legislative meetings on the proposal of the president. The corresponding bill was adopted by the State Duma and on December 12 of the same year Putin signed a law on a new order of election of governors. According to him, the procedure for submitting candidates by the President of Legislative Assembly was introduced; In the event of a two -time deviation of the presidential candidate, the regional parliament may be dissolved; The president received the right to remove the heads of regions in connection with the loss of the presidential confidence in them.
Critics of the law claimed that it was not aimed at combating terrorism, but at depriving the governors of independence. Their opponents indicated that the new order would block the path into the power of crime and simply ineffective leaders. But the first, whose powers were confirmed by the president, was the governor of Primorye Sergey Darkin, whom a number of media accused of ties with criminal circles. Also confirmed by the confidence of the president and another governor - Kirsan Ilyumzhinov, who also has the glory of the odious politician .
The fear of local legislators before a possible dissolution is illustrated by the fact that since the law comes into force, there has not been a single case that the regional parliament reject the candidacy proposed by the president.
Opponents of the law from the very beginning pointed out its anti -constitutionality, referring, in particular, to the precedent decision of the Constitutional Court, which on January 18, 1996 recognized the institution of the Charter of the Altai Territory, which provides for the election of the head of the region by the Legislative Assembly. In July 2005, the Constitutional Court confirmed that the current procedure for the appointment of governors complies with the Basic Law. The judges of the Constitutional Court were not unanimous during the consideration - two judges, Anatoly Kononov and Vladimir Yaroslavtsev, had a special opinion.
On November 11, 2005, the State Duma adopted in the first reading the amendments to the current legislation introduced by the President of Russia, giving the right to the political party, which won the regional parliamentary elections, to offer the head of state a candidacy for the post of senior official of a particular subject of the Russian Federation. The new procedure for nominating a candidate for governors looks like some mitigation of the appointment scheme of governors, in which the president makes a decision on the candidate. But in view of the fact that the United Russia has a majority in regional parliaments, in the future, the new law opens the way to establish the total dominance of this party.

Alexander Auzan, Institute of the National Public Treaty project: of course, in the political system, the trends related to the consolidation of the constitutional court of the new political order are negative, because the court changed itself. The Constitutional Court practically revised previously adopted decisions - this is the basis for the special opinion of the two judges of the Constitutional Court.
Alexander Ryklin, "Daily Journal": if we are talking about the judicial system, then for me the two events of this year, obviously, fall out of the overall picture, is also quite negative: this, of course, is the trial of Khodorkovsky and this is the decision of the constitutional court on the legality of the appointment Governors. This unprecedented decision indicates that there is no more constitutional court in Russia. Because the court, which, in fact, claims that sometimes we interpret the Constitution like this, and sometimes we interpret the Constitution of Syak is not a constitutional court.
Julia Latynina, "Echo of Moscow", "New Gazeta", "Daily Journal": it was important not only to do it, but also how it was done. That is, the authorities on the blue eye said that the constitution was not violated. This shows how they will try to act in the future. I admit that in 2008 there will be no operation "successor", but at the same time they will say that the constitution is not violated. How this will be done is another question, but Putin would like it like that - it is felt.
Lev Levinson, Institute of Human Rights, Institute "Public Expertise": the decision on the appointment of governors does not even indicate that the constitution is violated where it is obvious to everyone. For me, the problem is more that the Constitutional Court showed that it has ceased to be a guarantor of constitutional rights today.
We initially had problems with the Constitutional Court, and by the end of the 1990s they became more and more obvious. At the end of 2000, there was a well -known decision on the legality of the third and fourth terms of governors. It seems to me that since then the balance of power in the Constitutional Court has outweighed towards the consistent majority. Still, even after the restoration of the Constitutional Court in 1995, and the newly appointed and the old judges were not all perfect, but still they were cleaner, more prophal, more consistent. With the exception, unless, Zorkin, who turned out to be quite flexible and supple - he learned the 1993 school, made the conclusions correctly. The judges were dying, after the sixty-five years, the first-generation judges left, like Tamara Georgievna Morshchakova and Nikolai Trofimovich Vedernikov, and “St. Petersburg” or some completely incomprehensible people, taken out of the backwills, about which no one could say anything, and came to their place. which fall, apparently, in great dependence. How much this composition of the court has buried over the past few years of very important, problematic cases of compliance with the Constitution, without seeing the grounds for interference at all! Compared to the mid -nineties, now the Constitutional Court is generally seeking to evade cases on the merits, turning around in every way. Or even, considering essentially, recognizes the constitutional frankly unconstitutional things.
The current Constitutional Court has become a kind of decorative decoration of "controlled democracy." Of course, there are separate satisfactory solutions. But the fraction of the conjuncturals is so great that somewhere they can afford them - according to the criminal process, according to enforcement proceedings.
The state -owned economy. Gas war with Ukraine
The first large -scale act of nationalization was committed on December 19, 2004, when 77.79% of the statutory capital of the main extracting asset of the Yuganskneftegaz OJSC Yuganskneftegaz were sold from the auction of Baikal Finance Group LLC for $ 9.36 billion, and a few days later Baikal Finance groups "Together with" Yuganskneftegaz "were bought by the State" Rosneft ".
On September 28, 2005, the largest purchase in the history of the country was: Gazprom OJSC and the management company Roman Abramovich Millhouse Capital signed the binding documents for the acquisition of 72.663% of the shares of Sibneft OJSC for $ 13.1 billion.
Also, by the beginning of the fall of 2005, the state increased its share of shares in the main energy campaign of the country - Gazprom to the control .
Concentrating in the hands of the state more and more fuel and energy resources, Russia at the same time more actively uses economic pressure as a foreign policy factor. Inside the country, control over the most profitable sector of the economy becomes the economic base of the existing regime. Outside - an instrument of pressure on "unfriendly regimes" in the countries of the near abroad.
The most high -profile example was the Gas War with Ukraine, which caused sharply negative comments on the actions of Russia by the United States and the European Union and seriously overshadowed the beginning of the Russian chairmanship in the Great Eight.
The conflict unexpectedly ended with a very opaque transaction , according to which Russia sells gas at $ 230 paradoxically, and Ukraine buys 95 each.
Foreign commentators almost unanimously regarded Russia's behavior as an international blackmail with a political background and expressed doubt about the reliability of Russia as a partner.

Joseph Dzyaloshinsky, an independent institution of communicativeness: I begin from the fact that, apparently, the main tendency of the past year was the metastasis of the state into all pores of society, that is, the state tumor struck more and more areas of the social organism. Events that confirm this trend: firstly, the more deep fit of the state in the affairs of the economy. On the one hand, the case of Yukos as a demonstration case, which shows the economic establishment that it is impossible to solve anything without us and you will resist - it will be bad, and on the other hand, the participation of the state is completely distinct, in large economic processes - tenders and so on. Putin’s personal participation in the so -called gas conflict is whether to consider it as political or as an economic one. In any case, the fusion of political processes with economic processes in this "gas conflict" was simply evident. That is, the first most distinct trend of the past year is to penetrate the state interests of the entire economic sphere.
Valentin Gifter, Institute of Human Rights: There is a final choice of a corporate economy that coincides with the corporate state structure. The hardware and bureaucratic interests of individual departments begin to prevail over legal state interests. This is a combination of corporate state structure with corporate terms in the economy - I mean that the state becomes the largest corporation in the economy. It should be understood that it becomes a corporation not in the sense of property, but in the sense of control over economic actions.
Well, as for the outside, this, of course, is a guideline to ensure that, at least in the former Soviet space, from "SSENRITY" to move on to economic and other levers of pressure on neighboring countries. At the same time, hiding behind quite selfish Russian economic and political interests. After all, there are democratic empires, the United States is trying to play such a role when the decision-making center imposes some of its value items to the surrounding states. But we have a union on the basis of the economic, pragmatic and other egoism of the center, which is in no way connected with value things. In all directions, deviations from liberal-democratic principles are observed. It is interesting that this is combined with many completely liberal measures in macroeconomics: one does not interfere with the other, as it turned out. На волне протестов резко повысилась политическая активность партий, возникли новые организации, были заключены прежде невозможные договоренности о совместных действиях между демократическими партиями и организациями левого толка. И хотя волна митинговой активности в конце концов спала, политические организации получили ценный опыт и практические навыки уличных действий, которые использовались на протяжении всего года.

Наверное, говоря о монетизации, надо в совокупности говорить и о последствиях вступления в силу Жилищного Кодекса - это тоже очень серьезный удар. Там две большие проблемы. Первая - это то, что социальное жилье становится практически недоступным, и эта тема чуть ли не закрывается для большинства регионов. Обеспечение нуждающихся жильем спихивается на уровень местного самоуправления. Никакие гарантии по площади предоставляемого жилья на федеральном уровне не устанавливаются, в зависимости от исторических условий: кто в юрте привык жить, тот, значит, будет жить и в юрте. Ну, и плюс расширение возможности выселения, в том числе и за неуплату коммунальных платежей, расширение прав домовладельцев и муниципальных властей по неприватизированному жилью - вплоть до того, что они могут запретить вселение детей и родителей.
Эта антисоциальная направленность - первая сторона медали. Вторая - то, что модель управления жильем, которая там прописывается, в силу закрытости процедур, в силу безграмотности большинства населения в этой области, в 90 процентах случаев будет работать на монополию существующих ДЕЗов, которая уже проводит на наших глазах к росту стоимости жилья. Рост стоимости жилья - это следствие монополии ДЕЗов, монополия ДЕЗов - это следствие Жилищного Кодекса.
Александр Аузан, Институт национального проекта "Общественный договор": Я бы сказал, что год начался гораздо интереснее, чем закончился. Мне кажутся очень значимыми социальные протесты начала года, потому что они показали некий предел.
Мы говорим о периоде реакции, и этот период начался не в 2005-м, а в 2003 году, на мой взгляд. Поскольку реакция делает определенную работу, которая потом исчерпывается и начинается тот или иной вариант выхода из реакции, то самый интересный вопрос - это где эта точка перелома и в какую сторону пойдет выход. Но тут понятно: не закон отметили, а просто заткнули рот деньгами - пусть недостаточными и очень плохо оформили это организационно. Это показало, кстати сказать, что при нынешних условиях власть для замирения с обществом готова тратиться, но не готова менять стратегию по отношению к обществу: договариваться, а не подавлять его и запугивать.
Хочу еще сказать об очень важной тенденции последнего года: если раньше у нас гражданское общество формировалось за счет того, что возникали новые группы активных граждан, чаще всего работающих профессионально, то с конца 2004 года стали впервые формироваться движения граждан по интересам. Я это вижу, для меня это заметно. Последние 15 лет нашего относительного хаоса - демократией это назвать нельзя - эти 15 лет не прошли даром.
Впервые я это заметила на поведении людей в Благовещенске и в Бежецке, когда не просто мы приезжали и нам говорили: "пожалуйста, защитите нас" - а сами люди начинали что-то делать. Появилось движение, которое, может быть, неудачно назвали - "Избитая Россия" - но оно есть. "Автомобильная Россия" таким же образом появилась. И еще одно очень интересное движение - движение жильцов бывших общежитий. Они говорят, что их миллион. Я не знаю, миллион их или нет, но что десятки, может быть, сотни тысяч - это точно.
У меня уже не вмещаются в одну папку дела, которые присылают из разных городов. Причем это не дела людей, которых преследуют, а дела людей, которые борются с этими преследованиями. Они отстаивают свои интересы. Они в прошлом году в Перми провели съезд жильцов бывших общежитий. По их инициативе будут слушания у Уполномоченного по правам человека. Это возникло абсолютно снизу, по разным городам, они все объединяются друг с другом, обмениваются опытом и, в общем, уже есть маленькие победы. Может быть, я этому немного способствовала, а может - случайно совпало: 20 июля, когда была встреча с президентом, я подала ему бумаги этих общежитий. А где-то в конце августа произошел перелом: суды, которые им прежде по всем пунктам отказывали, стали признавать их право на площадь. У нас же все как делается: кто-то позвонил в наш независимый суд...
Появились новые движения на муниципальном уровне. Выборы в муниципальные законодательные собрания прошли очень интересно. Например, в Московской области получилось такое, чего, по-моему, с начала 90-х годов не было: в разных местах прошли кандидаты - 150 человек - не те, кого поддерживала власть, а те, кого хотело население. Они прошли без денег, у них вообще не было ничего. Их давило и государство, и административный ресурс, и деньги были на той стороне, а люди проголосовали настолько единодушно, что пришлось признать их победу. Это не только в Московской области, но, например, в Волгодонске. И мне кажется, очень важно поддержать эти очажки муниципальные, где они появились, чтобы их не задавили, потому что, конечно, будут давить.
Ведь демократия должна расти, а она у нас все время сверху спускалась - и Горбачев ее спускал, и Ельцин ее спускал. А вот Путин перестал спускать - и где она? А то, о чем я говорю, - это происходит снизу. Растение должно от корней расти, а не от макушки.
Это не значит, что у Путина ничего не получится до 2008 года и после 2008 года, очень даже может получиться. Но это показывает, что уже зреет та сила, которая это переломит. Это уже будет настоящее, не дарованное. Другое дело, что я до этого не доживу, но другие доживут...
ЭХО "ЦВЕТНЫХ РЕВОЛЮЦИЙ"
Бурные политические события в Грузии (ноябрь 2003), Украине (декабрь 2004) и Киргизии (март 2005), где произошла смена власти, сопровождавшаяся массовыми уличными выступлениями под демократическими лозунгами, главным из которых было требование четных выборов, оказали огромное влияние на внутриполитическую ситуацию в Russia. "Цветные революции" были восприняты российскими властями как реальная опасность. Страх массовых антиправительственых выступлений превратился в настоящую фобию , а противодействие "цветным революциям" стало одним из базовых постулатов официальной идеологии. Все это вместе, по всей видимости, ускорило развитие авторитарных тенденций и расширило сферу притязаний власти в стремлении контролировать общество.
Эксперты "Барометра" отмечали создание управляемых из Кремля молодежных движений ("Наши"), усиление контроля над партиями, жесткое преследование радикальных молодежных организаций, контроль за выборами, ужесточение избирательного законодательства, контроль над НПО, установление полного контроля на электронными СМИ, ужесточение правил проведения массовых акций, усиление "патриотического воспитания".

Иосиф Дзялошинский, Независимый институт коммуникативистики: Что касается реагирования на украинские события, "оранжевую революцию" и прочее - это совершенно отчетливая демонстрация, связанная с однозначным отношением к украинским процессам как к прорусским или антирусским. Других оценок, в общем, и не было. "Оранжевая революция" рассматривалась чуть ли не как внутреннее дело России. Анализ многих публикаций показал, что больше всего российские власти возмущало то, что она пошла не по пути "правильного" политического процесса, но что случилось вмешательство народа, майдан и т.д.
Я бы назвал эти истерики в России по поводу Украины, начиная "оранжевой революцией" и кончая газовым конфликтом, "украинским синдромом". Такое ощущение, что именно на материале Украины оттачивается фразеология и некие идеологические клише, связанные с тем, что происходит в самой России.
Юлия Латынина, "Эхо Москвы", "Новая газета", "Ежедневный Журнал": Весь год мы наблюдали последствия "оранжевой революции" для самочувствия Кремля. В конце года это отношение вылилось еще и в газовый скандал.
Позиция Кремля состоит из двух составляющих. Первое, и, видимо, глубоко личное: судя по всему, президент Ющенко нанес глубокое личное оскорбление кому-то в Кремле - не отравившись, да еще и выиграв революцию. Мало того, получив все те предвыборные подарки, которые должны были достаться Януковичу, включая субсидии на газ, вынутые, можно сказать, из личного кармана. Это все равно, что увести девушку, да еще и поселиться в подаренной ей квартире. Иначе мы не старались бы так нагадить Ющенко даже газовым скандалом.
И второе: судя по всему, "оранжевая революция" произвела глубочайшее впечатление на Кремль, и боязнь "оранжевой революции", "устроенной руками ЦРУ" стала там абсолютно хронической фобией. Причем частично эта фобия совершенно искренняя, потому что она покоится на глубоких убеждениях маленького подполковника КГБ, сидящего в германском городке, о картине мира. Эта картина мира впитана, можно сказать, с материнским молоком на лекциях: о том, что проклятые США угрожают великому и могучему Советскому Союзу.
А частично эта фобия подогревается как окружением президента, так и просто пиарщиками типа Суркова, которые прекрасно понимают, что на этой фобии можно заработать кучу бабок.

Явное и все набирающее темп наступление на гражданское общество идет, в частности, по линии возрастания давления на независимые общественные организации: это и закон о некоммерческих организациях, и история с Общественной палатой.
То же самое демонстрируют последние региональные выборы: в Мосгордуму и в парламента Чечни. С моей точки зрения то, что МХГ делала в течение 8 лет, - мониторинг выборов - делать больше не стоит. Потому что выборы перестали быть выборами.
КРЕМЛЬ И ПОЛИТИЧЕСКИЕ ПАРТИИ: МАНИПУЛИРОВАНИЕ КРИЗИСАМИ
Официальная трактовка политической реформы, проводимой президентом Путиным, включает в себя постулат об усилении роли партий (см., например, послание президента Федеральному собранию в 2005 г.), как одной из целей преобразований. В реальной жизни для целого ряда партий прошедший год стал кризисным.
В феврале 2005 г. после успешного участия "Родины" в региональных выборах и голодовки в знак протеста против монетизации льгот Дмитрий Рогозин заявил о переходе в оппозицию. "Мы больше не будем спецназом президента", - заявил он . Летом 2005 г. фракция "Родина" в Государственной Думе распалась на две части после того, как из нее был исключен Сергей Бубурин, обвиненный в попытке организовать раскол. Государственная Дума внесла изменения в регламент для того, чтобы зарегистрировать в качестве фракции группу Бабурина. "Этот бардак устроила "Единая Россия", - прокомментировал это событие Рогозин. Осенью "Родина" была снята с выборов в Мосгордуму.
В Российской партии пенсионеров (РПП) произошла смена лидера. После того, как череды успешных выступлений на региональных выборах, Валерий Гартунг был смещен с поста председателя партии по иску его предшественника Сегея Атрошенко. Однако новым руководителем РПП стал отнюдь не Атрошенко, а Игорь Зотов - вицегубернатор Тульской области. По сообщениям СМИ его избранию предшествовала встреча с замглавой администрации президента Владиславом Сурковым. Гартунг обвинил Кремль в организации своего смещения с поста лидера партии.
Наконец, скандалом закончился в декабре съезд Демократической партии России, на котором лидером партии должен был стать экс-премьер Михаил Касьянов. Представители ряда региональных отделений партии во главе с председателем ЦК ДПР Андреем Богдановым, в последний момент отказалась от ранее достигнутых договоренностей. Касьянова не пустили на съезд партии, а лидером был избран Богданов. По сообщениям СМИ , к организации интриги против Касьянова были причастны депутаты Госдумы от "Единой России" Франц Клинцевич и Александр Хинштейн.
В результате отчетливо видна следующая тенденция: партии, успешно набирающие популярность или партии, которые могут резко увеличить свои ресурсы (финансовые или кадровые), одна за другой переживают кризисы. Причем каждый раз СМИ и участники конфликтов заявляют о причастности к событиям сотрудников администрации президента или представителей "Единой России". Ситуация, сложившаяся вокруг развития политических партий укладывается в общую логику действий Кремля, стремящегося оградить свою политическую монополию от реальных или потенциальных угроз из какой бы то ни было части политического спектра они не исходили.

Владимир Прибыловский, ИИЦ "Панорама": История с Демократической партией России во многом просто комичная. Власть так испугалась Касьянова, у которого рейтинг - полпроцента, что затеяла интригу. Но и Касьянов вел себя просто смешно. Я не считаю, что события вокруг Демократической партии России и вокруг Партии пенсионеров важны сами по себе, но они показывают, как власть пугается любой тени и применяет неадекватные меры.
А вообще положение партий - оно и так плохое, и в этом смысле самый негативный момент - это снятие "Родины" с московских выборов. Это беспрецедентная вещь. У нас все время ЦИК кого-нибудь снимает, но снятие с выборов одного из заведомых победителей, партии, которая претендует на второе место в политической системе, в популярности - это, наверное, самое важное негативное событие в сфере партийной системы. Хотя было заметно и снятие Партии пенсионеров во многих регионах, где у нее было много сторонников. Это распространение башкирской технологии: как только кто-то вырос, тут же его с выборов и снимают.
В Чечне вовсе не было выборов , и в этом смысле участие в них "Яблока" и СПС - это просто позорное явление. В Москве были хоть какие-то выборы пусть несправедливые и нечестные, с фальсификациями, с нажимом, но там хоть что-то от чего-то зависело. А в Чечне были назначения, причем в условиях военной диктатуры. Причем там же войск стоит столько же, сколько населения, все солдаты голосовали. Другое дело, что в Чечне, я думаю, никто ничего и не считал - написали, как заранее решили, и все.
Но все-таки, пока крупные партии, как "Яблоко" и коммунисты, не запрещены, говорить о каком-то принципиальном ухудшении положения партий рановато. Вот если кого-то из них не зарегистрируют - придерутся к численности или к чему-то еще, - это будет означать катастрофическое ухудшение состояния партий.

Это выражалось в давлении на любые политические проявления, во вмешательстве исполнительной власти в партийное строительство: например, в истории с "Родиной". Похоже, что суд над НБП - сфабрикованное провокативное дело для демонстрации того, что мы будем бороться с "фашистскими тенденциями". Вообще, фашизм, фашистские взгляды стали каким-то таким экраном, на котором власть демонстрирует свою заботу о народе. Я никак не могу для себя решить, является ли это своеобразной игрой, когда одна рука двигает фигуру, а другая гневно клеймит эту фигуру. Потому что по отношению к фашизму власть каждый раз выступает и говорит: "Видите, какая это большая угроза!" И НБП тоже, мне кажется, была использована как демонстрационный прием, как будут страшно наказывать тех, кто позиционирует себя как фашистская партия. Я думаю, что НБП трудно связать с фашизмом, хотя, конечно, на уровне высказываний все это у них есть.

И пятипроцентное бракование подписей, и то, что действующие парламентские партии подписей при этом не собирают, и сумму залога увеличили чуть ли не вдвое, который не возвращается практически никому (нужно 4 процента получить, чтобы возвращался), - этот весь комплекс мер означает создание идеальных условий для консервации власти сегодняшними лицами.
СОБЫТИЯ НА СЕВЕРНОМ КАВКАЗЕ
2005 г. продемонстрировал, что не только Чечня, но и весь Северный Кавказ является крайне нестабильным регионом, где кризисные явления могут в любой момент проявиться массовыми волнениями или вооруженными выступлениями. Обстоятельства расследования бесланской трагедии и суд над единственным выжившим террористом Нурпашой Кулаевым, криминальный скандал в Карачаево-Черкессии, вылившийся фактически в политический кризис, боевые действия в столице Кабардино-Балкарии, операции против боевиков в Дагестане, Ингушетии и той же Кабардино-Балкарии - все это лишь самые яркие проявления кризиса, охватившего регион. Соседство с Чечней серьезно усугубляет ситуацию, но является причиной нарастания напряженности. Так в боях в Нальчике участвовали чеченские боевики, но это вооруженное выступление стало возможным в первую очередь вследствие жестокости и произвола местных правоохранительных органов, создавших питательную среду для возникновения вооруженного подполья.
Высокопоставленные представители российской власти почти официально признали не только серьезность проблемы, но и отсутствие стратегии выхода из кризиса и эффективных рычагов влияния на ситуацию в регионе.

Лев Левинсон, Институт прав человека, Институт общественных экспертиз: Я бы не разделял происходившее в Нальчике , Беслане и Чечне . 2005 год дает все основания говорить о Северном Кавказе в целом. Чечня - это просто один из регионов, где идет, с той или иной степенью интенсивности, гражданская война (или война с собственным народом, или спецоперация против гражданского населения - по-разному это можно называть). Но здесь уже не какие-то очаги: мы видим и Дагестан, и через неделю - Кабардино-Балкарию, и Чечню, и Игушетию, и Карачаево-Черкесию: постоянно или дома там горят, или кого-то танками обстреливают, или трех террористов ловят целыми полками... В принципе, подожжен весь Северный Кавказ. Это, конечно, тоже не в 2005 году началось, но сейчас уже охватило практически всю территорию. Целый регион в состоянии обостряющегося конфликта, и все, что делается, делается не для того, чтобы это как-то начать врачевать.
Юлия Латынина, "Эхо Москвы", "Новая газета", "Ежедневный Журнал": По всей России происходит трудноописуемый процесс: процесс полного отвязывания силовых органов. Милиция, силовики в России превратились в особую нацию, которая обращается с остальными гражданами приблизительно так, как норманны обращались с англосаксами, или белые поселенцы с американскими индейцами, или англичане с покоренными индусами. Это скорее можно описывать в терминах национальных. Это получается, что разные народы с разными обычаями говорят на разных языках.
Но если во всей остальной России это происходит достаточно мирно, то есть не вызывает реакции (в Благовещенске менты избивают несколько сотен жителей, и жители даже боятся жаловаться), то на Кавказе есть ответ, что надо делать с ментами, которые тебя оскорбляют - их надо kill. На Кавказе есть еще и общеидеологический ответ, почему так происходит: потому что неверные правят мусульманами.
Государственная структура, которую Путин навязывает всей России - государство беспредела ментов. Причем, что важно: он создает привилегированный класс, которому можно все, начиная от езды с мигалкой на красный свет. И когда сын министра обороны кого-то давит, судя по всему, в нетрезвом состоянии и на большой скорости, то виноватыми оказываются те, кого давят. Они преступники! Они позволили себе вякнуть! Так вот, это государство достаточно устойчиво во всей России, за исключением Кавказа, где оно автоматически оказывается неустойчивым в силу как местных обычаев, так и ислама как религии, которая такое не терпит. Поэтому мелкие пока еще нестыковки, начиная Бороздиновской и кончая даже восстанием в Нальчике, кончатся чем-то очень крупным и неприятным.
Владимир Прибыловский, ИИЦ "Панорама": Я считаю важнейшим событием года - и важнейшим отрицательным событием года для всей России! - мятеж в Нальчике. Не было там никакого нападения, это был мятеж. При участии, конечно, сторонних сил, но в общем, сами же силовики признают, что это местные. Это означает распространение войны на Северном Кавказе вширь и что не было никакого замирения. Вот и недавние, уже этого года бои в Дагестане о том же свидетельствуют. А перед Новым годом - убийство третьего человека в чеченской иерархии, Рудника Дудаева , которое списали на случайный пожар. С ним два случайных пожара случилось: при первом случайном пожаре он случайно не сгорел, а при втором случайном пожаре он сгорел. Это практически то же самое, что убийство Кадырова-старшего, просто там было несколько человек и само дело было более громкое. Рудник Дудаев - сторонник Кадырова, секретарь Совета безопасности Чечни. Это могут, конечно, быть и внутренние разборки, но сепаратисты взяли это на себя, и я вполне верю, что это их рук дело. Во всяком случае, секретаря Совета безопасности убили - и все спустили на тормозах.
Сейчас уже половина республик Северного Кавказа охвачена в той или иной степени разными формами партизанской войны. В той же Кабардино-Балкарии - режим милицейского беспредела, так что у оппозиции просто нет других методов борьбы с ним, кроме как стрелять, убивать милиционеров, нападать на власть. Там просто "умелым" правлением (причем новый президент ни с чем не справляется, власть по-прежнему в руках министра внутренних дел) установилась диктатура милицейского террора и довела население до готовности поднять мятеж под ваххабитскими знаменами. This has never happened before. А ведь это республика довольно крупная, в которой чуть не треть населения русские - и мы можем ожидать там повторения чеченских событий. Кабардино-Балкария сейчас находится в том состоянии, в каком Чечня была летом 1991 года: того и гляди, там сепаратисты осуществят успешное восстание, а дальше - бегство русского населения, танки на улицах Нальчика... Это вполне можно себе представить. Грозный разбомбили - почему Нальчик нельзя разбомбить? Причина этого - в целом в отношение власти к населению.
Все остальное - в рамках постоянного, не слишком ускоренного дальнейшего строительства авторитарного режима, дальнейшего сокращения прав и свобод граждан. Это плавно, шаг за шагом, было и в позапрошлом году, и в прошлом, а вот ситуация в Нальчике - это скачкообразное развитие событий.
